SUBJECT: Fence Permit, 4275 Garrison Street
The application for a fence permit for the referenced property will require an application
for a Claos I Special Exception to the Flood Plain. The entire property io within the 100
year flood plain Zone A and falls under the requirements of our Flood Plain Ordinance.
Specifically, Section 26-206.C.1 and therefore also Section 26-206.F.16. Both are
attached for reference. The fence must be constructed in a break-away design or the
bottom to be placed one foot above the base flood elevation. This latter requirement
would place the bottom of the fence approximately two feet above the ground which, of
course, is not practical. An alternative design io to stagger the fence pickets from one
side of the fence rail to the other leaving a one to two inch gap between the pickets on
each side. This allows for privacy, yet also allows the free flow of water through and
around the pickets. I will review the application for the special exception with the
required attachments; either a break-away design, or the staggering of pickets, or other
method of allowing flood flows to pass through.

Sec. 26-206. Flood Storage District.

(A) Application and Description: These regula.
tions shall apply to all properties designated as
within the Flood Storage District.
(B) Permitted Uses: The permitted uses in the
.load storage district are the same as those uses
permitted in section 26-205(B). However, in the
Flood Storage District, special exemption permits
may be applied for as specified in paragraph (C)
arid (D).
(C) Special Exceptions-Class I: Any use enu-
merated in this paragraph may be permitted only
upon the issuance of a Class I special exception
permit by the floodplain administrator as pro-
vided in section 26.208(C) and in compliance with
paragraph (F) of this section.

section 26-208 and in compliance with paragraph
(F) of this section.

Sec. 26-207. Nonconforming uses.
The existing lawful use of a structure or pre-
muses which is not in conform ry with the provi-
sions of these regulations may be continued sub-
ject to the following conditions:
(1) No such use shall he e-rnanded,or enlarged
except in conformity with the provisions of
these regulations. -
(2) No substantial improvement to any noncon-

(5) Any alteration, addition or repair to any
nonconforming structure permitted pur-
suant to subsection (2) above shall be pro-
tected by floodproofing measures pursuant
to section 26.208(C)(4)(a).

Sec. 26-208. Administration.
(A) Floodplain Administrator: The city engi-
neer of the City of Wheat Ridge or his designee
shall be the floodplain administrator. The duties
of the administrator shall include, but not be lim-
ited to:
(1) _ Coordination between departments and di-
visions:
(a) Coordinate the application, permit, re-
view, appeal, certification and enforce-
ment processes between the office of the
city engineer and the department of

ment as appropriate to ensure compli-
ance with these regulations and an ef-

(b) All applications and certifications shall
be submitted to the department of'plan-
ning and development from which fur.
