The property is within the City of Wheat Ridge, and all notification and posting requirements have been met,
therefore, there is jurisdiction to hear this case.
1. REQUEST
The property in question is located at 2990 Marshall Court and is currently zoned for single family
residential, however an abandoned garage occupies the property.The property is zoned R-2, Residential-
Two. (Exhibit 1, Zoning Map).
The applicant is requesting approval of a 20' front yard setback variance from the 30' front yard setback
requirement in the Residential-Two zoning district. (Exhibit 2, Application and Exhibit 3, Deed). The
purpose of the variance request is to allow for the construction of a house with an attached garage on the
south side of the property.
II. SITE PLAN
The applicant is proposing construction of a house and attached garage. The proposed attached garage will
be almost fully contained within the required thirty foot front yard setback. Pursuant to Section 26-14 (F) of
the Wheat Ridge Code of Laws, any structure within the Residential-Two zoning district must maintain a
minimum 30' front yard setback. The variance requested by the applicant would allow a house and garage to
encroach into twenty feet of the thirty foot front yard setback.
The applicant has submitted a site plan showing the proposed location for the house and attached garage as
well as a site data table (Exhibit 4, Site Plan, Exhibit 5, Data Table). The applicant has also included an
Improvement Location Certificate (Exhibit 6, Improvement Location Certificate).
The property currently accommodates an abandoned garage. There is a working easement which runs from
the southwest corner to the northeast corner of the property maintained by Denver Municipal Water Works.
The easement measures sixty feet wide, and runs the entire width of the property. The easement occupies
approximately 4,920 square feet.
Staff has received no objection to or public comment regarding this variance request thus far.
III. VARIANCE CRITERIA
Staff has the following comments regarding the criteria used to evaluate a variance request:
1. Can the property in question yield a reasonable return in use, service or income if
permitted to be used only under the conditions allowed by regulation for the district in
which it is located?

If the request is denied the property may still yield a reasonable return in use. Currently, there is
room to develop the property, albeit with a smaller structure. The property is currently zoned as
single-family and can continue to be used as such, regardless of the outcome of the variance
request.
2. Is the plight of the owner due to unique circumstances?
The unique circumstances attributed to the property stem from the easement which runs the entire
width of the property from the southwest corner to the northeast corner. The easement is sixty feet
wide, and occupies approximately 4,920 square feet.
3. If the variation were granted, would it alter the essential character of the locality?
The proposed structure would encroach upon twenty feet of the required thirty foot front yard
setback. There have neither any setback variances requested nor granted for this entire
neighborhood. All other height, setback, and lot coverage requirements for the Residential-Two
zoning district will be met.
4. Would the particular physical surrounding, shape or topographical condition of the
specific property involved result in a particular hardship (upon the owner) as distinguished
from a mere inconvenience if the strict letter of the regulations were carried out?
There is nothing unique about the shape of the lot or the topography of the site which would cause
a hardship. The lot is relatively flat, and is rectangular in shape. At approximately 12,788 square
feet, the lot exceeds the minimum requirement for a single-family home in the R-2 district. At
approximately 131 feet, the lot exceeds the minimum width for a lot in the R-2 district.
5. Would the conditions upon which the petition for a variation is based be applicable,
generally, to the other property within the same zoning classification?
Other property owners in the same zoning classification may request a similar variance. Each
application is reviewed on a case by case basis and evaluated based on the circumstances
pertaining to each request.
6. Is the purpose of the variation based exclusively upon a desire to make money out of the
property
The purpose of the request is based on a desire to build a house and garage as large as possible
while not encroaching upon the water easement. There is approximately 1,815 square feet of
available building space on the south side of the easement. However, the way the garage is to be
attached to the house, it would violate the front yard setback.
Has the alleged difficulty or hardship been created by any person presently having an

interest in the property?
The hardship was not created by any person presently having an interest in the property. The
easement was in place well before the current owners purchased the property in September of
2000.
8. Would the granting of the variations be detrimental to the public welfare or injurious to
other property or improvements in the neighborhood in which the property is located?
The welfare of the public would not be impacted by granting of the variation nor would it be
injurious to other property or improvements in the area. All other setbacks, height, and building
coverage requirements will be met.
9. Would the proposed variation impair the adequate supply of light and air to adjacent
property or substantially increase the congestion in the public streets or increase the
danger of fire or endanger the public safety or substantially diminish or impair property
values within the neighborhood.
The proposed structure will not impair the adequate light and air to adjacent properties, nor
endanger public safety. The structure will be located in the front yard of the property, situated near
a cul-de-sac bulb. The requested variance does not involve additional housing units therefore will
not increase traffic.
10. If it is found in criteria 8 and 9 above that granting of the variation would not be
detrimental or injurious to other property or improvements in the neighborhood, and it is
also found that public health and safety, public facilities and surrounding property values
would not be diminished or impaired, then would the granting of the variance result in a
benefit or contribution to the neighborhood or the community as distinguished from an
individual benefit on the part of the applicant, or would granting of the variance result in
reasonable accommodation of a person with disabilities?
This variance would not have a beneficial effect on the neighborhood. It would solely benefit the
owner. It would not result in the reasonable accommodation of a person with disabilities.
VL STAFF CONCLUSIONS AND RECOMMENDATION
Upon review of the above request, staff concludes that the above criteria are supportive of the
variance request. Staff has found that there are unique circumstances attributed to this request that
would warrant approval of a variance. Therefore, staff recommends APPROVAL for the
following reasons:

3. Approval of the variance would not be injurious to other properties in the neighborhood.

DenverMetro Waste Water. Addrt/ona/ly, beinga corner/ot, Lot 1 is subject to the thirty-footfront
setbackrequirementontwoof/ts'fours/des 7hesetbackrestrictionscoupled with theright-of-way
strictiytimits the placement of anysizable structure to the south end of the property.
The targetsa/esmarketforthe proposedhome wou/d bean established, "move-W fami/y.
Mostprobablya second time buyer, this familywou/dbe lookingforroom to house an expanding
familyinterms ofboth lotsizeforfamilyactivityand/ivingareaforaccommodation. Theproposed
home has been designed accordingly while keepingthe lot coverage of the total structure to a mere
15%- wellunder the maximum 40%coverage a/lowed. We feelmarketab//ityofthe final product
wouldbeseverelyandadverselyaffectedbyafu ffierreduction/n home size.
Asa result of the above considerations, weare proposinga structure that would blend with
