This parcel was recently purchased by Randy Ketelsen who is intending on using the property for the servicing of campers for sale on the adjacent property. The new owner is also interested in the specific zoning restrictions on the property which is what Pm responding to by this letter. The property was rezoned to PID (Planned Industrial Development) in 1976. The regulating document is a recorded development plan called D and M Subdivision Amendment 42, a cop of which has been attached. Generally in a plaruled development, the development plan illustrates how the property can be used and what physical improvements can occur. Staff has concluded that the proposed use of the property for the servicing and detailing of campers is an allowed use. In regard to development on the property, you have asked the following questions: The property owner has had problems with vandalism to his inventory at his existing location further to the west. Is it possible to build a 6' high fence with gate that can be closed at night? The fence would run along the front property line and would restrict vehicles from entering and exiting the lot at night. There is an existing split wood rail fence which runs across the front property line. This fence appears to decarative in nature, rather than functional. A 6' high chain link fence sunounds the rear portion of the property. The fence regulations in the city of Wheat Ridge provide that from the front wall of the building to the back property line, a fence can be 6' in height. Fences located within the area beriveen the front wall of the building and the front property line are limited to 4' in height. Since a 6' high chainlink fence is not shown along the front property line, an amendment to the existing final development plan would have to be pursued. A fence height variance would not be required as there is flexibility written into the planned development process. The property owner is interested in displaying several of the units for sale in the landscaping at the front of the property. Is this possible? In all of the City's planned developments, areas used for display must be shown as such on the development plan. It is unacceptable to use areas intended as landscaping for display. This is also something that could be pursued as a development plan amendment. Staff believes this issue merits further discussion as this displaced landscaping should be made up elsewhere in the Front of the building. It is unlikely that a plan amendment would be approved which didn't compensate for the displaced landscaping. The oroper[v owmer is interested in mal<ing outdoor lighting imnrovements nn the property. What will be required? A lighting plan must be submitted and reviewed as a building permit. Section 26-30(S) of the Wheat Ridge Code of Laws provides that any lighting on private property shall not "spillover" onto adjacent property, nor shall it interfere " with reasonable enjoyment of adjacent land uses". The property has residential development to the southeast of it. Any lighting improvements must be sensitive to this adjacent residential development. How will the existing moratorium on the issuance of building perxnits affect the property improvements indicated above? The moraforium for building permits was adopted in September of 2000. The moratorium applies to all extemal remodels, renovations and additions and for new construction within certain areas within the city. The property in question is located in the moratorium area, however, at the time of this writing the extent of the improvements described above would not be affected.. It may be possible that this is an area where increased standards may be considered appropriate based on recommendations from the streetscape project consultant. We will have more information regarding the extent of upgraded standards as we move through the process. Completion of the project is anticipated in March of 2001. The development plan amendment process can take from four to six months to complete. Public hearings are required in front of both Planning Commission and City Council. Section 26-30(S) of the Wheat Ridge Code of Laws provides that any lighting on private property shall not "spillover" onto adjacent property, nor shall it interfere " with reasonable enjoyment of adjacent land uses". The property has residential development to the southeast of it. Any lighting improvements must be sensitive to this adjacent residential development. How will the existing moratorium on the issuance of building permits affect the property improvements indicated above? The moratorium for building permits was adopted in September of 2000. The moratorium applies to all extemal remodels, renovations and additions and for new construction within certain azeas within the city. The property in question is located in the moratorium area, however, at the time of this writing the extent of the improvements described above would not be affected.. It may be possible that this is an area where increased standards may be considered appropriate based on recommendations from the streetscape project consultant. We will have more information regarding the extent of upgraded standards as we move through the process. Completion of the project is anticipated in Mazch of 2001. The development plan amendment process can take from four to six months to complete. Public hearings aze required in front of both Planning Commission and City Council.
