It has been deternvned that there aze a total of 4 bus benches at 2 locations with advertising in the
City that have not received permits for 2005, or had applications submitted for their location. Per
Section 21-145 of the Code of Laws the benches must be removed within 15 days of the date of this
letter. An inspection will be scheduled for Mondav. Julv 11 to ensure that the following benches
have been removed:

2. 52°d and Wazd, NE comer, 2 benches

Your application for renewal of the pernilts for bus benches you currently have in Wheat Ridge has
been received. This letter is to inform you that an inspecdon has been done on the benches in
Wheat Ridge that are on the most recent list that you submitted and the following has been found:
• 38`hAvenue and Kipling, northeast comer - There is graffiti on the south bench that needs
to be removed.
• 38t° Avenue and High, southwest comer - There is graffiti on the one bench at this locauon
that needs to be removed.
• 38`hAvenue and Pierce, northwest corner - There is graffiti on both benches that needs to be
removed.
• 38`" Avenue and Pierce, southeast comer - The west bench has paneling that is peeling off
that needs to be corrected.
• 32°d Avenue and Wadsworth, northwest comer - There is graffiti on the north bench that
needs to be removed.
• 47th Avenue and Aarlan Street, northwest comer - There is graffiti on the one bench at this
location that needs to be removed.
• 32°a Avenue and Independence Street, northeast comer - There is graffiti on the one bench
at this location that needs to be removed.
• 44`hAvenue and Kipling Street, southwest comer - There is graffiti on both benches that
needs to be removed.
• The following location was proposed for a new bench location - 44`h and Kipling, southwest
y comer (2 different locations).
There is currently only one bus stop at this location, therefore only one bus bench
location will be pernritted. As of the date of this letter, this single ]ocation can be
considered approved for up to two bus benches. In order to retain this location, the
bench must be placed within IS days of ihis letter, in conformance with the city's bus
bench regulations.
Per Section 21-124 (e), for every five benches allowed with advertising, one bench without
advertising must be provided in a residential zone district (A-1, A-2; R-1, R-lA, R-1C, R-2 and R-
2A). The total (existing and proposed) number of benches is 44 according to the lists that were
submitted. All of the benches submitted in the list have advertising on them however.
With 44 benches the total number of required non-advertisina benches is 9. Please provide a list
illustrating at least 9 non-advertisine benches in the citv within the above mentioned zone districts.
Please take the necessary steps to come into compliance for approval. Per Code of Laws Section
21-145 you will be given fifreen days to correct these reasons for disapproval or remove the bench
or benches. An inspection will be scheduled for Monday, April 18, 2005 to confirm that these
corrections have been made, and that the requested advertising and non-advertising benches have
been piaced.

Please find the attached lists of your bus bench locations. These lists are what you submitted last
year with your permits. Please be aware that it is yoar responsibility to determine if these lists are
accurate, and you will be required to remove any benches not shown on this list. You also may be
required to make necessary repairs to benches in substandard condition prior to issuance of your
permit.
Please also be aware that per the Code of Laws Sec. 21-124 (e) for every five benches with
advertising, there must be 1 bench without advertising in the appropriate zone district referenced in
my letter to you dated Januazy 31, 2005.
Our records show that you cusently have 42 bus benches with advertising in the City. It is unclear
how many benches you have without advertising and their locations, but it appears that you are
deficient from the required amount. Please be awaze that the required amount and location of non-
advertising benches must be illustrated on the pernut. For exampie, if you are to retain 42 bus
benches with advertising in the City, you must have 8 benches without advertising in the
appropriate zone district. There is no fee assessed for the non-advertising benches.
