The vacation of the 300' portion of the easement may be approvable by the City, but not per the Legal Description and Exhibit included. Due to the fact that the Engineer-of-Record, Mr. S. Sylvester Mikosz, P.E., has clearly stated that the wall construction will be in compliance with the original approved Final Drainage Report ONLY if the conditions he specifies are met. One of the conditions he states is that a Swale be constructed along the face of the walls (between the walls and the fence line), with a positive grade towards the I-70 Frontage Road. Because the Engineer added the swale construction as a condition of his Certification, the (drainage) easement must remain in force for the 3' strip between the wall face and the fence line. Therefore, I recommend the vacation of only the westerly seven (7) feet of the current 10' easement. Even if the utility companies have all agreed to allow for the vacation of the easement, it may be easier to simply vacate the westerly 7' of the easement rather than attempting to vacate the entire utili portion of the easement, and only the westerly 7' of the drainage portion. This makes not only the creation of the vacation document a bit more difficult to write, but ultimately much harder for one to understand in the future. At such time as all of the utility companies have agreed to vacate the westerly 7' of the current easement, and a revised Legal Description/ Exhibit are created, in my opinion the vacation will be approvable by the City of Wheat Ridge. We are requesting the vacation of the utility easement adjacent to buildings 1 and 2 of Garrison Village to allow the construction of two retaining walls. As you can see on the attached drawings there are no utilities within the easement. The retaining walls were built as shown on the drawings to minimize the slope on the eastern side of the buildings. Our construction staff unknowingly built the walls within the easement, thus our request to vacate the easement. As you can see on the plans the utilities are all located closer to the buildings and there are no utilities located within this easement. I have attached letters from all of the utility companies approving the vacation, a map of the area showing the actual location of the utilities, the legal description of the area to be vacated, and certification and a letter with recommendation from the engineer of record on the project. Also attached is the City application and the $300.00 application fee. Please let me know if you need any additional information. Costilla Ave. #200 Greenwood Village, CO 80112 RE: Garrison Village - Retaining Walls at buildings 1 and 2, Job # 01-006 Dear David: This letter is to provide recommendations for completing construction for two retaining walls located east of buildings I and 2, respectively. The below listed recommendations are with respect to satisfying storm drainage as approved in the drainage report for this project. The reason for adding the new walls was caused by a change to the footprints for the above-mentioned buildings. The, footprint extended approximately 5 feet further to the east than originally designed. Consequently, this change would have steepened the grade between the buildings and the property line to more than 3:1. To alleviate this problem the subject retaining walls were added. The walls are located about 3 feet from property line, and their height varies between 2 and 4 feet. The following recommendations must be met for these walls to be in compliance with the approved drainage report for the site: I. The downspouts outlets from buildings 1 and 2 shall be directing their roof discharge towards the drives, not towards the easterly direction. 2. A Swale with a positive grade towards. the I-70 Frontage Road shall be constructed between property line and the face of walls (see Exhibit 1), tying into the existing contours on the adjacent property to the east- It is recommended that the existing conditions be field verified prior to construction to assure positive drainage is possible.
