The proposed shed is detailed at an overall height of 12 feet located 5 feet from the western property line. Pursuant to Section 26-209 of the Wheat Ridge Code of Laws, a shed which is in excess of 8 feet in height must have a setback of at least 10 feet from any property line. You have a few options to remedy this situation. You may move the proposed shed five feet to the east. After reviewing aerial photographs, it may be difficult to locate the shed 10 feet from the western property line, given the existing location of the detached garage. You may choose to lower the overall height of the shed. The Code states that for any shed less than 8 feet in height, the setback from any property line shall only be 5 feet. Height is measured to the midpoint of the roof, between the eave and the peak. The current shed, although 12 feet to the peak, is only considered 9.3 feet tall (measured to the midpoint of the roofl. If neither of these options is amenable, you may choose to apply for a setback variance. This will require the submittal of a variance application, a copy of a survey or improvement location certificate and a fee of $390. A public hearing in front of the Board of Adjustment is required. They will decide to either approve or deny your request, based upon the evidence submitted and heard at the public hearing.
