HomeMy WebLinkAbout6760 W. 38th AvenueWEATHERBOND ROOFING EXTENDED WARRANTY WARRANTY NO.: 1529900 BUILDING OWNER: J&J INVESTMENTS C/O JERRY NEALON NAME OF BUILDING: CRESCENDO FINE AUDIO BUILDING ADDRESS: 6760 W 38TH AVE WHEAT RIDGE, CO DATE OF COMPLETION OF THE WEATHERBOND ROOFING SYSTEM: 10/7/2020 DATE OF ISSUE: 10/7/2020 WeatherBond Roofing Systems (WeatherBond), warrants to the Building Owner (Owner) of the building described below, that subject to the terms, conditions, and limitations stated in this warranty, WeatherBond will repair any leak in the WeatherBond Roofing Membrane caused by deterioration of the membrane due to normal weathering or any manufacturing defect in the membrane for a period of 20 years commencing with the date of substantial completion of the WeatherBond Roofing System. See below for exact date of warranty expiration. WeatherBond's total financial obligation over the life of this warranty shall not exceed the Owner's original cost of WeatherBond materials for the WeatherBond Roofing System. This warranty refers to the WeatherBond brand membrane material only. Flashings, adhesives and any other accessories contained in a membrane system are not covered by this or any other warranty, express or implied. TERMS, CONDITIONS, LIMITATIONS 1. Owner shall provide WeatherBond with written notice to the address printed below within thirty (30) days of the discovery of any leaks in the Roofing Membrane as well as three (3) 12 -inch by 12 -inch samples of the roofing membrane. Two (2) of the samples should be from the suspected leak area and one (1) from another area. By so notifying WeatherBond, the Owner authorizes WeatherBond to investigate the cause of the leak. Should the investigation reveal the cause of the leak to be outside the scope of this warranty, investigation and repair costs for this service shall be paid by the Owner. Failure by the Owner to pay the investigation costs will render this "WeatherBond Roofing Extended Warranty" null and void. 2. If, upon inspection, WeatherBond determines that the leak is caused by defects in the WeatherBond Roofing Membrane material, Owner's remedies and WeatherBond's liability shall be limited to WeatherBond's repair of the leak. 3. This Warranty shall not be applicable if WeatherBond determines that any of the following has occurred: (a) The WeatherBond Roofing Membrane is damaged by natural disasters, including, but not limited to, lightning, insects, earthquakes, hurricanes, fire, tornado, and hail; or (b) The WeatherBond Roofing Membrane is damaged by any acts of negligence, accidents, or misuse, including but not limited to, excessive traffic, recreational activities, storage of materials on the roof, vandalism, or civil disobedience; or (c) The WeatherBond Roofing Membrane is damaged by infiltration of moisture in, through, or around walls, skylights, vents, copings, HVAC units, building structures, or underlying or surrounding areas; or (d) The WeatherBond Roofing Membrane is damaged by the building structure failing to have adequate strength to support all live and dead loads, including water and snow loads, or by any other structural defects or failures; or (e) The WeatherBond Roofing Membrane is damaged by settlement, distortion, cracking, movement or failure of the roof substrate, coping, walls, structural members or components adjacent to the roof or foundation of said building; or (f) The WeatherBond Roofing Membrane is damaged as a result of attack by roof top contaminants such as solvents, petroleum, oil products, acids, or other harmful chemicals. (g) The WeatherBond Roofing System encounters leaks or is otherwise damaged by condensation resulting from any condition within the building that may generate moisture. This Warranty shall be null and void if WeatherBond determines that any of the following has occurred: (a) If, after installation of the WeatherBond Roofing Membrane by a WeatherBond Recognized Roofing Contractor, there are any alterations, test cuts, or repairs made on or through the roof, or objects such as, but not limited to, structures, fixtures, or utilities are placed upon or attached to the roof without first obtaining written authorization from WeatherBond, or (b) Failure by the Owner to follow the WeatherBond care and maintenance instructions, including, but not limited to, periodic cleaning of drains and removal of harmful debris from the roof, or (c) Owner fails to comply with every term and/or condition stated herein, or (d) The WeatherBond Roofing Membrane is not installed according to WeatherBond's current specification at the time of installation. (e) WeatherBond membrane comes in contact with adhesive, sealants, tapes or other accessories manufactured or marketed by companies other than WeatherBond. 5. During the term of this Warranty, WeatherBond shall have free access to the roof during regular business hours. 6. WeatherBond shall have no obligation under this Warranty while any bills for installation, supplies, services, and warranty charges have not been paid in full to the WeatherBond Recognized Roofing Contractor, WeatherBond, or material suppliers. 7. WeatherBond's failure at any time to enforce any of the terms or conditions stated herein shall not be construed to be a waiver of such provision. 8. This warranty is not assignable or transferable in any manner by operation of law or otherwise. 9. WeatherBond shall not be responsible for the cleanliness or discoloration of the WeatherBond Roofing System caused by environmental conditions including, but not limited to, dirt pollutants or biological agents. 10. WeatherBond shall have no liability under any theory of law for any claims, repairs, restoration, or other damages including, but not limited to, consequential or incidental damages relating, directly or indirectly, to the presence of any irritants, contaminants, vapors, fumes, molds, fungi, bacteria, spores, mycotoxins, or the like in the building or in the air, land, or water serving the building. WEATHERBOND DOES NOT WARRANT PRODUCTS UTILIZED IN THIS INSTALLATION WHICH IT HAS NOT FURNISHED; AND SPECIFICALLY DISCLAIMS LIABILITY, UNDER ANY THEORY OF LAW, ARISING OUT OF THE INSTALLATION AND PERFORMANCE OF, OR DAMAGES SUSTAINED BY OR CAUSED BY, PRODUCTS NOT FURNISHED BY WEATHERBOND. While normal aging will occur on all roofs, if not detected early, problems stemming from abuse, contamination, accidents and severe weather can result in extensive and costly repairs or premature failure of the roofing system. Single -ply Roofing Systems are typically low -slope and easy to inspect, but caution must be taken to ensure safety. WeatherBond disclaims and assumes no liability for any rooftop activity. - Owner must retain records related to the roofing system. Such records include, but are not limited to: the warranty document and serial number, maintenance inspection logs, rooftop traffic logs, service logs, and invoices for work performed on the roofing system. - Inspect the roof at least every six months (preferably spring and fall) and immediately following any weather event that includes excessive rainfall, high winds and/or hail warnings. Increased number of rooftop maintenance inspections may be required on some roofs as the location may dictate, such as higher trees near the building which will accumulate leaves and debris on the roof and have adverse effects on drainage. In addition, rooftop maintenance inspections should occur after regular maintenance of any rooftop unit. When inspecting the Roofing System, pay special attention to the following: - Walls/Parapets/Roof Edge — Wind damage often begins at the perimeter of the roof. Ensure all membrane terminations and edge metal and copings are secure. - Roof Deck Membrane — Inspect the field of the roof, scanning for damage caused by wind-blown debris or traffic. - Penetrations/Roof-top Units — Inspect the membrane, flashings and terminations around penetrations and roof -top units for possible damage from service work. Ensure the units and terminations are secure. - Remove debris (leaves, dirt, trash, etc.) — Good roofing practice dictates that water should drain from the roof and that ponded water should evaporate within 48 to 72 hours after a rainfall. Debris can inhibit drainage. Additional Maintenance Items: - Foot Traffic — Walkways must be provided if regular traffic is required or if rooftop equipment has a regular thirty (30) day or less maintenance schedule. - Petroleum Products & Chemicals — Keep all liquids containing petroleum products or chemicals off the membrane to avoid product degradation. - Animal Fats/Vegetable Oils: EPDM Membranes — Do not exhaust animal fats/vegetable oils directly onto EPDM roof surfaces. TPO & PVC Membranes — Animal fats/vegetable oils must be regularly removed and the rooftop surface cleaned with a mixture of soap and water. What to do if a leak occurs: - After verifying the leak is through the roofing system, please contact a local WeatherBond Roofing Contractor of your choice to resolve the leak. - If minor, emergency temporary repairs are made to a suspected leak area, use Lap Sealant or a good -grade rubber caulk to address the repair area (do not use asphaltic roof cement). Please note, WeatherBond is not responsible for the cost associated with any emergency temporary repairs. Alterations to the Roofing System: - Alterations to the Roofing System must be completed by a WeatherBond Authorized Contractor. Included in this packet you will find: • A minor building permit application • A freestanding sign calculation sheet • A wall sign calculation sheet All signs are classified as 'minor' building permits. The following items must be submitted with a permit application for a sign: • A completed minor building permit form (front and back) • A calculation sheet • For wall signs a site plan which shows the entire building (with wall length dimensions), location of street, location of any existing signage and location of proposed signage • For freestanding signs a site plan which shows the location of the building, the size of the building, location of any existing freestanding signs and location of proposed freestanding sign (with distance to property lines) • A detail sheet which shows the height of the proposed sign (freestanding), sign copy with dimensions, electrical information, footer information (freestanding) Please keep copies of the minor building permit and signage calculation sheets on file, as they are required submittal items with any building permit application for a new sign. Freestanding Sign Calculation Sheet You must complete this sheet and include it in the submittal package for any new freestanding signs. You will also need to create a site plan and a detail sheet of the signage. Contractor: You are allowed 1 freestanding sign for every street right-of-way adjacent to your property. The allowable sign size is related to building size. Step 1: Determine the square footage of the building: Building size (in square feet): (This will be inserted in the formula below) Step 2: Complete the appropriate allowable signage formula: If the building is 0 -1,500 square feet in size, you are allowed a 35 square foot sign If the building is 1,501 - 5,000 square feet in size, complete the following: I 1- 1,501 = T 50 = + 35 = Building size Allowed sign size If the building is 5,001 - 50,000 square feet in size, complete the following: - 5,001 500 = + 100 = Building size Allowed sign size If the building is 50,000 + square feet in size, complete the following: I I - 50,001 = ~ - 1,000 + 190 = Building size Allowed sign size The "allowed sign size" may be placed on each side of the freestanding sign. Check here if the sign is existing and you are replacing a cabinet or face with the same size cabinet or face.
