This Memo is to inform you that all of the above-mentioned documents for this development have been reviewed and aze hereby approved (with comments) for construction by the Department of Public Works. A copy of the approved plans is to remain on-site during construction. The Engineer-of-Record also needs to be aware of the following items regarding the construction of the project: Engiueered Drawings for Retaining Wall Required Engineered drawings for the proposed retaining wall, signed and sealed by a Professional Engineer licensed in the State of Colorado, will need to be submitted for review and approval prior to the commencement of wall construction. No CeMificate of Occupancy for Lot 2A or Building Permit for Lot 3A will be issued until the wall design has been reviewed and approved. 2. Application for Minor Grading/Fill Permit Prior to the commencement of any onsite grading, an Application for a Minor Grading/Fill Permit, along with the fees due will need to be submitted for review and approval. 3. Written Approval Required Prior to Off'site Construction Written approval must be obtained from all affected owners and a copy provided to the City for the irrigation ditch relocation and for any proposed offsite construction work, prior to commencement of the work. 4. Grading and Erosion Control The erosion control for the project shall be in place prior to the commencement of any grading activities, and maintained as needed during [he course of construction. Please be advised that additional erosion control measures may be required if deemed necessary by the Ciry Inspector. 5. Public Improvement Restoration/Debris Tracking It will be the responsibility of the of the contractor for the project to repair any damage to the existing public improvements along West 30'" Avenue as a result of related construction traffic in the area. Also, the contractor will be responsible for maintaining West 30"' Avenue on a regular basis such that it remains free of construction debris and tracking from construction traffic accessing the site. Right-of-Way Construction Permit(s), Licensing, and Bonding Prior to any construction within the public right-of-way, the necessary Right-of-Way Construction Permit(s) and respective licensing will need to be submitted for processing by the City. Right-of-Way Construction Permits are issued only after approval of all required technical documents, including but not limited to, the Final Drainage Report & Plan, Final Plat, Final Development Plan, Traffic Impact Study, Storm Sewer Plans, Street Construction Plans, Grading & Erosion Control Plan, Traffic Control Plan, and easement or ROW dedications. In addition, if the cost of the proposed public improvements exceeds $10,000, additional warranty bonding shall be required. 7. 2-Year Warranty Period fbr Public Improvements The contractor shall warrant all work performed within the public Right-of-Way for a period of two (2) years, commencing upon completion of all constructed public improvements and Final Acceptance by the City Inspectoc Prior to the expiration of said 2-yeaz Warranty Period, if the City Inspector at any time deems that the constructed public improvements are in such condition as to require replacement or repairs, the contractor shall complete such repair work upon request per the City of Wheat Ridge Permit Testing and Inspection Requirements. 8. Drainage CeMification Required Prior to C.O. or C.C. Upon completion ofthe drainage improvements, the Engineer-of-Record Mr. William J. Logan, P.E., shall provide to the City of Wheat Ridge a written, signed and sealed Drainage Certification Letter stating that the overall site grading was completed per the approved Grading/Drainage Plan, all drainage facilities were conshucted per the approved construction plans and shall function as defined in the approved Drainage Letter, and that the site has been accurately surveyed to confirm that the grading and construction of all drainage facilities was completed in accordance with these documents. The Drainage Certification Letter shall be submitted to the Ciry for review and approval, and shall be accompanied with As-Built Plans for all constructed drainage facilities prior to issuance of any Certiticates of Occupancy. Two (2) copies of the "As-BuilY" Plans shall be submitted as follows: a. 1 copy is to be on full-size 24" X 36 " bond paper, signed and sealed, and b. 1 copy is to be on electronic media (DVD or CD-ROM) and shall be in AutoCAD 2000- 2007.dwg format only. 9. Materials Testing for Construction within the Public Right-of-Way It will be the responsibiliry of the developer/owner, to provide the necessary testing, as applicable for the scope of this project, for sub-grade compaction and other related material tests for any improvements to be constructed within the public Right-of-Way. Unless otherwise designated, all referenced specifications, standards or policies shall be the latest edition as revised or updated by approved supplements published and issued prior to the date of the building permit. REQUIREMENTS All materials sampling and testing shall be performed by certified, experienced and qualified materials testing technicians who work under the supervision of a registered professional engineer in the State of Colorado. All materials sampling and testing equipment shall be serviceable and have cunent calibrated certifications. Soil classifications and moisture-density curves shall be provided to the Departrnent of Public Works inspector prior to in-place density testing. Materials testing technicians shall furnish copies of failed test results to the inspector as promptly as the results become available. On a weekly basis when testing is being performed, the developer shall furnish the inspector with copies of all test results taken during the prior week and a cover letter, signed by the supervising registered professional engineer, which summarizes the results and discusses any failed tests or inconsistencies. The City materials testing requirements are provided in Table 720-1. All testing procedures of verification and central lab requirements shall be as specified in the Frequency Guide Schedule of the Colorado Depar[ment of Transportation Field Materials Manual. One test is required for any fraction of the specified frequency. The subdivision is surrounded by existing residential development and fronts West 30'h Avenue along the north property line. Numerous easements are contained within the site and an existing irrigation ditch on lot 3a is to be relocated to allow for the proposed building. Proposed development consists of three 4,600 square-feet residential duplexes. Approximately 11,300 square-feet of paved surface and 14,200 squaze-feet of vegetation will remain after completion. The subdivision is less than one acre in size and has a number of existing topographical and physical constraints. The first single-family residence is considered to be existing, as it was constructed prior to the subdivision. The new development will only be two proposed single-family residences. No detention is required for this development based upon these facts. The site crests across lot 3a and slopes north to West 30`h Avenue and south to the adjacent lot. The drainage is desigied to minimize runoff to the adjacent properties and to provide a degree of water filtration through grass lined drainage swales. Ali roof drains are to be directed into the proposed grass- lined swales. The proposed drainage plan collects the majority of the rainfall in Basins A and B and drains runoff northerly to the existing drainage ditch along 30`h Avenue. The common drive lane in basin A is cross-sloped away from the west property line into the grass lined channel between the buildings and the driveway. Although the grades of this channel aze steep due to site restrictions, the grades decrease as the water flows towards West 30`h Avenue. This will achieve water quality in the grass lined channel. A similar a-ass lined channel is proposed in basin B along the east property line. A limited azea designated as basin C directs runoff to the south and matches the existing grade break in lot 3a. Both the 5-year and 100-year runoff estimations are included on the drainage plan. The proposed drainage swales have sufficient capacity to channel the 100-year runoff from basins A and B to the existing drainage ditch along the front of the property. The grass lined channels shall be maintained to provide proper flow by the owners of the correlating lots. Runoff from Basin C will sheet flow over grass surfaces to the south and should have a minimal impact on the adj acent lot. The existing irrigation ditch located in lot 3a shall be relocated to the center of the proposed irrigation easement to the south of the single family residence on lot 3a. The end of the existing 12 inch corrugated metal pipe (CMP) shall be exposed and a concrete structure larger than the CMP shall be cast around the end of the existing pipe. The concrete structure shall continue in the direction of flow and connect to a manhole shown on sheet C1.2 as ST MH-A. This irrigation system then tums south to a 12 inch RCP and connects to ST MH-B. The system then transitions to a 12 inch HDPE pipe that is located in the center of the proposed irrigation easement and drains to the existing cistern at the eastem edge of the irrigarion ditch. Details for the irrigation conduit can be seen on sheet C23. Drawings 2 and 3/SP1.1 show that the single family residence on lot 3a does not lie within the irrigation easement. The easement is wide enough to provide sufficient azea for the proposed irrigation system to be installed and for the structure on lot 3a to be constructed without interfering with the irrigation conduit. A permit must be obtained prior to conducting any repair work on the structure. The Building Division shall issue a permit for work that is related only to the repair of the firewall and roof parapet exception that has been improperly installed. 2. Shoring shall be installed as necessary to allow far the removal of the structure to access the firewall and insure the safety of the warkers on tlie project. 3. The roof sheathing shall be removed and replaced in a fashion that staggers the end-seams a minimum of two feet from course to course, and that ensures that fire-retardant plywood extends a minimum of four (4) feet to each side of the required firewall. The roof sheathing is required to be nailed at 6" o.c. at edges and 12" o.c. in field, and must be inspected prior to being concealed. Tbe firewall is required to extend from footing to roof sheathing, uninterrupted, and into any soffits or projections, on both sides of each one-hour wall. Gypsum board on each wall shall be nailed at a maximum of 7" o.c. throughout, shall be 5/8" exterior-rated, and shall have all vertical seams land on framing members, and all horizontal seams shall be b]ocked of be taped and mudded air tight. Areas between joists in the floor system that are required to have gypsum board applied shall be complete pnor to final approval of the firewall system. All work shall be inspected and approved prior to concealment. 5. Fire-rated drywall that is removed shall not be re-uscd. Fire-rated sheathing that is removed and re-used shall be free of holes and defects. 6. Upon completion of the fire wall and parapet corrections, the obtained permit shall be closed and no other work wili be permitted unti] a permit for the full construetion of the building is obtained. The Stop Wark order shall remain in place until such time that the permit for full construction is obtained. Approvals from planning, sanitation, water, WR fire and any other applicable agencies shall be required priar to issuance of the permit for construction of the building. Schumacher, Jr., CBO 61( DATE: Apri130, 2008 SUBJECT: 6350-60 W. 38~' Avenue - Hyland Enterprises On February 20, 2008, at the request of the Building Division, Community Services Officer Jennifer Barbagiovanni issued summonses to six individuals working at 6350-60 W. 38Ih Avenue in the City of Wheat Ridge for failure to obtain the lawfully required building permits. These individuals appeared in City of Wheat Ridge Municipal Court on April 3, 2008, and plead guilty to chazges, with sentencing scheduled for May 1, 2008. The court advised these individuals that sentencing would be based in part on the level of compliance with municipal and building codes that was achieved prior to the sentencing date. Post heazing, at the request of Craig Brazanskas, defendant, and representative of Hyland Enterprises, project owner, a memorandum was composed outlining the requirements to achieve compliance with municipal and building codes, which was forwarded to Mr. Brazanskas via facsimile on April 11, 2008. Confirmation of the facsimile was received and receipt acknowledged by Mr. Brazanskas. (See attached) Item # 1 of the April l lth memorandum states that "a permit must be obtained prior to conducting any repair work on the structure. The Building Division shall issue a permit for work that is related only to the repair of the firewall and roof parapet exception that has been improperly installed." On April 21, 2008, Mr. Brazanskas contacted the Building Division to request an inspection of the repair of the firewall system that was underway. No permit for this work has been obtained, as was required in the memorandum of April 11, 2008. No other permits have been issued for the construction of this structure. A Stop Work Order, originally posted on February 20, 2008, remains posted on the structure. On Apri122, 2008, workers were found to be again working on the project, at the direction of Mr. Brazanskas, without the required permit. Mr. Brazanskas and the workers at the project are again in violation of the following municipal and building codes: City of Wheat Ridge Municipal Code Section 5-33, Building Permit Required- "No person...shall...repair...any building...without first having obtained a permit for the specific work to be performed from the building inspection division." City of Wheat Ridge Municipal Code Section 5-85 adopts the 2003 International Residential Code. City of Wheatll,~Oge % C;pMMUNITY DEVELOPMENT Under the International Residential Code Section 1051, Permit required, "Any owner or authorized agent who intends to...repair...a building or structure shall first...obtain the required permit" Additionally, Mr. Brazanskas and the other individuals are now in violation of the following building code section: Under the International Residential Code Section 114.2, Stop Work Order, Unlawful Continuance, "Any person who shall continue any work in or about the structure after having been served with a stop work order...shall be subject to penalties as prescribed by law." A complete application and plans for the construction of the structure at 6350-60 W. 38"n Avenue has not been received by the Building Division as of this date, and many of the issues related to the proper installation of infrastructure remain unaddressed or incomplete. In the process of attempting to rectify this situation, the Building Division has discovered that Mr. Hyland's LLC was delinquent in its' requirements with the State of Colorado, and that his subcontractors were not properly licensed or insured in accordance with City of Wheat Ridge Municipal Code, Sections 5-115, Contractors License Required, 5-103, Responsibility of licensees, and Section 5-125, Bond and insurance required. When considering sentencing on the summonses issued on Februazy 20, 2008, the Building Division respectfully requests that the court consider that the individuals involved committed a second offense of working without the required permit, this despite the courts' previous advisement to the defendants to ensure that a permit was obtained prior to warking on this project, and the written direction from the Building Division stating the same.
