CALL THE MEETING TO ORDER: The meeting was called to order by Chair HOWARD at 7:30 p.m on August 24, 2000 in the Council Chambers of the Municipal Building, 7500 West 29th Avenue, Wheat Ridge, Colorado. 2. A set of these minutes is retained both in the office of the City Clerk and in the Department of Planning and Development of the City of Wheat Ridge. 3. PUBLIC FORUM There was no one signed up to speak. 4. PUBLIC HEARING A. Case No WA-00-06: - An application filed by George E. Collings for approval of a 5-foot variance from the required 15-foot combined side yard setback for an individual lot for the purpose of constructing an attached garage addition for property zoned Residential-Two (R-2) and located at 8920 West 32nd Avenue. This case was presented by Mary Austin. She reviewed the staff report, presented slides and overheads of the subject property and entered all pertinent documents into the record. She advised the Board that there was jurisdiction to hear the case and then reviewed the criteria used to evaluate a variance request. She noted that four letters had been received from neighbors who indicated they had no objection to the variance. Staff gave a recommendation of approval for reasons outlined in the staff report. Kristin Bright 8900 West 32nd Avenue Ms. Bright, the applicant's daughter was sworn in by Chair HOWARD. She appeared before the Board to speak on behalf of Mr. Collings due to the fact he has hearing difficulties. She explained the reason for the request is to have an additional covered space for Mr. Collings' vehicles. In response to a question from Board Member HOVLAND, Ms. Bright stated that there would be seventeen feet between the proposed garage and the adjacent house. Chair HOWARD asked if there would be a need for additional driveway to be installed if the variance were to be approved. Ms. Bright explained that, due to the configuration of the present driveway, there would be no need for an addition. I. REQUEST The property in question is located at 8920 West 32nd Ave and is currently being used for single- family residential. The property is zoned R-2, Residential-Two. (Exhibit 1, Zoning Map). The applicant is requesting approval of a 5' side yard setback variance from the required 15' combined side yard setback for an individual lot in the Residential-Two zoning district. (Exhibit 2, Application and Exhibit 3, Deed). The purpose of the variance request is to allow for the expansion of the attached garage on the west side of the residence. IL SITE PLAN The applicant is proposing construction of an attached garage to be added directly to the west of the existing garage. Pursuant to Section 26-16 (F), of the Wheat Ridge Code of Laws, a structure within the Residential-Two zoning district must maintain a minimum 5' side yard setback on one side, with a total of 15' overall side yard setback. The variance requested by the applicant would permit placement of the garage within 5' of the western property line (side yard). This would reduce the required 15' combined side yard setback to a total of 10'. The applicant has submitted a letter of request outlining the reasons for seeking the variance (Exhibit 4). The applicant has also submitted a site plan showing the layout of the existing single family home on the lot and the location of the proposed garage addition (Exhibit 5). The elevations for the proposed addition show the architectural compatibility with the existing home (Exhibit 6). The property was purchased by the applicant in 1954 and developed with a single family home. The single family structure has a small attached garage for 1 car on the west side of the building. The proposed addition would provide an additional parking space for 1 more car. The existing single family home is currently located 5' from the eastern property line which causes the required side yard setback along the western property line to be 10'. The proposed attached garage addition will encroach into this required minimum 10' side yard setback by 5'. Therefore, the garage addition will be located 5 feet from the neighboring property to the west. Staff has received 4 letters stating no objection to the requested variance (Exhibit 7). III. VARIANCE CRITERIA Staff has the following comments regarding the criteria used to evaluate a variance request: Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? Board of Adjustment Page 2 WA-00-06/Collings If the request is denied the property may still yield a reasonable return in use. The property currently has a one car garage, and has sufficient parking for additional vehicles. It is currently developed with a single family home and can continue to be used as such, regardless of the outcome of the variance request. 2. Is the plight of the owner due to unique circumstances? The unique circumstances attributed to the property arise from the slope of the lot and the irregular shape of the lot. The property backs up to the Crown Hill open space park and has a considerable slope in the rear of the property which renders the rear of the property unusable for a garage structure. Additionally, the house was built parallel to West 32nd Avenue, not the property lines. This unique orientation causes limited space for the addition. 3. If the variation were granted, would it alter the essential character of the locality? The proposed structure would encroach upon 5' of the required overall 15' side yard setback. There should be limited negative effects upon the adjacent property since the structure would still meet the required 5' minimum side yard setback. The proposed structure will be consistent in construction and design with the existing structure, therefore should not alter the essential character of the locality. 4. Would the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? There is a large drop off at the rear of the existing garage into the back of the property. Due to the slope, any vehicle access to the back yard is not an option. Any garage addition to the front of the existing garage would be out of character with the neighborhood, and could potentially encroach into the required front yard setback. There appears to be no other viable alternative for locating an additional garage on the property. 5. Would the conditions upon which the petition for a variation is based be applicable, generally, to the other property within the same zoning classification? Other property owners in the same zoning classification may request a similar variance. Each application is reviewed on a case by case basis and evaluated based on the circumstances pertaining to each request. 6. Is the purpose of the variation based exclusively upon a desire to make money out of the property The purpose of the request is not based on a desire to make money out of the property. The request is based on the desire to provide additional covered parking for the residents. Board of Adjustment Page 3 WA-00-06/Collings 7. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? The hardship was not created by any person having an interest in the property. The difficulty relates to the slope of the property which is a naturally occurring condition. 8. Would the granting of the variations be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located? The welfare of the public would not be impacted by granting of the variation nor should it be injurious to other property or improvements in the area. The maximum building coverage for an R-2 zoning district is 40% of the overall lot area. The existing single family home with the proposed addition will be well within that limitation. 9. Would the proposed variation impair the adequate supply of light and air to adjacent property or substantially increase the congestion in the public streets or increase the danger of fire or endanger the public safety or substantially diminish or impair property values within the neighborhood. The proposed attached garage structure should not impair the adequate light and air to adjacent properties, nor endanger public safety. The new addition will meet the minimum 5' side yard setback. The requested variance does not involve additional housing units therefore will not increase traffic. 10. If it is found in criteria 8 and 9 above that granting of the variation would not be detrimental or injurious to other property or improvements in the neighborhood, and it is also found that public health and safety, public facilities and surrounding property values would not be diminished or impaired, then would the granting of the variance result in a benefit or contribution to the neighborhood or the community as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? The proposed garage would provide an individual benefit to the home owner. It would probably not result in a benefit to the neighborhood or the community. It would not result in the reasonable accommodation of a person with disabilities. VI. STAFF CONCLUSIONS AND RECOMMENDATION Upon review of the above request, staff concludes that the above criteria are supportive of the variance request. Staff has found that there are unique circumstances related to the physical topographical condition of the property that would warrant approval of a variance. Collings and Shirley E. Collings, original and current owners, of 8920 W. 32nd Ave, Wheat Ridge, CO (Loth, Distant View, County of Jefferson, State of Colorado) are asking the Board to consider a variance request to the easement setback rulings pertaining to the zoning standards. This request pertains to a proposed garage addition to the west side of the house. The existing garage is a small one car garage. We are a two car family and would like to add to the existing garage to house the second car. Considering the current cost of automobiles, protection of the elements and safety of storage is paramount in protecting our substantial investment. ( ie vandalism and thievery). It has become increasing more difficult to clean the snow off the car that is not garaged as we advance in years, because of health and physical constraints. Adding space for a second car in our garage would help us tremendously in the winter months. This transition from a one car to a two car garage would update our home to modern standards. ~ We live on the S-curve of 32nd Ave, which is a very busy street, with an increased traffic volume. Due to the volume of the traffic and that we are on the curve, we feel it is unsafe and unwise to park along W. 32nd Ave. It not only impairs our vision as we exit our driveway, but our neighbor's as well. The proposed garage addition would easily fit within currant zoning standards if the house would have been originally built parallel to the property lines. The house sits skewed on the lot, thus the proposed addition violates the 5715' set back ruling on the east side. however approximately 30% of the east side satisfies the ruling. There is 27' between our house and the house to the east. Please note that included in this packet are letters from the neighbors and owners of the properties to the east and west side of our house, saying they have no objection to this addition. The site for this addition keeps the lines of the proposed addition in proportion to the lines of the house. Because of elevation constraints we cannot build the garage in the back yard. From the front of the house that faces 32nd Ave. to the back yard there is a 8 foot drop in elevation. This drop is not a gradual drop, but a sharp drop supported by retaining walls and terraces. This elevation drop does not allow us to build a double deep garage either as there is not enough footage for that size of an addition between the exisiting garage and where the drop begins. We have no easement to the back yard, as it would go through our neighbor's yard to the east thus prohibiting us from building a garage in the backyard from that point as well. According to the surveyor's improvement location certificate there is not an encroachment of the 5' minimum easement to the east property line.
