As you may or may not recall, Brandon Fistell, Martin's son, visited the Building Division on November 13, 2009, accompanied by Councilman Joey DeMott, to purchase a permit for the re- roofing of his home. Mr. DeMott introduced himself to me at that time and explained to me that he was friends with Brandon and had accompanied Brandon in an effort to "facilitate" the permit process. I asked Brandon Fistell if he was personally doing the work, to which he replied "yes ". The application for permit had no stated value, and Brandon Fistell stated that he was unaware of the value of the work. The calculated value of the work was $4,071.00, which is $1,274.00 less than the contract price of $5,345.00 for the roofing. A homeowner permit was issued. Martin Fistell visited today to inquire about his roof, which failed inspection today for the second time. Martin asked to speak to me, but I was unavailable, so he talked to Melissa Mackey, explaining that Councilman DeMott was the general contractor on the project, and produced a contract signed by Councilman DeMott as proof. He explained that he had been advised by Councilman DeMott to obtain a homeowner permit under his name because it didn't matter to the City either way under who's name the permit was obtained. He inquired of Melissa as to whether Mr. DeMott's firm with which he had contracted, V.I.G. Property Solutions, was licensed, which it is not, nor has it ever been. Mr. Fistell was upset by this and stated that Mr. DeMott was a Councilman and that he should know the rules. Mr. Fistell left his phone number, so I contacted him. He reiterated what he had stated to Melissa and further elaborated on Mr. DeMott's involvement, stating that Mr. DeMott had negotiated the contract with him and then subcontracted the work to a group of Hispanic workers with Texas license plates. He also stated that the same group of workers, under Councilman DeMott's direction, and per the signed contract, had removed and replaced water damaged drywall on the interior of the home, and had also removed roof covering materials, replaced roof sheathing and re- installed the old roof covering, without inspection and in violation of code. He further stated that Councilman DeMott had been promising to schedule an inspection of the work, but that had not happened, so he, Mr. Fistell, took it upon himself to request today's inspection. He stated that the reason he requested the inspection is because Councilman DeMott has been pressuring him for payment in advance of the final inspection approval. Mr. Fistell is upset that the work is not code compliant and that Councilman DeMott is operating in violation of municipal code. He asked me to look into this matter and get back to him. This is a serious violation of many areas of municipal code on the part of Councilman DeMott that warrant immediate attention. We should discuss this at your earliest convenience. Thanks. John C.
