Pursuant to Ordinance No. 1291, the Community Development Director has the ability to decide upon applications for administrative special use approval, without requirement for a public hearing, provided the following conditions are met: 1. A completed application package has been submitted and fee paid. 2. The Community Development Department has notified adjacent property owners by letter notice and the site has been posted for at least ten (10) days. 3. No written objections have been received in such ten day period. 4. The Community Development Director concludes that the criteria for approval, as set forth below, are substantially complied with and support the request. The Community Development Director can impose conditions or stipulations upon. the approval, which may include physical design, operational, and maintenance considerations to ensure compliance with the criteria for review. The Community Development Director shall also decide the following: 1. Whether the SUP runs with the land in perpetuity; or, 2. Whether the SUP is personal to the applicant and may or may not be inherited; and /or, 3. Whether the SUP is granted only for a defined period, after which time the special use shall expire unless renewed subject to all of the requirements of this section. The applicant has submitted a site plan, which shows the individual units and building layout. Major auto repair will be performed only in the highlighted unit on the site plan. No other physical changes are proposed for the property. FINDINGS OF FACT: The specific unit, in addition to a large majority of the property, has been historically used for major auto repair. 2. Major auto repair, as defined in Section 26-123 of the Wheat Ridge Code of Laws, is a special use in the C-1 zone district. 3. Adjacent property owners were notified by certified mail of the application, and no written objections were received. 4. The applicant, Jack Gindi, has the ability to continuously meet the conditions of the special use permit. 5. The proposed special use will not have a detrimental effect upon the general public health, welfare, and safety. 6. The proposed special use will not result in traffic congestion nor overburden the capacities of the existing streets and utilities. 7. The proposed special use will not adversely affect the light and air to adjacent properties as no physical changes are proposed to the structure or the property. This request for an administrative special use meets all applicable conditions as required by Section 26-114 of the City of Wheat Ridge Code of Laws. Staff has not received written comments in opposition to this request from the adjacent property owners. Therefore, Case No. SUP-03-08 is hereby APPROVED with the following conditions: 1. Major auto repair be limited to unit number 112, as depicted on the provided site plan. 2. The special use shall be a grant of use to the tenant and any future tenant(s) of unit number 112. 3. The use of 9491 W. 44`h Avenue unit number 112 shall remain consistent with the site plan contained in the case file. Complete engines are crated and shipped from companies such as Jasper, ATK and Marshall and are delivered generally within one to two days of the order. When the new engine arrives we remove the original engine from the vehicle, transfer any required parts to the remanufactured engine and install it into the vehicle. The old engine cores are then re-crated and sent back to the manufacturer for a core deposit refund. The Wheat Ridge Autoplaza is a shopping center consisting of 11 shops which specialize in automotive services such as transmission repair, auto detailing and auto body repair. The center offers plentiful parking and excellent exposure from it's comer location. The property is home to a Texaco gas station and convenience store as well as a Big `O' Tire store. Built in 1989, this 31,240 sq. ft. "Auto-Plaza" has been managed and maintained in top condition. What we are requesting is a continued use of the space as it was used in the past. Previous to ATL, the space was used as a heavy auto repair space just as a majority of the property is currently operated.
