To Whom It May Concern, It has come to our attention that Exemption Permits allowing the operation of solid-fuel devices on high pollution days have been issued in the pas[ in violation of Article N, Section 9-41 of the City of Wheat Ridge Code of Laws. Exemption permits that have been issued for sole source of heat for garages and workshops do not meet the intent of the ordinance due to "sole source of heaY" being intended for residential heat. There are two methods in which an exemption permit may be issued: An exemption to operate solid-fuel devices on high pollution days issued under the following circumstances and upon submission of an application demonstrating eligibility: (1)a. Sole source ofheat. Any person who relies on a solid-fuel-burning device installed prior to the effective date of this article as their sole source of heat shall be eligible for an exemption hereunder. Any person applying for such an exemption must sign a sworn statement that they rely on a solid-fuel-buming device installed prior to the effective date of this article as their sole source of residential heat. (1)b. Approved or exempt solid fuel-bterning devices. Any person who operates an approved or exempt solid-fuel-burning device shall be eligible for an exemption from the prohibition or operation contained in subparagraph (1)a. of this definition. Persons entitled to an exemption under this article shall be issued an exemption permit which must be displayed on the premises to which the exemption applies and be visible from a place of public access on high pollution days.
