October 5, 20 10 Mr. John Schumacher Chief Building Official 7500 W 29 Avenue Wheat Ridge, CO 80033-8001 Dear Mr. Schumacher, I am very concerned as well as other tenants residing at Clearwater Townhomes that we are continuously smelling fumes from the body shop at R & R Body Shop, 10805 W 44 Avenue in Wheat Ridge. LEGAL INTEREST OF APPELLANTS Appellants are the owners of record of the real property and improvements located at 10805 W. 44th Avenue, Wheat Ridge, Colorado 80033, which real property and improvements are the subject of the Notice and Order, 11. ORDER OR ACTION PROTESTED As noted above, Appellants protest and challenge the Notice and Order which is attached as Exhibit A hereto. Specifically, Appellants protest and challenge the determinations of the Chief Building Official as follows: 1. That "the structure's ventilation system for the paint booth is not compliant with applicable codes and presents a potential health and safety hazard to the occupants and 3. That "the structure has been reported as a nuisance and hazard by occupants of the adjacent properties and been confirmed by the Building Division staff'." Appellants are, not aware of any complaints by any person at any time for events occurring after January 5. 2011. 4. That "the structure does not have adequate ventilation under the requirements of the applicable codes." Appellants assert that the structure has adequate ventilation. 5, That "the proximity of the exhaust discharge piping to the property line poses a public health hazard." Appellants believe that this statement is untrue, as they have never been advised that any person has suffered any illness, injury or health condition as a result of the operation of their business. Further, the location of the vent was approved by the City of Wheat Ridge in 1976. 111. RELIEF SOUGHT Appellants challenge the actions ordered by the Chief Building Official which would require Appellants to perfaim the following acts: 1. Immediately cease operations related to the application of automotive undercoating, paints or finishes; and -2- 2. Obtain the legally required permits, inspections and approvals required to alter the existing ventilation system or install new ventilation system components as necessary to achieve full compliance with applicable codes. Accordingly, Appellants request that the Notice and Order be dismissed and set aside.
