We dug the sewer up on Wednesday (3/10/04). We found the sewer pipe separated and a rock
was in the pipe. It looked like when it was backfilled the pipe was separate at that time, we also
found a beer can on top of the pipe. When the pipe was installed they did not install pipe bedding
azound the pipe, which should have been done according to city code. The city code on this is 6"
of pipe bedding is to be placed on top of the pipe. There was only about 1" of bedding on top and
bottom of the pipe. The dirt azound the pipe was very wet and was biack from the sewer leaking
it had been leaking for a long time.

Your compiaint involving Richard Todd in was received by the Real Estate
Commission on March 22, 2004. The complaint was assigned to the undersigned
Investigator and entered into our permanent record. As part of our investigative process, a
copy of the complarnt has been sent to the licensee with a request for a writter. response.
The Real Estate Commission's jurisdiction is limited to the license law and the
imposition of discipline against licensees where violations of license law are proven or
admitted. The Commission has no jurisdiction with regard to Civil Action claims (e.g.:
money damages), or authority to settle contractual disputes. If appropriate, you may wish
to discuss the possibility of filing a civil action in this matter with an attorney. If your
claim is under $ 7,500 you may consider filing in small claims court. Your efforts through
the courts can run concurrent with any action this office may take.
Complaints involving an immediate threat to the public (e.g.: theft, conversion of
iunus) are given tne iiiguest priority. Other types of complaints are generaily handied in
chronological order, based on the date that they were filed with the Commission.
Therefore, it may take several months to complete the investigation.
We will contact you for an interview. During the course of the investigation the
investigator will assess the evidence of the alleged misconduct gathered through interviews
and statements of principals, independent witnesses, and the review of relevant documents.
The final disposition of the complaint is based on the weight of the evidence supporting the
allegation of misconduct, not the allegation itsel£ If the complaint is referred to formal
hearing, the Commission has the authority to impose an administrative fine, require
additional education, censure a licensee, place the licensee on probation, temporarily
suspend, or permanently revoke a license. Complaints may be dismissed for a lack of

sufficient evidence or because of a satisfactory settlement to the matter negotiated
between yourself and the licensee. When the investigation is complete, you will be
