The following is the official set of Board of Adjustment minutes for the Public Hearing of
January 23, 2003. A set of these minutes is retained both in the office of the City Clerk and in
the Community Development Department of the City of Wheat Ridge.

There was no one signed up to speak.
4. PUBLIC HEARING
A. Case No. TUP-02-05: An application filed by Trugreen Landcare for approval of
a one-year Temporary Structure Permit to allow an office trailer on property
VVV zoned Commercial-Two (C-2) and located at 8935 West 440' Avenue.
This case was presented by Mike Pesicka. This case was continued from October 24,
2002 and December 4, 2002, because the applicant had failed to comply with posting
requirements.

Mr. Pesicka advised the Board that all posting and noticing requirements had been met
and there was jurisdiction to hear the case. He entered all pertinent documents into the
record and reviewed the staff report. Staff found that there were unique circumstances
attributed to the request and therefore recommended approval of the request for reasons
outlined in the staff report.
In answer to a question from Board Member ECHELMEYER, Mr. Pesicka stated that the
TUP could only be granted for one year and the applicant could not re-apply. at the end of
that year.

Ms. Leach, representing the applicant, was sworn in by Vice Chair HOVLAND. She
explained that the applicant has need of the trailer until such time as offices could be
moved from the trailer into the building presently occupied by Pipes, Inc. The move is
planned to take place this year.
In response to a question from Board Member MONTOYA, Ms. Leach indicated the
applicant was agreeable to the termination date for the TUP of October 24, 2003.
Vice Chair HOVLAND asked if there were any individuals present who wished to
address this matter. There was no response.
Board Member MONTOYA stated that he would vote in favor of the TUP because
present zoning of the property already allows a trailer to be stored on the property but not
to be used as an office building.
Upon a motion by Board Member MONTOYA and second by Board Member
BLAIR, the following resolution was stated:

Type of Temporary Use Permit: One-year Temporary Structure Permit to allow an
office trailer on property zoned Commercial-Two (C-2) for property located at 8935
West 44th Avenue.
For the following reasons:
1. Based on staff s recommendation, approval of the temporary structure
would not alter the essential character of the neighborhood.
2. Approval of the request would not impair the adequate supply of light and
air to adjacent properties.
3. Approval of the temporary structure would not result in undue traffic
congestion or traffic hazards.
With the following condition:
1. The temporary trailer be removed by October 24, 2003.
The motion passed 6-0 with Board Members DRDA and YOUNG absent.
B. Case No. WA-02-18: An application filed by Amy Coffey for approval of (A) a
5-foot side yard setback variance from the 10-foot side yard setback requirement
for a two-story structure resulting in a 5-foot side yard setback and approval of
(B) a 7-1/2 foot rear yard setback variance from the 10-foot rear yard setback
requirement resulting in a 2-1/2 foot rear yard setback for property zoned
Residential-One C (R-1C) and located at 5575 West 35th Avenue.
The case was presented by Mike Pesicka. He reviewed the staff report, entered all
pertinent documents into the record and advised the Board there was jurisdiction to hear
the case. Staff recommended denial of the application for reasons outlined in the staff
report. Mr. Pesicka noted that a foundation has been poured for the addition planned by
the applicant because she will build whether or not she receives the variance. Without
the variance, the addition could be built to just under 20 feet in height. With the variance,
the addition is proposed to exceed 20 feet in height.
Board Member MONTOYA expressed concern about the impact of light and air to
adjacent properties and structures that could be built in the future. Mr. Pesicka stated that
the structure would be larger than any other structure in the neighborhood but would not
block any view that hasn't already been blocked before. The nearest residence is fifty
feet from the subject residence.

Dear Jeff and Robin:
This letter is in regard to the upcoming Board of Adjustment meeting on December 4, 2002. Since you did
not pick up and post your signs by the required November 20, 2002 deadline you will not be on the agenda
for the upcoming meeting. I spoke with Robin over the phone and discussed how the case will handled for
the continuance.
Your case will be rescheduled to the Board of Adjustment meeting on January 23, 2003. You will be
required to submit payment of $90.00 dollars for republication to the Planning and Development Department
no later than January 2, 2003 by 12:00pm. Public hearing signs will be available for you to pick-up on
January 6, 2003, and shall be posted by 5pm on January 9, 2003. If you fail to comply with this schedule
your case will be withdrawn and a summons will be issued to remove the temporary office trailer.
The following paragraph is from Chapter 26 of the Wheat Ridge Code of Laws regarding posting
requirements. Section 26-1.09A.C. Posted Notice. "At least fifteen (15) days prior to any public hearing
for a specific site development which requires approval by the planning commission, board of adjustment or
city council, the director of planning and development shall cause to be prepared, and the applicant post, a
sign (one (1) per street frontage) upon the parcel under consideration for approval which provides notice of
the kind of action requested; the hearing authority; the time, date and location of hearing; and the location of
the parcel under consideration by both addresses and legal description. The sign shall be posted within the
property boundaries, shall be affixed to a flat surface, shall be elevated a minimum of thirty (30) inches from
the ground (however, not more than six (6) feet above ground), shall be visible from the street without any
obstructions, shall be legible and displayed for fifteen (15) days prior the public hearing. The fact that a
parcel was not continuously posted the full fifteen (15) days may not, at the discretion of the hearing authority,
constitute grounds for continuance where the applicant can show that a good faith effort to meet this posting
requirement was made."

1. REQUEST
The property in question is located at 8935 W. 44a' Avenue, and is currently a lawn care company. The
property is zoned Commercial-Two (Ea, iliit 11 Zonh gMaP).
The applicant (owner), Truegreen Lawncare (Eichiliit2,Poweref Attorney), is requesting approval of a
one-year temporary structure permit to allow for an office trailer (Exhibit 3, Applic;fion).
II. SITE PLAN
Applicant has submitted a site plan showing the proposed location for the temporary office
building (Exhibit 4; Site Plan'/Survey). The property has operated as a lawn care company and
may continue this use pursuant to Section 26-204 Zone District Use Schedule. The applicant has
requested for the temporary office trailer to remain for 2 years (Exhibit 5, ApplicaptLetter).
Pursuant to Section 26-115D.3.a and 26-115D.3.b., the board of adjustment may approve a
temporary structure permit for no longer than one year per application, and only one permit per
year may be approved for a specific site. The current applicant recently placed the trailer on the
site without approval from the city. A building inspector noticed the trailer on the site and the
city in-turn notified the applicant of the required process.
III. VARIANCE CRITERIA
Staff has the following comments regarding the criteria use to evaluate a Temporary Use request. The
proposed temporary use:
Will not have a detrimental effect upon the general health, welfare, safety and
convenience of persons residing or working in the neighborhood of the proposed
use; and
The potential temporary office trailer will not be detrimental to the public welfare or
injurious to other properties. The adequate supply of light and air will not be decreased;
the temporary trailer will not increase congestion in public streets or the parking lot.
There will still be adequate parking for customers, and none of the drive aisles will be
restricted. The trailer would not increase the danger of fire.
2. Will not adversely affect the adequate supply of light and air, nor cause significant
air, water or noise pollution, or cause drainage problems for the general area; and
The adequate supply of light and air will not be compromised. The temporary trailer
should. not produce any pollution of air, water or noise in the area. There should be no
drainage problems associated with this request. The site is adjacent to Clear Creek, but
the proposed location for the temporary structure is not located within the floodplain.
3. Will not result in undue traffic congestion or traffic hazards, or unsafe parking,
loading, service or internal traffic conflicts to the detriment of persons whether on
or off site; and
The proposed temporary trailer will not increase traffic congestion or traffic hazards.
There would still be adequate parking for customers and drive aisles will not be blocked
as a result.
4. Will be appropriately designed, including setbacks, heights, parking, bulk,
buffering, screening and landscaping, so as to be in harmony and compatible with
the character of the surrounding areas and neighborhood, especially with adjacent
properties; and
The character of the property would not be altered. The proposed addition of a small (12'
by 40') temporary office trailer will have minimal impact to surrounding neighborhoods
and properties. It is Department policy that due to a lack of a permanent foundation,
these types of temporary trailers need not meet setback standards of the zone district in
which they are located. However, the trailer as placed would not violate the development
standards of the C-2 zone district. In addition, there are no screening or landscaping
requirements for temporary office trailers.
5. Will not overburden the capacities of the existing streets, utilities, parks, schools,
and other public facilities and services.
The potential temporary structure would not be detrimental to existing streets, nor
overburden any utilities, parks, schools or other public facilities.
IV. STAFF CONCLUSIONS AND RECOMMENDATIONS
Upon review of the above request, staff concludes that the above criteria are supportive of the
temporary structure request. Staff has found that there are unique circumstances attributed to
this request that would warrant approval of a temporary structure. Therefore, staff recommends
APPROVAL for the following reasons:
Approval of the temporary structure would not alter the essential character of
the neighborhood.
2. Approval of the request would not impair the adequate supply of light and air
to adjacent properties.
3. Approval of the temporary structure would not result in undue traffic
congestion or traffic hazards.
With the following condition:
1. The temporary trailer is removed by October 24, 2003.

on Pumps Inc. in the building to the west, at which time we hope to take over their lease.
