think this building has been illegally converted from commercial to residential. It is zoned "Neighborhood Commercial,"
the county has the structure an office building, and it looks and feels like a little shoppette.
The zoning would potentially allow for residential uses, but there are conditions (see attached if interested) and I haven't
yet asked Meredith or Ken if we could allow it in this building—it supposed to be relegated to the 2nd floor or rear. More
importantly I see no building permits to indicate that a conversion ever took place, and the call Kathy mentioned is the
second in a week that we've had regarding residential use of the space.

SUBJECT: Status of Occupancy— Commercial v. Residential
The property at 11460 W. 44th Avenue is zoned Neighborhood - Commercial and includes a
single story structure with at least 5 separate units. Based on records from the Jefferson County
Assessor's office, the lot area is 11,413 square feet and the building is 3,464 square feet in size
and was constructed in 1971. As of September 2012, the owner of record is Saint Martin Society
Branch 134 of PNA.
Based on the zoning, the property is intended to include primarily commercial uses. Section
26 -626 of the municipal code (residential uses in commercial zones; conditions) residential uses
are permitted on the subject property with certain conditions (see attached code excerpt). Based
on the size of the property, only two (2) dwelling units would be permitted.
The Community Development Department received several inquiries from potential residential
tenants in August 2012. Building permit records indicate that no permits have even been pulled
for a conversion of the building to a residential use. The existing residential of use of 3 units on
the subject property was determinedto be an illegal use based onthe absence of building permits
for a conversion.
John Schumacher and Kirk Cadotte inspected the property and met with the property owners
(John and Jim) to explain that residential uses would require building permits and certain
investments in order to meet residential building codes and separation requirements. A copy of
code section 26 -626 was provided to the property owners.
Ultimately, one of the property owner representatives (Jim) left a voice message on August 24,
2012 at 1:59pm stating that the property will be used exclusively for commercial uses because
the improvements required to convert to residential would be cost- prohbitive.
The property at 11460 W. 44' Avenue shall not include residential uses unless a legal
conversion occurs with a building permit and all conditions of the zoning code are met.
