The purpose of the meeting was to review the revised and modified Schematic Design with the City of
Wheat Ridge Building and Planning departments.
1. Tim reviewed the changes and reductions of the original scope of work. Included are the elimination
of the second floor, elevators, basement and stairs.
2. Tim highlighted the areas of the floor plan with the occupancy groups. The Classrooms are E
occupancy, the Multi-purpose room is A-3 occupancy and the Administration/Office area is B
occupancy. The public spaces in between (public restrooms, warming kitchen, lobby/waiting) were
recommended by Chad Root to be B occupancy. The following are Building code related items
discussed;
a. The 2 hour separation between each of the 3 occupancies mentioned in item 2 was discussed.
Chad said he would waive this code requirement pending approval from. the Arvada Fire
Protection District. Chad said he would classify this facility as a typical school for occupancy
classifications. LOA was requested to send a progress set to Steve Steigleder of the Arvada
Fire Protection District. The "trade off' may be 20 lb. Fire extinguishers instead of 10 lb and
additional fire detection. LOA to confirm if an anunceator panel will still be required at the
front door.
b. Chad said that in addition to the amendments that LOA had an Energy Code was also adopted.
He provide LOA a copy of this.
3. Tim confirmed that the Arvada Fire Protection District waived the previously documented fire
sprinkler requirement. Steve had also approved the fire hydrant locations and pressure.
4. The meeting moved onto planning items.
a. Tim said that the placement of the building had been adjusted and that a variance for the
setback from the Metro Water lift station would not need to be made.
b. The retention requirement was briefly discussed and that Dave Brossman with the City
Engineering would need to review and approve the plan.
c. Meredith asked for confirmation of the distance from the west property line to the back of curb
(to be 25' but can be waived if the fire department required this to be adjusted) She also said
that the entry has a 35' max. dimension. (Reference code section 26501D.4.d). LOA to
confirm ( see attached)
d. Any exterior parking lot lights have a 18' maximum and 0 lot line bleed.
e. Meredith questioned the west elevation and the code requirement of a 66% maximum glazing.
After reviewing the other elevations this was waived.

f. The signage was questioned. Only a preliminary scheme has been discussed. Chad said that a
separate sign code will be enforced for this.
g. Exterior materials and colors (stucco and metal roof) were reviewed and accepted. Code does
not accept CMU and pre-engineered metal.
h. A trash enclosure is required and is to be a 6' high opaque material with opaque gates.

The purpose of the meeting was to review the Schematic Design with the City of Wheat Ridge Building
and Planning departments.
A. Luis gave an overview of the project starting with the site plan. The adjacent property and shared
access was reviewed. Luis showed a couple of early schemes that had a drive in front of the facility and
then how that evolved into two (2) separate parking lots on the east and west side of the facility with no
drive.
1. The setbacks for front, side and back yards were confirmed by Meredith Reckert.
2. Meredith confirmed that the playground could not be considered in the 20% open area.
3. The parking formulas were reviewed for classrooms and office. Meredith pointed out that the
second floor administration could use 1:300.
4. The free-standing storage building was discussed. Chad Root stated that if it was less than 1000
square feet, one story and not connected to the main building it would need to have a 15'
setback. LOA'said that it would re-design this to be attached to the main building on order to
maintain the 10' setback.
5. The trash dumpster was discussed and this needs to be completely enclosed on all sides with
gates. Reference section 26-614. LOA said the materials would be complementary to the
building. (LOA and Jeff Co to jointly check out the actual shared location with the adjacent
owner)
6. Meredith and Wheat Ridge Engineering confirmed that a continuation of the sidewalk, curb and
gutter is to be provided in front of the Metro Waste area/easement even thought Jeff
CO is not the Owner of this property. (LOA and Jeff Co to jointly check out the legal
implications ofsnow removal, accidents, etc.)
7. The overhang per code can only be 30". LOA will need to modify the overhang on the back.
8. Meredith noted that the setback of 30' also is applicable to the area directly north of the Metro
Waste "bump out" for the easement. The positioning of the current building footprint
encroaches on the 30'. A 10% variance can be given administratively but our request would be
more than 10%. A variance for this will need to be submitted to the Board of
Adjustments which meets the 4" Thursday of the month. An application was given to LOA. Jeff
Hirt from Planning would be assigned to this procedure.

B. Luis gave a detailed review of the floor plans showing stairs, exiting, elevator location, occupancy
separation walls, etc. The facility will be sprinklered per the Wheat Ridge Fire Department.
1. Chad pointed out that the City will be adopting the 2003 International Building Code (IBC).
Wheat Ridge will have no amendments. Due to the uncertainty of when this facility actually
may get constructed the design team will design to this IBC and not the 1997 Uniform
Building Code. Multipurpose room will be classified as a A-3.
2. It was agreed that Corridors do not need to be rated. Chad said that an area of refuge will need
to be designated in the Stairwells.
3. Chad confirmed that the Health Department will not need to review these because the kitchen is
only for warming and not for cooking as in a commercial setup.

Case No. SUP-03-09 is an application by Sandy Martin for Jefferson County Head Start requesting
approval of an administrative special use permit to allow a public school on Restricted-Commercial
zoned property located at 12725 West 42°d Avenue.
Pursuant to Ordinance No. 1291, the Community Development Director has the ability to decide
upon applications for administrative special use approval, without requirement for a public hearing,
provided the following conditions are met:
1. A completed application package has been submitted and fee paid.
2. The Community Development Department has notified adjacent property owners by
letter notice and the site has been posted for at least ten (10) days,
3. No written objections have been received in such ten-day period;
4. The Community Development Director concludes that the criteria for approval, as set
forth below, are substantially complied with and support the request.
The Community Development Director can impose conditions or stipulations upon the approval,
which may include physical design, operational, and maintenance considerations to ensure
compliance with the criteria for review.
The Community Development Director shall also decide the following:
1. Whether the SUP runs with the land in perpetuity; or,
2. Whether the SUP is personal to the applicant and may or may not be inherited; and
/or,
3. Whether the SUP is granted only for a defined period; after which time the special use
shall expire unless renewed subject to all of the requirements of this section.
The applicant has submitted a site plan showing building layout, parking and drives, playground and
other areas to be landscaped. The property will share a parking aisle access with the property to the
east. All minimum commercial standards and development regulations of the Restricted-
Commercial zone district appear to be met.
FINDINGS OF FACT:
1. A public school is a special use in the RC zone district.
2. Adjacent property owners were notified by certified mail of the application.
3. No written objections were received.
4. The applicant, Sandy Martin for Jefferson County Head Start Program, has the ability to
continuously meet the conditions of the special use permit.
5. The proposed special use will not have a detrimental effect upon the general public health,
welfare, and safety.
6. The proposed special use will not result in traffic congestion nor overburden the capacities of
the existing streets and utilities.
This request for an administrative special use meets all applicable conditions as required by Section
26-114 of the City of Wheat Ridge Code of Laws. Staff has not received written comments in
opposition to this request from the adjacent property owners.
Therefore, Case No. SUP-03-09 is hereby APPROVED with the following conditions:
1. The use of the property is for a public school.
2. The special use permit shall remain in effect as long as Jefferson County Head Start
occupies the structure.
3. The use of the property shall remain consistent with the site plan contained in the case
file. If the use of the structure ceases to be a school, parking shall be provided consistent
with the Off-Street Parking Regulations of the Zoning and Development Code.
4. Within six months of issuance of a certificate of occupancy for the structure, the city
traffic division shall complete an analysis of school zone status for W. 42nd Avenue.

School Zone designation is usually implemented based on actual use. The assessment will be based on
the traffic criteria such as pedestrian crossing volume, vehicular traffic volume, site conditions, parking
activities, traffic circulation, sight distance etc. Upon request, the PW Dept will field evaluate once the
school is in session. Let me know if you want to discuss further.

Planned Use of Lot:
The proposed site would be used for a school with the associated administrative uses. The currently
planned use is for a Head Start facility. The Head Start program consists of morning and afternoon
preschool sessions, providing education for up to 35 children at any given time. The Head Start facility
would have six staff members, and a single bus service provided to the families.
The building would include two classrooms, restrooms, teacher's lounge and a lobby area all on one level.
Federal requirements for the building include that a minimum of 35 sgft/child in each classroom, and 50
sgft/child in the playground. The building will not be a metal building. On the schematic site plan both the
building and playground square footage areas have been sized above the standard requirements to allow for
more space for each child, and allowing space for other unknown items which may be discovered during
the programming phase of design. Parking will be provided per the City of Wheat Ridge's planning
requirements. City of Wheat Ridge's requirements for setbacks and easements have been shown on the
schematic site plan. Please refer to attached drawing in Section 6 of the Special Use Application binder.
The County has not yet contracted for the design of the building so there may be amendments to the layout
of the site plan.
History of Head Start:
The Head Start program began nationally in the 1960's as part of the Economic Recovery Act under
President Lyndon Baines Johnson. The results of the legislation became know as the "war on poverty".
Head Start enjoys bipartisan support and the future continues to look bright.
Jefferson County Head Start program began July 1, 1997. The program services 406 children and families
in a four-county area. The counties are Jefferson, Clear Creek, Gilpin and Park. Jefferson County Head
Start is part of Jefferson County government and is under the Human Services Division. Jefferson County
Head Start provides preschool educational programming for children ages 3 to 5. The program also
provides resource and referral assistance to Head Start eligible families who are at the 100% poverty level.
There is no charge to families for this service.
Jefferson County Head Start is funded 100% by the Federal government through the U.S. Department of
Health and Human Services, Division of Children and Families. Head Start receives 20% in in-kind
contributions from the community and the Head Start parents in the form of goods, services and facilities.
For example, the City of Westminster provides a former library building for Head Start classrooms at a
lease rate of $1.00 per year. Head Start obtained $319,000 in Federal funds to remodel this building. The
Intergovernmental Agreement between Jefferson County and the City of Westminster is for a 20-year
period. The Kings Mill Head Start center in Westminster is located at 9018 Field Street. Prior to this

arrangement with the City of Westminster, no Head Start services were provided in the Jefferson County
portion of the city. Now Westminster has preschool and family services for members of their community
who are unfortunately the "poorest of the poor". For example, a family of four cannot make over $18,400
annually.
Jefferson County Head Start currently has centers in Arvada, Edgewater, Golden and Westminster. Also
centers are located in Empire and unincorporated Southern Jefferson County. There is no center located in
the City of Wheat Ridge, which according to a recently completed Community Needs Assessment, is a high
need area for Head Start eligible families at the 100% poverty level with preschool aged children.

1. DEFINITIONS
(a) "Mortgage" means mortgage, deed of trust or other security instrument.
(b) "Public Records" means title records that give constructive notice of matters affecting the title
according to the state law where the land is located.
2. LATER DEFECTS
The Exceptions in Schedule B - Section 2 may be amended to show any defects, liens or
encumbrances that appear for the first time in public records or are created or attached
between the Commitment Date and the date on which all of the Requirements of Schedule B
- Section 1 are met. We shall have no liability to you because of this amendment.
3. EXISTING DEFECTS
If any defects, liens or encumbrances existing at Commitment Date are not shown in Schedule B,
we may amend Schedule B to show them. If we do amend Schedule B to show these defects, liens
or encumbrances, we shall be liable to you according to Paragraph 4 below unless you knew of this
information and did not tell us about it in writing.
4. LIMITATION OF OUR LIABILITY
Our only obligation is to issue to you the Policy referred to in this Commitment, when you
have met its Requirements. If we have any liability to you for any loss you incur because of an error
in this Commitment, our liability will be limited to your actual loss caused by your relying on
this Commitment when you acted in good faith to:

The following is a summary of the pre - application meeting for a proposed Head Start located at
approximately 12701 W. 42 °a Avenue.

Existing Zoning: Restricted Commercial (R -C)
Existing Comprehensive Plan: Single Family (4 units per acre) SF4
Applicant/Owner Preliminary Proposal: A one story structure and playground to house a
maximum of 35 students for Jefferson County Head Start. The Head Start program consists of
morning and afternoon sessions. The facility would have six staff members, and a single bus
service provided to participating families. The building would include two classrooms, a restroom,
teacher's lounge and a lobby area. May investigate the feasibility of building a two -story building
with a possible basement.
Planning Department Comments: This proposal will require a Special Use to be processed
before a building permit can be submitted. A process for a special use starts with posting the
specific property for a period of 10 days and notification by mail of adjacent property owners. If a
legitimate, written objection to the proposed special use is received in the Community Development
Department within the 10 day posting period, the case will be referred to City Council for a final
decision. If no written objection is received, the process will remain administrative.
The submittal package will be referred out to the appropriate agencies for a 15 -day period.
Comments and/or corrections received from the responding agencies are then given back to the
applicant.
Conditions can be attached to a decision of approval. Staff or City Council as the ability to decide
if the special use permit will run with the land, or just with the current property owner. If a public
hearing is required, then the special use process will most likely take 2 -3 months.
No platting will be required for this process. The property directly to the east shares a cross - access
easement with the subject property for parking and access purposes.
Public Works Comments: Public improvements will be required along W. 42 "d Avenue.
Negotiations with Metro Wastewater District will be required if you desire to utilize their parcel.
Please see the attached memo for further comments from the Public Works Department.
Building Department: Wheat Ridge Fire Department will require the building to be sprinkled. If
you have concerns with sprinkling of the building please contact Dave Roberts, Wheat Ridge Fire
Marshall at 303 - 403 -5902.
Currently, the City of Wheat Ridge is using the 1997 UBC. By the beginning of 2004, the City will
begin using the 2003 IBC. All engineering and construction documents require a wet -stamp and
signature upon submittal. If a second story is planned, the installation of an elevator may be
required. Please contact the Building Department for further details.

This is a high visibility site on the ease side of I -70. It has good accessibility from 44th Avenue

Planned Use of Lot:
The proposed site would be used for a Head Start facility. The Head Start program consists of morning and
afternoon preschool sessions, providing education for up to 35 children at any given time. The Head Start
facility would have six staff members and a single bus service provided to the fa mili e s.
The building would include two classrooms, restrooms, teacher's lounge and a lobby area all on one level.
Federal requirements for the building include that a minimum of 35 s ft/child in each classroom and 50
9ft/child in the pla On the schematic site plan both the building and playground square footage
areas have been sized above the standard requirements to allow for more space for each child, and allowing
space for other unknown items which may be discovered during the programming phase of design. Parking
will be provided per the City of Wheat Ridge's planning requirements. City of Wheat Ridge's
requirements for setbacks and easements have been shown on the schematic site plan. Please refer to
attached drawing.
History of Head Start:
The Head Start program began nationally in the 1960's as part of the Economic Recovery Act under
President Lyndon Baines Johnson. The results of the legislation became know as the "war on poverty ".
Head Start enjoys bipartisan support and the future continues to look bright.
Jefferson County Head Start program began July 1, 1997. The program services 406 children and families
in a four - county area. The counties are Jefferson, Clear Creek, Gilpin and Park. Jefferson County Head
Start is part of Jefferson County government and is under the Human Services Division. Jefferson County
Head Start provides preschool educational programming for children ages 3 to 5. The program also
provides resource and referral assistance to Head Start eligible families who are at the 100% poverty level.
There is no charge to families for this service.
Jefferson County Head Start is funded 100% by the Federal government through the U.S. Department of
Health and Human Services, Division of Children and Families. Head Start receives 20% in in -kind
contributions from the community and the Head Start parents in the form of goods, services and facilities.
For example, the City of Westminster provides a former library building for Head Start classrooms at a
lease rate of $1.00 per year. Head Start obtained $319,000 in Federal funds to remodel this building. The
Intergovernmental Agreement between Jefferson County and the City of Westminster is for a 20 -year
period. The Kings Mill Head Start center in Westminster is located at 9018 Field Street. Prior to this
arrangement with the City of Westminster, no Head Start services were provided in the Jefferson County
portion of the city. Now Westminster has preschool and family services for members of their community
who are unfortunately the "poorest of the poor ". For example, a family of four cannot make over $18,400
annually.

Jefferson County Head Start currently has centers in Arvada, Edgewater, Golden and Westminster. Also
centers are located in Empire and unincorporated Southern Jefferson County. There is no center located in
the City of Wheat Ridge, which according to a recently completed Community Needs Assessment, is a high
need area for Head Start eligible families at the 100% poverty level with preschool aged children.
