Please be advised that at its meeting of March 25, 2004, the Board of Adjustment APPROVED
your request for a 10-foot setback variance from the required 10-foot setback for a freestanding sign,
resulting in a 0-foot setback for property zoned Commercial-One and Industrial and located at 4901
Marshall Street for the following reasons:
1. The location of the structure on the property, the road configuration which is on the
outside of a significant curve in two-lane Highway 72, and grade change between the
street and the building pad site contribute to unique circumstances and hardship on the
property.
2. There is hardship due to the excessive right-of-way for Marshall Street also known as
State Highway 72.
3. Signage of code-complying setback causes patrons driving past, particularly at night, to
be forced to turn around on Marshall, a basically unlit street, thus creating a traffic
hazard.
4. Due to the unusually deep right-of-way of 35 feet from the pavement of Highway 72,
with the variance, the visual setback perceived will be 35 feet from the roadway.
5. Approval of this request will not affect negatively the public welfare or be injurious to
other property or improvements in the neighborhood. It will not impair the supply of
light and air, substantially increase congestion in the public streets or increase fire
danger.
With the following conditions:
The existing freestanding sign and banner on the property must be removed at the time
of completion of construction of the new sign.

2. If Marshall Street, also known as State Highway 72, is ever widened, the sign must be
moved back to a commensurate setback and this condition placed in the Jefferson
County Clerk and Recorder records.
Enclosed is a copy of the Certificate of Resolution, as well as a draft copy of the minutes,
stating the Board's decision which became effective the date of the meeting, March 25, 2004.
This variance shall automatically expire within one hundred eighty (180) days of the date it
was granted, September 21, 2004, unless a building permit has been obtained.

1. CALL THE MEETING TO ORDER
The meeting was called to order by Chair BLAIR at 7:30 p.m. in the Council
Chambers of the Municipal Building, 7500 West 29 ° Avenue, Wheat Ridge,

The following is the official set of Board of Adjustment minutes for the public
hearing of March 25, 2004. A set of these minutes is retained both in the office of
the City Clerk and in the Community Development Department of the City of
Wheat Ridge.

4. PUBLIC HEARING
A. Case No. WA-04-01: An application filed by Cheryl Wise for Copper
Fields Events Chateau for approval of a 10-foot setback variance from the
required 10-foot setback for a freestanding sign, resulting in a 0-foot
setback for property zoned Commercial-One and Industrial and located at
4901 Marshall Street.
The case was presented by Meredith Reckert. She advised the Board there was
jurisdiction to hear the case. She entered all pertinent documents into the records
and reviewed the staff report and digital presentation. Staff recommended
approval of the application for reasons outlined in the staff report.

Board Member BELL asked if there were any known plans to widen Marshall
Street in the future. Ms. Reckert replied that staff is not aware of any such plans.
Board Member ABBOTT asked for clarification as to whether staff was
suggesting the existing sign and banner be removed at the time of building permit
or completion of the new sign. Ms. Reckert replied that staff would prefer
removal at the time of completion of the new sign.
In response to a question from Board Member HOVLAND, Ms. Reckert stated
that there is an excessive amount of right-of-way for Marshall in this area.
In reply to a question from Board Member ECHELMEYER, Ms. Reckert
explained that the existing Gart Brothers billboard on the property does not count
toward the applicant's sign allotment.
Board Member BELL asked about the visual impact of a lighted sign in the
proposed location. Ms. Reckert deferred that question to the sign representative.

Mr. Hamilton, the sign consultant, was sworn in by Chair BLAIR.
Ms. Wise explained that her need for a variance results from the fact that
customers have difficulty in finding the entrance to the events center because of
the placement of the existing sign and the darkness of the street. Many times,
customers will drive past the entrance and then make a u-turn on the curve of
Marshall to go back to the entrance which causes serious traffic hazards. She also
stated that she has had contact with the Colorado Department of Transportation
who assured her that there are no plans to widen Marshall and, if that were ever to
happen, she stated she would bear the burden of relocating the sign.
Mr. Hamilton stated that most properties come to the edge of the road. In this
case, the property line is 35 feet from the road due to the excessive right-of-way,
making the existing sign extremely difficult to see. He entered into the record a
photograph depicting the location of the proposed sign if a variance is granted and
the new sign could be placed closer to the road. Copies were given to each Board
member. He stated his belief that the reason for the excessive amount of right-of-
way was that Marshall Street was at one time the main connection between
Arvada and Denver. This is no longer the case.

In response to a question from Board Member HOWARD, Mr. Hamilton stated
that the proposed sign would have fluorescent lighting.
Board Member ABBOTT asked if any line-of-sight studies had been done. Ms.
Wise replied that no studies have been done, however, drivers don't see the
present sign because they are keeping their eyes on the curve of Marshall.
Board Member MOLNAR asked the applicant if she had contacted the utility
company about placing a street light to provide more illumination. Ms. Wise
replied that she had done so, and the existing street light was installed.
Board Member BELL stated she had no problem with the proposed location of the
sign due to the configuration of the land; however, she would like assurance that
the sign would be moved back in the event that Marshall is ever widened. Ms.
Wise agreed that she would move the sign if Marshall were ever widened.
In response to a question from Board Member DRDA, Ms. Reckert replied that
there are no sight triangle issues with the proposed location of the sign.

There were no individuals present to address this case.
Upon a motion by Board Member ABBOTT and second by Board Member
ECHELMEYER, the following resolution was stated:
Whereas, the applicant was denied permission by an administrative officer;

I. REQUEST
The property in question is located at 4901 Marshall Street, and is currently utilized as an event center.
The property is zoned Commercial-One and Industrial (Exhibit 1, Zoning Map).
The applicant (owner), Cheryl Wise (Exhibit 2, Application, Exhibit 3, Letter of Request), is requesting
a 10'sign setback variance to allow a sign to be erected on the property line (0' setback). This would be
the only freestanding sign on the property besides an existing billboard. An existing sign and a banner
on the Marshall Street frontage would be removed.
Pursuant to Section 26-709.D.3.b. of the Wheat Ridge Code of Laws, signs 7' to 15' in height must be
setback 10' from street right-of-way. The proposed sign will be 14' high.
II. SITE PLAN
The property is roughly 6.8 acres in size and is located on the curve of Marshall Street as it
transitions north from W. 48`h Avenue. The structure on the property was originally built in
1930 and contains 9400 square feet of floor area. The former D.A.V. social club was refurbished
into Copper Fields Event Chateau in 2001. The changes were primarily cosmetic to both the
inside and outside. The event center has an occupancy of up to 500 people.
Access to the property is by way of a curb cut on Marshall. The structure is located on the very
western edge of the property, setback 400' from the Marshall Street right-of-way. There is a 10'
difference in elevation between the building pad site and the street. There appears to be 45' of
excess right-of-way on the west side of Marshall between the edge of asphalt and the right-of-
way/property line (Exhibit 4, Aerial Photo). Due to the location of the building and the grade
change, visibility of the business is limited from Marshall Street.
Many of the events held on the premises occur at night. Marshall Street is not well lighted.
Because the street curves to the east, south of the property and the building is setback so far from
the road, the structure and access point are not visibly evident to patrons of the event center.
Many times patrons drive past the entrance drive and have to continue north on Marshall Street
to turn around and go back. The applicant is hoping that a sign setback variance will provide
increased visibility of the building and driveway. The sign will be placed 40' south of the
existing curb cut, perpendicular to Marshall Street, outside of the sight distance triangle (Exhibit
5, site plan).
The proposed sign measures 14' x 16.66'. The actual sign copy will be in three panels totaling
88 square feet. Permitted freestanding sign size for a 9400 square foot structure would be 109
square feet. The vintage sign is decorative in nature, constructed of wrought iron. It is being
moved from its existing location at the southwest corner of Kipling and Colfax Avenue (Exhibit
6, sign elevation).

III. VARIANCE CRITERIA
Staff has the following comments regarding the criteria used to evaluate a variance request:
Can the property in question yield a reasonable return in use, service or income if
permitted to be used only under the conditions allowed by regulation for the district in
which it is located?
If the requests are denied, the property may still receive a reasonable return in use. The
property is currently utilized as an event center, and this use may continue whether or not
the sign setback variance is granted. The property is allowed on freestanding sign,
regardless of the variance request.
2. If the variance were granted, would it alter the essential character of the locality?
Because of the large amount of excess right-of-way for Marshall Street, the sign would still
be setback 45' from the edge of asphalt. There are various types of commercial uses in the
surrounding area. One of these businesses has an associated freestanding sign. This sign
appears to meet setback requirements. Granting of the variance would not alter the essential
character of the locality.
3. Does the particular physical surrounding, shape or topographical condition of the
specific property involved result in a particular and unique hardship (upon the owner)
as distinguished from a mere inconvenience if the strict letter of the regulations were
carried out?
There are unique circumstances due to the unused, excess right-of-way for Marshall Street.
The property is located on the curve where W. 48"' Avenue transitions into Marshall and is
substantially lower in elevation than the street. The location of the structure is on the very
west portion of the lot.
4. Has the alleged difficulty or hardship been created by any person presently having an
interest in the property?
There are unique attributes to the property, including street configuration, elevation
differences from the street and existing building setback. The hardship is due to the excess
right-of-way for Marshall Street, which dictates placement of the sign.
5. Would the granting of the variance be detrimental to the public welfare or injurious to
other property or improvements in the neighborhood in which the property is located,
by, among other things, impairing the adequate supply of light and air to adjacent
property, substantially increasing the congestion in public streets or increasing the
danger of fire or endangering the public safety, or substantially diminishing or
impairing property values within the neighborhood?

The request would not be detrimental to the public welfare or injurious to other properties
in the area. The adequate supply of light and air would not be compromised as a result of
the request. The request would not increase congestion in the streets, nor increase the
danger of fire. The request would most likely not have an effect on property values in the
neighborhood. The renovation of the property into an event center likely had a positive
effect on property values and character of the area.
6. If criteria 1 through 5 are found, then, would the granting of the variance result in a
benefit or contribution to the neighborhood or the community, as distinguished from
an individual benefit on the part of the applicant, or would granting of the variance
result in a reasonable accommodation of a person with disabilities?
Granting of the request would not result in a contribution or benefit to the neighborhood,
and would merely be a convenience for the property owners and the patrons of the event
center. The request would not result in a reasonable accommodation of a person with
disabilities.
IV. STAFF CONCLUSIONS AND RECOMMENDATIONS
Upon review of the above requests, staff concludes that the above criteria are supportive of
the variance request. Staff has found that there are unique circumstances attributed to this
request that would warrant approval of a variance. Therefore, staff recommends APPROVAL
for the following reasons:
1. The location of the structure on the property, the road configuration and grade
change between the street and the building pad site contribute to unique
circumstances on the property.
2. There is hardship due to the excessive right-of-way for Marshall Street.
3. Approval of this request will not affect negatively affect the public welfare or
be injurious to other property or improvements in the neighborhood. It will
not impair the supply of light and air, substantially increase congestion in the
public streets or increase fire danger.
With the following condition:
1. The existing freestanding sign and banner on the property be removed at the
time of building permit for the new sign.

Precision Sign Company has been contracted by Copper Fields Events Chateau Inc to refurbish
and install a vintage iron sign, now located just South of Colfax on Kipling. Because of the
unusually large setback on Marshall St., we are seeking a variance to allow us to install said sign
with no additional setback.
The Copper Fields Events Chateau is located at 4901 Marshall Street. Sign code requires the sign
be ten feet back from the property line. We are asking for a variance of this code because DOT
possesses the first thirty feet from the road. If the sign is installed ten feet from the DOT line, it
would not be noticed from the road.
The building, itself, sits approximately 400' from Marshall making it nearly impossible to see if
traveling southbound into the curve. By the time most people see the building, they have already
passed the driveway. Many of Copper Field's events are at night, which makes finding Copper
Field's very difficult and frustrating to clientele.
In addition, the grade of the property slopes down toward the building. The slope is more drastic
from about fifteen feet from the street, dropping about forty to fifty feet. The proposed placement
is at street grade. If placed according to current code, only the top portion of the sign would be
seen from street grade.
Because of the above hardships, a variance is necessary in making Copper Field's Event Chateau
noticeable to its patrons.

Dear City of Wheat Ridge,
Precision Sign Company has been contracted by Copper Fields Events Chateau Inc to refurbish and install
an iron sign, now located just South of Colfax on Kipling. Because of the unusually large setback on
Marshall St., we are seeking a variance to allow us to install said sign with no additional setback.
The Copper Fields Events Chateau is located at 4901 Marshall Street. Sign code requires the sign be ten
feet back from the property line. We are asking for a variance of this code because DOT possesses the first
thirty feet from the road. If the sign is installed ten feet from the DOT line, it would be more difficult to
see the sign from the road. In addition, the further you go from the street, the slope of the land drops more
and more. We want the sign to be as close to street height as possible.
