SUBJECT: Subsurface Investigation & Engineering Analysis
Lot 14, Lee's Subdivision, Jefferson County, Colorado
Mr. Turgeon:
Three test pit excavations at the subject location were observed
on June 24, 1996, to evaluate subsurface conditions and provide
foundation design recommendations.
Plans call for construction of several two story, multi-family
residences over crawl spaces. Wood and concrete masonry
superstructures will be supported by reinforced concrete
foundations.
Excavation locations are indicated in Figure l, Test Hole
Location Plan. The soil profile exposed in the excavations was
very consistent and is summarized below:
0- 2 Feet SAND; slightly to moderately clayey, silty,
gravelly, slightly to moderately organic, medium
dense; slightly moist, brown to dark brown, (SC).
2- 8 Feet SAND; very gravelly, to GRAVEL; very sandy, fine
to very coarse grained, slightly clayey, medium
dense, moist to wet, (SP-GP).
Soils are non-cohesive and samples suitable for swell
consolidation testing could riot be obtained. Soils should have
very low to nil swell poEential. Consolidation potential should
be low.
Groundwater was encountered in all test pits at depths of four to
five feet. Groundwater may be slightly more shallow during
periods of heavy precipitation and water infiltration.
Foundations should be kept as shallow as possible to prevent
excess moisture in crawl spaces and.problems during excavation
and construction.

The structures can be supported on a continuous spread footing
foundation designed for a maximum contact pressure of 2000 psf.
Contact pressure should be calculated using full dead load plus
full live load.
Foundations should be constructed on existing soils that are
smooth, even and free of loose soil, rocks and debris.
Foundations should not be constructed on frozen or saturated
soils.
Drain systems should be constructed around the interior
foundation perimeters. The drains should be graded to a sump pit
within the crawl space areas. The sump should be fitted with an
automatic pump to discharge water a minimum of ten feet from
foundations.
Particular attention should be given to proper grading of drain
pipe. Improper grading, such as high or low spots in the drain
pipe, could lead to drain failure and over wetting of foundation
bearing soils resulting in damage to the foundation and
superstructure.
Backfill placed against foundation walls should be free of trash
and fragments of rock over six inches in maximum diameter,
moistened, and adequately compacted to prevent settlement.
Excessive compaction may cause damage to foundation wall.
Foundation walls should be a minimum of seven days old prior to
backfilling. All walls over 4.0 feet high should have floor
'
systems in place or be well braced to prevent damage from lateral
pressure.
The area surrounding foundation walls should have a positive
slope away from the walls. A one foot drop in elevation for the
first ten feet away from walls is recommended. The owner should
periodically inspect the surface around the foundation to locate
and correct grading problems which may occur due to settlement of
foundation backfill.
Lawn and landscaping irrigation should be controlled as much as
possible to prevent additional wetting of subsoils. If a
sprinkling system is installed, heads should be placed so that
spray does not fall within five feet of foundation walls.
Decorative landscaping, such as rock and/or bark should be used
in areas directly adjacent to foundation walls. Shrubbery
planted within five feet of foundation walls should be hand
watered and this watering should be minimized.

Downspouts and sill cocks should not be allowed to discharge
directly onto the ground surface. Splash blocks and/or downspout
extensions should be used wherever possible to discharge water
beyond the limits of foundation backfill where backfill soils are
not covered by pavement and/or sidewalks.
The owner is encouraged to read Landscapinq and Home Maintenance
on Swellina Soils, Special Publication No. 14, available from the
Colorado Geological Survey. Soils at this site are not
expansive, however, recommendations contained in the report are
applicable to all construction in the Denver area.

OPTION TO PURCAASE REAL PROPERTY

This Agreement made this 1996, by and
between Port Orchard Development Co. (Optionor), and James R.
Turgeon (optionee).
RECITALS
1. Optionor is the owner of that real property described as:
11600-11700 W. 46th Avenue, Wheatridge, Colorado.
2. Optionee desires to obtain an Option to Purchase the
described real property on the terms and conditions set forth
herein:
NOW, THEREFORE, based upon the mutual covenants and
conditions, IT IS HEREBY AGREED AS FOLLOWS:
3. oPTION. Optionor grants to Optionee the exclusive right
to purchase the real property described herein on the terms and
conditions hereinafter set forth.
4. PURCHASE OF OPTION. In consideration for the granting
of this Option:
a. Optionee shall pay to Optionor the sum of
FIVE HUNDRED DOLLARS AND N01100 ($500.00),
payable upon exercise of the option.
1 - OPTION
5. EXERCISE OF OPTION: Optionee may exercise this Option by
delivering, personally or by certified mail, to Optionor written
notice of Optionee's intent to exercise on or before six months
from date of the option agreement In the event the option is
exercised, closing of the sale shall be within 60 days of the date
notice of exercise is given to Optionor, or as soon thereafter as
practicable. Optionee shall bear all costs of closing, including
the acquisition of a title report and the set-up of an escrow.
6. SALE: The terms of the sale shall be as follows:
a. Optionor shall deed by good and sufficient
deed its interest in the real property to
optionee.
b. Optionee shall pay to optionor the sum of

costs for maintenance and improvements
incurred between option date and exercise of
option. Total purchase price will be due on
closing.
c. Optionee shall assume all underlying
encumbrances and shall save and hold harmless
Optionor therefrom. Optionee shall bear the
cost of all assumption fees and any other
expenses related to sale.
7. NO FUTURE ENCUMBRANCES: After the date hereof, Optionor
shall not in any manner further encumber the sale property without
the written consent of Optionee.
2 - OPTION
S. EXTENSIONS: The term of this option may be extended for
two successive six month periods. To obtain such an extension,
optionee must deliver a notice of such to optionor, personally or
by certified mail, prior to the expiration of the original option
term or extension thereof. In addition and at the same time,
Optionee shall pay to Optionor the sum of $350. Upon such
extension, all of Optionee's rights and obligations pursuant to the
terms hereof shall be extended for a period of six months from the
date of exercise of the extension.
9. BINDING EFFECT: This option shall be binding upon the
heirs, successors and assigns of the parties hereto.
10. ATTORNEYS FEES: In case suit or action is instituted
to enforce any of the terms of this agreement, the losing party
agrees to pay the prevailing party such sums as the court may
deem reasonable as attorney fees, including in the event of
appeal, together with costs and disbursements as provided for by
statute.
11. ENTIRE AGREEMENT: This document is the entire file and
the complete understanding of the parties with respect to the
transaction contemplated herein. It supersedes and replaces all
prior and contemporaneous agreements, understandings,
representations and statements, both written and oral, whether
between the parties or their representatives.

12. COUNSEL: This option has been prepared on behalf of
Optionor. Optionee has been advised to seek independent legal
counsel.

Dear Mr. Griffith,
This letter is to inform you that the final drainage study,
erosion control plan and the West 46th Avenue and Simms Court
street improvement construction drawings for the above referenced
project have been reviewed and approved only for construction
directly related to the proposed Lot 1 and Lot 6 adjacent to the
West 46th Avenue frontage. City approval for the remaining Lots 2
thru 5 will be granted upon approval of the proposed amended
plat, the proposed storm sewer easement to West 44th Avenue and
the street width designation for Simms Court. A Temporary
Certificate of Occupancy, or a Certificate oi Occupancy can not
be approved by the Public Works Department for any units
constructed in Lot 1 or Lot 6 until these requirements have been
met. Finally, please be aware of the following items regarding
the construction of the project:
l,_The proposed drainage facilities_shall be constructed and
approved by the City of Wheat Ridge prior to issuance of the
Temporary Certificate of Occupancy.
2. Erosion control for the project shall be placed in conformance
with the approved drainage/erosion control plan and shall be
maintained as needed during the course of construction.
3. All drainage improvements shall be constructed in conformance
with the approved drainage report and plan.
4. It will be the responsibility of the contractor for the
project to repair any damage to the existing public
improvements on West 46th Avenue as a result of related
construction traffic in the area. Also, the contractor will
be responsible for maintaining West 46th Avenue on a regular
basis such that it is free of construction debris and tracking
from construction traffic accessing the site.
