Where terms are not defined, they shall have their ordinary accepted meanings within the context with wluch they ue used. Webster's Third new Internarional Dictionary of the English Language, Unabridge, copyright 1986, shall be construed as providing ordinary accepted meanings. Words used in the singular masculine gender include the feminine and the feminine the masculine. BiJII.DING CODE is the International Code Council, as adopted by this jurisdicrion DANGEROUS BiTII.DING is any building or structure deemed to be dangerous under the provisions of Section 302 of tlus code. HOUSING CODE is the Uniform Housing Code promulgated by the Intemarional Conference of building Officials, as adopted by flus jurisdicrion. INTERNATIONAL PROPERTY MAINTENANCE CODE is the 2003 Intemarional Property Maintenance Code promulgated by the Intemarional Code Council, as adopted by this jurisdiction. SECTION 302 - DANGEROUS BUII.DING For the purpose of this code, any building or structure which has any or all of the condirions or defects hereinafter described shall be deemed to be a dangerous building, provided that such wnditions or defects exist to the extent that the life, health, property or safety of the public or its occupants aze endangered. 1. Whenevex any door, aisle, passageway, stairway or other means of eacit is not of sufficient width or size or is not so arranged as to provide safe and adequate means of exit in case of fire or panic. 2. Whenever the walking surface of any aisle, passageway, stairway or other means of zxit is so wazped, worn. Loose, tom or otherwise unsafe as to not provide safe and adequate means of elcit in case of fire or panic. 3. Whenever the stress in any materials, member or portion thereof, due to all dead and life loads, is more than one and one half times the worldng stress or stresses allowed in the Building Code for new buildings of similar structure, purpose or location. 4. Whenever any portion thereof has been damaged by fue, earthquake, wind, flood or by any other cause, to such an extent that the shuctiual s4eng[h or stability thereof is materially less than it was before such catastrophe and is less than the aunixnum requirements of the Building Code for new buildings of sunilaz structure, purpose or location. 5. Whenever any portion or member or appurtenance thereof is likely to fail, or to become detached or dislodged, or to collapse and thereby injure persons or damage property. 6. Whenever any portion of a building, or any member, appurtenance or ornamentafion on the exterior thereof is not of sufficient strength or stability, or is not so anchored, attached or fastened in place so as to be capable of resisting a wind pressuce. of one half of that specified in the building Code for new buildings of similaz struchue, putpose or location without exceeding the working s4essed pexmitted in the Building Code for such buildings. 7. Whenever any portion thereof has wracked, warped, buckled or settied to such an estent that walls or other structural porrions have materially less resistance to winds or earthquakes than is required in the case of similar new co¢struction. 8. Whenever the building or slructure,. or any portion thereof, because of (i) dilapidation, deterioraflon or decay; (ri)faulty construction; (m) the removal, movement or instability of any portion of the gcound necessary for the purpose of supporting such buildings; (iv) the deteriorarion, decay or inadequacy of its foundation; or (v) any other cause, is likely to parlially or completely collapse. 9. Whenever, for any reason, the building or shucture, or any portion thereof, is manifestly unsafe for purpose of which it is being used. 10. Whenever the exterior walls or other vertical shuctural members list, lean or buckle to such an extent that a plumb line passing tLrough the center of graviTy does not fall inside the middle on thkd of the base. 11. Whenever the building or structure, exclusive of the foundation, shows 33 percent or more damage or deterioration of its supporting member or members, or 50 percent daznage or deterioration of its non-supporting members, enclosing or outside walls or coverings. 12. Whenever ffie building or shucture has been so damaged by fire, wind, earthquake or flood, or has become so dilapidated or deteriorated as to become (i) an amacrive nuisance to cluldren; (ii) a harbor for vagrants, criminals or ixnmoral persons; or as to (iii) enable persons to resort thereto for the purpose of committing unlawful or iuunoral acts. 13. Whenever any building or structure has been constructed, eaists or is maintained in violafion of any speciFic requirement or prohibition applicable to such building or structure provided by the building regulations of this jurisdiction, as specified in the Building Code or Housing Code, or of any law or ordinance of this state or jurisdiction relating to the condirion, locarion or structure of buildings. 14. Whenever any building or structure wluch, whether or not erected in accordance with a all applicable laws and ordinances, has in any non-supporting part, member or portion less than 50 percent, or in any supporting part, member or portion less the 66 percent or the (i) strength, (ii) fire-resisting qvaliries or chazacteristics, or (iu) weather-resisting qualities or chazacteristics requued by law in the case of a newly constructed building of like azea, height and occupancy in the same location. ' 15. Whenever a building or shuchue, used or intended to be used for dwelling purposes, because of inadequate maintenance, dilapidarion, decay, damage, faulty construction or arrangement, inadequate light, air or sanitarion facilities, or otherwise, is determined by the health officer to be unsanitary, unfit for humau habitation or in such a condirion that is likely to cause siclmess or disease. 16. Whenever any building or structure, because of obsolescence, dilapidated condition, deterioration, damage, inadequate esists, lack. of sufficient fire-resisrive consteuction, €avlty electric wiring, gas connections or heating apparatvs, or other cause,is determined by the fire marshal to be a fire hazard. 17. Whenever any building or structure is in such a condifion as to consritute a pubtic nuisance known to the common law or in equity jurisprudence. 18. Whenever any portion or a building or structure remains on a site after the demolition or des4ucrion of the building or structure or whenever any building or shucture is abandoned for a period in excess of six months so as to consritute such building or portion theieof an attractive nuisance or hazard to the public. The 1997 Uniform Housing Codes states: SECTION 1001- DEFINITIONS 5001.1 General. Any building or portion thereof that is determined to be an unsafe building in accordance with Section 102 of the Building Code, or any building or portion thereof, including any dwelling unit, guest room or suite or rooxns, or the premises on which the same is located, in which there exists any of the conditions ieferenced in this section to an extent that endangers the life, limb, health, property; safety or welfaze of the public or the occupants thereof, shall be deemed and hereby are declazed to be substandazd buildings. 1001.2 Inadequate Sanitation. Buildings or portions thereof shall be deemed substandazd when they are when they are in sanitary. Inadequate sanitation shall include, but not be limited to, the following; 1. I.ack of or improper water closet, lavatory, bathtub or shower in a dwelling unit or lodging house. 2. Lack of or improper water closets, lavatories, and bathtubs or showers per number or guests in a hoteL 3. Lack of or improper kitchen sink in a dwelling unit. 4. Lack of hot or cold running water to pluxnbing fixtures in a hotel 5. Lack of hot or cold rnvuing water to plumbing fixtures in a dwelling unit or lodging house. 6. Lack of adequate heating facilities. 7. Lack of or improper operarion ox requiied venffiaring equipment. 8. Lack of minimum amounts of natural light and venrilarion require by tlus code. 9. ' Room and space dimensions less than tequired by this code. 10. Lack of required elechical lighting. 11. Dampness of habitable rooms. 12: Infestarion of insecu, vermin or rodents as detemilned by the health officer. 13: General dilapidation or improper maintenance. 14. Lack of connecfion to required sewage disposai system. 15. Lack of adequate gazbage and rubbish storage and removal facilities as detemiined by the health officer. 10013 Structural Hazards. Buildings or portions thereof shall be deemed substandazd when they are or contain shvchual hazazds. Structural hazazds shall include, but not be limited to, the following: 1. Deteriorated or inadequate foundarions. 2. Defecrive or deteriorated flooring or floor supports. 3. Flooring or floor supports of insufficient size to carry imposed loads with safety. 4. Members of walls, partirions or other vertical supports that split, lean, list or buckle do to defective material or deteriorations. 5. Members of walls, partirions or other vertical supports that are of insufficient size to carry imposed loads with safety. 6. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that sag, split or buckle due to defective material or deteriorarion. 7. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that are of insufficient size to carry imposed lads with safety. 8. Fireplaces or chimueys that list, bulge o settle due to defecrive material or deterioration. 9. Fireplaces or clumueys that are of insufficient size or strength to carry imposed loads with safety. 1001.4 Nuisance. Buildings or portions thereof in which there exists any nuisance as defined in this code are deemed substandard btildings. 1001.5 Hazardous Electrical Wiring. Electrical wiring that was installed in violation of code requirements in effect at the time of installation or electrical wiring not installed in accordance with generally accepted construction practices in areas where no codes were in effect or that has not been maintained in good condition or that is not being used in a safe manner shall be considered substandard. 1001.6 Hazardous Plumbing. Plumbing that was installed in violation of code requirements in effect at the time of installation or plumbing not installed in accordance with generally accepted construction practices in areas where no codes were in effect or that has not been maintained in good condition or that is not being used in a safe manner shall be considered substandard. 1001.7 Hazardous Mechanical. Mechanical equipment that was installed in violarion of code requirements in effect at the time of installation or mechanical equipment not installed in accordance with generally accepted construction practices in areas where no codes were in effect or that has not been maintained in good condition or that is not being used in a safe manner shall be considered substandard. 1001.8 Faulty Weather Protections. Buildings or portions thereof shall be considered substandard when they have faulty weather protecrions, which shall include, but not be limited to, the following: 1. Deteriorated, crumbling or loose plaster. 2. Deteriorated or ineffective waterproofing or exterior walls, roof, foundations or floors, including broken windows or doors. 3. Defective or lack of weather protection for esterior wall coverings, including lack of paint, or weathering due to lack of paint or other approved protective covering. 4. Broken, rotted, split or buckled esterior wall coverings or roof coverings. 1001.9 Fire Hazard. Any building onportion thereof, device, apparatus, equipment, combustible waste, or vegetation that, in the opinion of the chief of the fue department, is in such a condition as to cause a fire or explosion or provide a ready fuel to augment the spread and intensity of fire or explosion arising from any cause shall be considered substandazd. 1001.10 Faulty Materials of Construction. The use of materials of cons4ucrion, except those that are specifically allowed or approved hy this code and the Building Code, and that have been adequaieiy maintained in good and safe condiHons, shall cause a building to be substandud. 100111 Hazardous or Insanitary Premises. The accumulation of weeds, vegetation, junk, dead organic matter, debris, garbage, offal, rat harborages, stagnant water, combustible materials, and similar materials or conditions on a premises constitutes fire, health or safety hazards that shall be abated in accordance with the procedures specified in Chapter 11 of this code. 1001.12 Inadequate Eaits. Except for those buildings or portions thereof that have been provided with adequate exit facilities conforming to the provisions of flus code, buildings or portions thereof whose exit facilities were installed in violation of code requuements in effect at the time of their cons4ucrion or whose exit facilities have not been increased in number or width in relations to any increase in occupant load due to alterations, additions or change in use or occupancy subsequent to the time of construcrion shall be considered substandard. Notwithstanding compliance with code requirements in effect at the time of their construction, buildings or portions thereof shall be considered substandazd when the building official finds that an unsafe condition exists through an improper location of exits, a lack of an adequate number or width of exits, or when other condirions eacist that aze dangerous to human life. 1001.13 Inadequate FSre-Protection or Fire-Fighting Equipment. Buildings or portions there of shall be considered substandazd when they aze not provided with the fire-iesistive construction or fire- eactinguishing systems or equipment required by this code, except those buildings or portions thereof Yhat conformed with all applicable laws at the time of their construction and whose fire-resistive integiTy and fire-extinguishing systems or equipment has been adequately maintained and improved in relation to any increase in occupant load, alteration or addition, or any change in occupancy. 100114 Improper Occupancy. All buildings or portions thereof occupied for living, sleeping, cooking or d'uung purposes that were not designed or intended to be used for such occupancies shall be considered substandard. The following is a list of items that shall be fixed to meet code: 1. 2. 4. Slab in Boiler room is sinking and making the shucture unsafe. 17. Holes in walls need to be filled. 18. Cable wiring is hanging. 19. No screens on soxne windows. 20. Need proper drainage from building. 21. Uncovered dumpster 22. Trash all over site shall be cleaned up. 23. NOTE THAT TFIE BUILDING DEPARTMENT NEEDS TO INSPECT THE INSIDE OF EACH U1VIT FOR LIFE SAFETY ISSUE5 AND SO THIS LIST MAY NOT BE THE ONLY ITEMS THAT NEED TO BE COIiRECTED. ORDER 1. The City of Wheat Ridge Building Official has deternuned the building referenced above to be a Dangerous Building. The Building Department wiil post the building as a Dangerous Building due to the amount of life safety issues. Pursuant to Code these spaces shall not be rented out to new tenants until all these items have been addressed. If the following items have not been fixed by February 28, 2006 the current occupants will be required to vacate the property.. This is therefore required in brder to protect life, health and safety of the public. II. The owners are ordered to pull a building permit to fix the deficient items. The Building DepartmenYwill post the building as a Dangerous Building due to the amount of life safety issues. Pursuant to Code ail occupants shall be required to vacate the property. This is therefore required in order to protect life, health and safety of the publia III. If the structure has not been brought to code or demolished by February 28, 2006. Section 801 in the Unifotm Code for the Abatement oF Dangerous Buildings states, "801.1 Procedure. When any work of repair or demolition is to be done pursuant Section 701.3, Item 3, of this code, the building official shall issue an order thereof to the director of public works and the work shall be accomplished by personnel of this jurisdiction or by private contract under the direction of said director. Plans and specifications therefore may be prepared by said director, or the director may employ such architectural and engineering assistance on a contract basis as deemed reasonably necessary. If any part of the work is to be accomplished by private contract, standard public works contractual procedures sha11 be followed." Section 801.2 states, "801.2 Costs. The cost of such work shall be paid from the repair and demolirion fixnd, and may be made a special assessment against the property involved, or may be made a personal obligation of the property owner, whichever the legislative body of tlus jurisdiction shall determine is appropriate." The property owner and all occupants are hereby ORDERED TO CEASE AND DESIST occupancy and use of the above described building. The Building Official shall cause the property to be posted with the attached Notice and shall take action to remove all future occupants from the building until the building is brought up to code. REMEDIAL ACTION 1. The property owner must apply for and obtain a City of Wheat Ridge building pemut to correct any deficiencies. IV. All deficiencies shall be fixed but are not limited to the items on this list. APPEAL OF THI5 NOTICE AND ORDER Any person having record title or other legal interest in the above described premises may appeal this Notice and Order or any acrion of the Building Official to the Building Code Advisory Boazd or known as the Board of Appeals pursuant to section 112 of the Code, provided that the appeal is made in writing as provided in the Code and filed with the Building Official within ten (10) days from the date of service of this Notice and Order. Failure to appeai will constitute a waiver of all rights to an administrative hearing and determination of this matter. FILING OF AN APPEAd.
