Youngblood (owners) are proposing a minor subdivision on property located at 4470 Wadsworth Blvd., Wheat Ridge, CO. The date and time of the meeting is Wednesday, May 28, 2003 at 6:30 P.M. The location of this meeting is Wheat Ridge City Hall, 7500 W. 29M Ave., Wheat Ridge, CO. The purpose for this proposal is to divide existing lot into two pieces. The northern most piece which borders 45'b Ave. will be a residential styled office building, the southern piece will be a future retail space. The City of Wheat Ridge has adopted a requirement that prior to any application for Rezoning of property, a Minor or Major Subdivision, and for Special Use Permits an applicant must notify all residents and property owners within 600 feet and invite them to a Neighborhood Input Meeting. The purpose of this meeting is to allow the applicant to present his proposal to the neighborhood and to give the neighborhood a forum to express their concerns, issues and desires. A Staff Planner will attend the meeting to discuss City policies and regulations and the process involved, however, the Planner will remain impartial regarding viability of the project. Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be entered as testimony, it is the public hearings in front of the Planning Commission and City Council where decisions are rendered If you want input in the decision-making process it is imperative that you attend the public hearings. The kinds of concerns residents normally have include the following: * Is the proposal compatible with surrounding land uses and zoning? * Are there adequate utilities and services in place or proposed to serve the project? * What is the impact on our streets? * How will this proposal affect my property? * Where will the storm drainage go? * How will the project be designed to enhance rather than detract from the neighborhood? * What specific changes can be made in the proposal to make it more acceptable to me? Furthermore, primary access to the subject property could potentially come from Wadsworth. The developer is looking at doing an access easement across lot one as part of the purchase negotiations. Lot four will have a W. 450' Avenue address. Commissioner BERRY expressed concern about the curb cut onto W. 45`s allowing traffic to flow into the neighborhood and recommended left turn only. Ms. Austin stated that a recommendation could be made to the traffic engineer. Depending on the use of the site, the traffic engineer would decide whether or not a traffic study is warranted. Todd Youngblood 4470 Wadsworth Boulevard Mr. Youngblood, the applicant, was sworn in by Chair McNAMEE. He stated he had nothing to add to the staff report as presented by Ms. Austin. Jim Templeton 4551 Vance Mr. Templeton was sworn in by Chair McNAMEE. He voiced concern about the possibility of increased traffic on Vance. He would like to see traffic routed onto Wadsworth. Case No. ZOA-03-09: An ordinance amending Chapter 26 of the Wheat Ridge Code of Laws pertaining to heights and setbacks for residential accessory structures and exceptions thereto. Alan White presented this case. Planning Commission recommended on June 5th that staff prepare an ordinance to address several setback issues and changes. The ordinance with those changes was presented to the Commission for their consideration. Chair McNAMEE suggested that the issue of setbacks for RV's be discussed when the RV ordinance is brought back. There was a consensus of the Commission to defer the issue of RV setbacks. Commissioner McMILLIN expressed concern about the proposed 15-foot height limit for garages. This would only allow a maximum of nine feet for the garage door. He stated he checked with two RV dealerships regarding heights of RV's. One dealership said they did not sell anything that would fit with a 10-foot garage door and the other said they sell one conversion van that would fit with a 10-foot garage door. This proposal would prevent owners from parking their RV's in a garage which presents a dilemma for them in light of the city's ordinance requiring any more than one RV to be parked indoors. Commissioner PLUMMER stated he would be in favor of adopting the ordinance as it is. If circumstances warrant, citizens would still have the right to apply for a variance from the ordinance. Commissioner DAVIS commented that she would like to see homeowners have the ability to pursue their own desires without undue duress and expense. Commissioner McMILLIN stated that he believed homeowners should be able to build accessory buildings at least half the height of the primary structure. The proposed height limits would limit accessory structures to less than one third of the primary structure height. The property is currently vacant and has frontage on both Wadsworth Blvd. and W. 45' Avenue. This plat is a re-subdivision of lot 2 from the Ace Hardware Lot Line Adjustment Plat (Exhibit 5). The lots in this subdivision are being platted as lot 3 and lot 4 to differentiate from the lot 2 of the original plat. This numbering sequence utilizes logical subdivision numbering progression and is less ambiguous than labeling the lots as 2A and 2B. Lot 1 is not being re-platted with this plat. On the original Ace Hardware Lot Line Adjustment Plat, Tracts A and B were reserved for the future re-alignment of Wadsworth Blvd. A development covenant between the owner and the City was executed at that time to provide for the future dedication of right-of-way when Wadsworth Blvd. is widened. This plat perpetuates Tract B as being reserved for that future dedication. There is a cross access/ingress-egress easement discussed in plat note #2 and shown graphically on the plat. This is a minor subdivision without public street dedication and as such, requires Planning Commission action only. All requirements of the Subdivision Regulations have been met. AGENCY REFERRALS The City Surveyor has reviewed the final plat document for completeness and has indicated that it is in compliance with the City's Subdivision Regulations. All service agencies can serve the property when developed. Any necessary system improvements, taps and meters will be at the developer's expense. The Public Works Department will require a drainage report for the site, prepared by a Colorado licensed professional engineer, prior to any development. Public improvements of curb, gutter and sidewalk are currently in place along W 45' Ave. Any improvements associated with the widening of Wadsworth Blvd. will be constructed at the time of that project. The property is located within the Wadsworth Boulevard Corridor Redevelopment Area. At their meeting on July 23, 2003, the Wheat Ridge Urban Renewal Authority reviewed the proposed subdivision (Exhibit 6) and found minimal impact to any plans for urban renewal projects. Xcel Energy can serve the property with requested utility easements adjacent to the front and rear lot lines for the installation and maintenance of utilities. These easements are discussed in plat note #7 and are depicted graphically on the plat document. Wheat Ridge Water District will provide water service to the property. Per the district's response, lot 3 will receive service from W 45`s Avenue and lot 4 from Wadsworth Blvd. V. STAFF CONCLUSIONS AND RECOMMENDATION Upon review of the above request, staff concludes that the applicant is subdividing a single parcel with frontage on Wadsworth Blvd and W. 45`s Avenue into two parcels, one fronting Wadsworth Blvd. and one fronting W 45' Avenue. The existing C-1, Commercial-One zoning will not change. The requirements of the Subdivision Regulations have been met. Staff recommends APPROVAL for the following reasons: 1. How will the city accommodate the increase in traffic for residential taxpayers and commercial interests? What exactly does, "future retail space" mean? I am already very concerned that I live precariously close to a propane gas supplier (W. 44th and Vance). Not sure who had the idea that this was acceptable but it seems way too close to any residential area in my opinion. I have no objection to a "residential styled office building." I believe the City of Wheat Ridge is remiss in failing to attract businesses to this area when one considers the tax revenues, etc. that must be lacking from empty lots and buildings in the W. 44th and Wadsworth Blvd. location. The beautification of W. 38th Ave. is wonderful. Gee, even Harlan Street was targeted. I wonder why my area of Wheat Ridge is left fallow? In sum, I welcome the idea of new businesses, in the commercially zoned areas. What types of businesses is the city trying to attract? That is my great concern. These easements are dedicated for the installation, maintenance, and replacement of electric, gas, television cable, and telecommunications facilities. Utilities shall also be permitted within any access easements and private streets in the subdivision. Permanent structures and water meters shall not be permitted within said utility easements. PSCo also requests that these utility easements be depicted graphically on the preliminary and final plats. While these easements should accommodate the majority of utilities to be installed in the subdivision, some additional easements may be required as planning and building progresses. As a safety precaution, PSCo would like to remind the developer to call the Utility Notification Center, at 1-800-922-1987, to have all utilities located prior to construction.
