In order to pass a final inspection on commercial elastomeric or similar type roofing, a
letter of inspection and approval from the manufacturer technical representative stating
that "the application of the roof at (project address) has been applied in accordance with
the installation instruction for (roof material brand name) roof covering" is required to
be on site at the time of final inspection.
Effective December 1, 2014, asphalt shingle installations require an approved midroof
inspection, conducted when 25-75 percent of the roof covering is installed, prior to final
approval. Installation of roof sheathing (new or overlay) is required on the entire roof
when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and
Mid -roof inspections may be called in at the same time, 100 percent of the sheathing must
be complete and 25-75 percent of the midroof may be complete. Asphalt shingles are required
to be fastened to the roof deck with a minimum of 6 nails per shingle. A ladder extending 3
feet above the roof eave and secured in place is required to be provided for all roof
inspections. Roof ventilation is required to comply with applicable codes and/or
manufacturer installation instructions, whichever is more stringent.

2. This permit shall expire 365 days after the date of issuance regardless of activity. Requests for extension must be made in writing and
received prior to the date of expiration. An extension of no more than 180 days made be granted at the discretion of the Chief Building
Official and may be subject to a fee equal to one-half of the originalpermit fee.

6. The issuance or granting of a permit shall not be construed to be a permit for, or an approval of, any violation of any provision of any

I am writing regarding your interest in opening a major auto repair and auto sales business at 9200
W. 44 Avenue in Wheat Ridge. This property is zoned Commercial -One (C -1). Under the C -1
zoning, both auto sales and major automotive repair are special uses, which means that a special
use permit (SUP) is required prior to either type of use operating on the property. An SUP was
approved for this property for major auto repair in 1984 (Case Number SUP- 84 -09). There is no
SUP on record that approves auto sales at this location, however the City has previously approved
auto sales business licenses at this location, most recently in 2008 for the business called
Buydirect Autoz.
The following paragraphs summarize our determination as to whether you can open a new
business with (1) major auto repair and (2) auto sales at this location and whether an SUP is
required.
Major Automotive Repair
At the time that SUP -84 -09 approved major auto repair at this location, SUP's were adopted by
ordinance and viewed as a change to the zoning map. It therefore appears that the SUP runs with
the property, rather than with one specific business, and thus it is still valid. Even if the SUP is no
longer valid, the City approved a major auto repair business license at this location in 2008 for the
business called Buydirect Autoz. Since Buydirect Autoz has only been out of business for
approximately five months, major auto repair could continue at this property under new ownership
as a legal nonconforming use, per Section 26 -120.0 of the Wheat Ridge Zoning Code, without a
new SUP.
Auto Sales
There is no SUP on record for auto sales at this property. However, the City approved an auto
sales business at this location in 2008, under the name Buydirect Autoz. This means that the auto
sales use is legal nonconforming. Per Section 26 -120.0 of the Wheat Ridge Zoning Code, legal
nonconforming uses can remain and change ownership as long as the nonconforming use is not
discontinued for a period longer than 12 consecutive months. Since the 12 -month period has not
been fulfilled, the legal nonconforming use of auto sales could continue under new ownership
without first obtaining a SUP.
In summary, no SUP will be required at this time since the business with major auto repair and
auto sales went out of operation about 5 months ago, which is within the 12 -month timeframe. If
the use of major auto sales is discontinued for a period of 12 consecutive months, then an SUP for
auto sales would be required before that use could be resumed on the property.
