The initial application was filed with the City Community Development Department on August
5, 2005. A comment letters was generated by city staff on September 5, 2005. Since that time,
there has been no activity on your special use request.
It is departmental policy that if no action occurs on an open case file within one hundred twenty
days, the case can be closed. Subsequent action on the property will constitute a new application
with new fees required.

This letter is in regard to your request for approval of a special use permit to allow a freestanding
CMRS tower for property zoned C-1, Commercial-One, located at 4700 Kipling Street in the
City of Wheat Ridge. I have reviewed your application and have the following comments:
1. The correct spelling of Wheat Ridge is two words: Please make corrections on the front
sheet under the Project Summary.
2. Please provide discussion regarding parking that is being displaced by the tower. The
requirement for hotel parking is 1 space per guest room plus parking for associated uses such as
on-site restaurants plus 1 space per employee on maximum shift.
3. Several mature trees are to be removed to make room for the new tower. The caliper inch
being removed must be replaced somewhere else on the property.
4. The tower shown on the plans is 40' in height. However, there is discussion about
increasing the height to 50' in the future. To allow this future extension, please show it on the
plan elevations.
5. Include a site data breakdown with building coverage, landscaped coverage and hard
surfaced coverages for both existing and proposed conditions in square footage and percent of
total.
The following are comments received from other city departments and outside agencies.
Wheat Ridge Public Works Department: No comments per August 8, 2005 referral form
returned.
Wheat Ridge Building Division: See attached memorandum from Chad Root dated

The Ramada Inn has failed to pull a permit to fix the burned out portion of the
Ramada Inn. Until the burned out portion gets a certificate of occupancy the Building
Division will not sign off on any new permits. The current permit expirers at the end of
December 2005 at this time the construction should be completed.

The following are our site plan review comments;
1) Fire protection to this location is provided by the Arvada Fire Department
Station # 2 located at 12195 W 52nd Ave. and Station # 1 located at 7900 W
57" Ave.
2) Fire hydrant spacing shall be 300 feet in all occupancies with the exception of
Group R, Division 3, and U occupancies. Provide additional fire hydrant to
protect proposed tower site. IFC 03 508.5.1. Exception 3 Amended.
3) Fire hydrant locations are to be approved by the water district of jurisdiction
and the Division of Fire Prevention. IFC 03 508.1.
4) The unobstructed width of a fire apparatus access roadway shall be a
minimum of 24 feet and an unobstructed clearance of not less than 13 feet 6
inehes. IFC 03 503.2.1 amended
5) The turning radius shall be a minimum of 46 feet outside and 26 feet inside
radius with a four-foot bumper overhang extending around the entire existing
building. Existing turning radius is inadequate. IFC 03 503.2.4.1
6) All dead-end fire apparatus access rods in excess of 150 feet in length shall be
provided with approved provisions for the turning around of fire apparatus.

In reference to Case #SL7P-05-O8, Jeff Keith for Nextel at 4700 Kipling St., Valley Water
District has reviewed the inquiry and offers the following comments- Valley Water
District feels that based upon the type of project and discussion with you, that water
service facilities would not be required. However, I have listed our requirements should
water service be needed or should the Arvada Fire Protection District have further
requirements.
I. Valley Water District can provide water service to your proposed development
subject to Valley Water District rules and regulations.
2. Valley Water District is supplied water through a Denver Wa er Department and must follow Denver Water operating rules contractwith the
regulations.
3. Valley Water District currently has adequate capacity through our Denver Water
contract to serve the project. The District must also follow all Denver Water mandates
with regard to drought and conservation that may be imposed.
4; Additional water on lines, fire hydrantsor Which Wwould be at owners expense to
meet Arvada Fire Protection District 5. The owner will need to provide necessary easements for water facilities.
6. Each separate building structure will require a separate water tap. The owner
will be responsible for the cost and installation of the taps and water service lines.
7, owner will be required to provide a recorded plat of the project to the Valley
Water District.

they be required to address any concerns prior to the final approval of the project.

Comprehensive Plan designation: Community Commercial Center
Existing use/site conditions: The property encompasses 2.78 acres and has a 121-room
hotel on it. An associated restaurant was subject to a fire and is not operating.
Applicant's Proposal: To construct a freestanding CMRS facility with ancillary equipment
shelter. The proposed tower would be located on the northeast corner of the site in the existing
parking lot. It would displace five existing parking spaces. The maximum height of the tower
would be 50'.
Issues Discussed:
How was this site chosen? There appears to be coverage deficiencies in this area. Other
options in this area were considered before choosing this site. The coverage from this
tower would serve both the residential community, as well as traffic on I-70.
If granted, how does the special use permit vest? There are a variety of ways for vesting of
the special use permit which is up to the discretion of staff. Typically, if substantial
investment is made in improvements to the property, the vesting runs with the land.
• Whether construction of the tower would interfere with future redevelopment of the area.
The applicant indicated that 11 extel would be willing to relocate their facilities if the
property ever redeveloped.
• The proposed tower location appears to impede an existing fire lane on the north side of
the existing hotel building. Staff noted that part of the special use process was
notification of utility providers for comment. The Arvada Fire Protection District would
have opportunity to comment at that time.
• The proposed tower location also displaces existing parking and landscaping.
• Maintenance of the property: The property is currently unmaintained. There is a history of
unsavory activity occurring within the hotel itself. The adjacent property owner
submitted digital photos taken of the property.
• Impact on adjacent properties: The owner of the property directly to the north and east
indicated that he is adamantly opposed to the tower construction. He expressed concern
regarding negative impacts to his employees and customers and for his showroom
building. He submitted two letters of objection (one from him and one from the
principal of Pennington Elementary School which is located to the east of the hotel site).

I, Randy Ketelsen, am completely against the proposed "Special Use Permit" that would
allow the construction of a Nextel free standing Cellular tower at 4700 Kipling Street. I
have owned and operated my business on the adjoining property since 1990.
Construction of this tower would seriously damage my property value as well as the
entire neighborhood, would pose health risks to my employees and neighbors, as well as
hundreds of elementary aged school children, and block future re-development of this
area.
I would like to specifically address the criteria for a "Special Use Permit" :
1. Approval of this Special Use Permit WILL have a detrimental effect upon the
general health, welfare, safety and convenience of persons residing or working in
the neighborhood of the proposed use.
Sixty-five men and women working at Ketelsen Campers of Colorado would be at
risk, as well as the employees and residents of the hotel. Over 200 elementary
age students at Pennington Elementary would also be exposed to potentially grave
health risks.
The safety of my employees and customers will be at risk, as the tower will only
be twenty feet from Ketelsen Campers building. If the tower were to fall, or
attachments fail and fall, they would land on the Ketelsen Campers building.
Lightning strikes would be a constant threat to our employees as well as the
general public.
2. Approval of this Special Use Permit WILL create or contribute to blight in the
neighborhood by virtue of physical or operational characteristics of the proposed
plan.
A tower of this magnitude would be a total blight in the neighborhood. It would
be visible from I-70, as well as a huge radius from the site. This is not the image
Wheat Ridge should be displaying.

3. Approval of this Special Use Permit WILL adversely affect the adequate light
and air, causing significant air, water or noise pollution.
Although the hotel already drains all their surface water run-off onto Ketelsen
Campers (they have no retention area) this site will further eliminate landscaped
areas, creating even more run-off.
4. Approval of this Special Use Permit WILL result in undue traffic congestion or
traffic hazards, or unsafe parking , loading, service of internal traffic conflicts to
the detriment of persons whether on or off the site.
It will result in unsafe parking as it will eliminate required parking stalls. Traffic
already has difficulty negotiating the corner where the tower would be located.
Arvada Fire Protection District should be contacted regarding the impossible

5. Approval of this Special Use Permit will NOT address problem issues of
setbacks, heights, parking, buffering, screening and landscaping. This tower
would not be in harmony and compatibility with the character of the surrounding
areas and neighborhood, especially with adjacent properties.
It will violate all of these criteria.
6. Unknown.
History of compliance by the applicant/property owner regarding Code violations
should be reviewed.
8. Ability of the applicant/property owner to comply with Code requirements should
be reviewed in light of past property history.
9. If approved, future re-development of this entire area would be stymied by a
tower in the middle of it.

I would first like to apologize for not attending tonight's meeting. Due to unforeseen
circumstances I am not able to participate, but I am making my feelings known through
this letter that will be delivered by Mr. Randy Kettlesen. I also intend to send you a copy
of this letter as well.
On behalf of Pennington Elementary I strongly object to permitting Nextel
Communications to erect a freestanding cellular tower. First, it is important for you to
understand that there is documentation that states that these types of towers are unsafe for
children. This structure will be within one-hundred yards of our school building and it
will be even closer to our new playground which is scheduled to be built within the next
year. In addition to this tower will being in the back of our new playground area it will
also be in direct view of our school, creating a visually unattractive focal point.
I am aware of the city's needs and understand why the city feels this tower would be
beneficial; however, I do not believe the city completely analyzed the potential risks this
tower would pose.

Applicant/Owner Preliminary Proposal:
Construct freestanding CMRS facility at 4700 Kipling Street with ancillary shelter. The
facility is proposed to go in the northeast corner of the site. There is an existing hotel on
the property.
Will a neighborhood meeting need to be held prior to application submittal? YES
Planning comments:
A special use permit will be required for the proposed facility. Freestanding CMRS
facilities require a special use permit to be constructed. Building or structure mounted
CMRS facilities do not require a special use permit. The process for special use permit
applications is discussed later.
The proposed facility will eliminate approximately 5 parking spaces as shown on the plan
that are used for the adjacent hotel. Eliminating these parking spaces cannot cause the
hotel to have insufficient parking pursuant to the city's parking requirements.

It is recommended that the Arvada Fire Department (303.425.0905) be contacted
regarding any access or circulation issues that may be created with the location of this
facility in back of the existing hotel.
The maximum height allowed is 50 feet. The elevations submitted show a 40 foot facility,
however it was expressed that a 10 foot extension (creating a 50 foot high facility) can be
added in the future. It is recommended that if the intent is to ultimately have a 50 foot
facility, that this be the original request. An additional special use permit may have to be
processed in order to allow for a 10 foot height extension in the future.
The property is zoned Commercial One (C-1).
The setback requirements for the CMRS facility will be as follows. The facility will be
subject to the same setback requirements that a freestanding, 50 foot sign would. This
will require a setback of 30 feet from any right-of-way line, however it does not appear
that the facility will be adjacent to any right-of-way. There is no setback requirement for
the facility at the location proposed, as the property is adjacent to commercially zoned
and used property. There cannot be any immediate visual blockage to any existing
signage in the area. If there is blockage, an offset of some kind may be required.
The setback requirements for the adjacent telecommunications shelter, shown at 11 feet
in height on the plans submitted, will be as follows. The shelter is a permanent structure,
therefore it will be subject to a 10 foot rear (east) setback requirement, and a 5 foot side
(north) setback requirement. The side yard setback requirement can be reduced to 0 feet
with the use of masonry or nonflammable material and in accordance with applicable
building codes.
Screening for the equipment and any trash storage areas must be in the form of a 6 foot
high solid fence.
Any type of lighting for the proposed facility should be indirect, and have no adverse
effects on adjacent properties, structures, or present any type of safety hazard for
motorists or pedestrians. Per the Code of Laws Sec. 26-503 (C)(4) all exterior lighting
shall be designed and situated so that all of the directly emitted light falls within the
property lines.
Based on the information submitted regarding the existing and proposed coverage, it is
not clear to staff at this point why the necessity exists for this facility. Clarification will be
needed as part of the formal application for the special use permit. Clarification for the
necessity of this facility at the pre-application phase, particularly the neighborhood
meeting will be beneficial as well. The proposed coverage does not seem to add a
substantial amount of coverage than what is existing if these illustrations are being
interpreted correctly.
The city may require upgrades to the appearance of the facility, both the CMRS
freestanding tower and the shelter. This may come in the form of conditions of approval

of the special use permit. Examples would be the color of the freestanding tower and the
materials used on the proposed shelter facility.

Streetscape /Architectural Design comments:
The application must meet the requirements of the Streetscape and Architectural Design
Manual.
The Streetscape and Architectural Design Manual does not allow the use of steel and
concrete for building materials.
Other comments:
A special use permit will be required to allow for the proposed facility on the property.
Freestanding CMRS facilities require a special use permit. The special use permit can be
approved administratively (without a public hearing) if there are no written objections
directly related to the special use request during the 10-day public notice period and if the
plan meets all applicable standards.
Now that a pre-application meeting has been held, the applicant can work with staff to
schedule the required neighborhood meeting. The Community Development Department
will initiate the 600' radius property owner search for the neighborhood meeting notice.
There is a $100 fee for the neighborhood meeting that needs to be received on or before
the date of the meeting. Once the neighborhood meeting is held, a formal application for
a special use permit may be submitted. Upon receipt of the application the proposal will
be referred to the necessary outside agencies for a period of 15 days review and
comment.
After the review process is complete, the Community Development Department shall
notify adjacent property owners by certified letter and posting of the site for 10 days. If no
written objections directly related to the special use request are received within this 10-
day period, the Community Development Director can approve, approve with conditions
or deny the special use. Upon receipt of any written objections by an adjacent property
owner or upon appeal by an applicant of a decision by the Community Development
Director, the special use request will be heard by the City Council through a public
hearing process. If approved, either by the Community Development Director or by the
City Council at a public hearing, the special use becomes effective immediately.

FOR THE NEW PROPOSED NEXTEL COMMUNICATIONS CMRS FACILITY
CITY OF WHEAT RIDGE SPECIAL USE PERMIT APPLICATION
SITE NAME: XAVIER / SITE NO. CO-0719
4700 KIPLING STREET, WHEAT RIDGE, CO
SEC 26-114. Special Uses
D. Criteria for Review
The proposed CMRS facility consists of a 20' x 45' lease area in the parking lot on property
located at 4700 Kipling Street. The proposed facility will include a 40' co locatable monopole
including a 12' x 20' equipment shelter.
The site is located in the far northeast corner of the property and therefore, will not have a
detrimental effect upon the general health, welfare, safety and convenience of persons
residing or working in the neighborhood of the proposed use.
The proposed site will not create or contribute to blight in the neighborhood by virtue of
physical or operational characteristics of the proposed use. The neighborhood consists of
commercial uses to the north, south and east. There is some multifamily residential to the
west along with a commercial strip center. The surrounding existing neighborhood uses are
consistent with the proposed cellular monopole.
3. The proposed site will not adversely affect the adequate light and air, nor cause significant
air, water or noise pollution. Neither the equipment shelter nor the monopole will cause
significant air, water or noise pollution. Nextel Communications hereby represents and
warrants that it shall not use, generate, handle, store or dispose of any Hazardous Material in,
on, under, upon or affecting the Property in violation of any Environmental Law.
4. The site will have no effect on traffic congestion or traffic hazards, nor will it create unsafe
parking, loading, service or internal traffic conflicts to the detriment of persons whether on or
off the site. The site is located in the parking lot of the Hotel Inn Express in the far northeast
corner. There are no loading docks or internal traffic in this area that will cause detriment
on or off the site.
The site will be appropriately designed, including setbacks, heights, parking, bulk, buffering,
screening and landscaping, so as to be in harmony and compatible with the character of the
surrounding areas and neighborhood, especially with adjacent properties. The site will meet
all City of Wheat Ridge building code requirements including setbacks, heights, parking,
bulk, buffering, screening and landscaping. All setbacks will be met according to the City of
Wheat Ridge Regulations. The height limit for CMRS in C-1 zone district is 50'. The
proposed monopole height is 40' and will accommodate approximately two (2) carriers. A
10' extension can be added to the monopole for a third carrier. The site is unmanned and
only requires a technician to be onsite once a month for approximately two hours to clean
and optimize the equipment and therefore, it onsite permanent parking is required. Screening
the facility will consist of a 6' tall wood cedar fence or whatever type of fencing is required
by the City of Wheat Ridge. The monopole is a galvanized steel color and Nextel feels this
natural color is compatible and will blend with the surrounding environment however if the
City of Wheat Ridge requires, Nextel will paint the monopole a color suggested by the City.
No landscaping is proposed at this time however if the City of Wheat Ridge requires it, a
landscaping plan will be submitted.
6. The site will not overburden the capacities of the existing streets, utilities, parks, schools and
other public facilities and services. The site does not require any public facilities except for a
low power electric service and telephone service and therefore will not overburden the
capacities of existing streets, utilities, parks, schools or other public services.
7. History of compliance by the applicant with Code requirements or any prior conditions
regarding the subject property. Nextel Communications does not have a history of any prior
code violations with the City of Wheat Ridge regarding the subject property.
8. Ability of the applicant or any permitted successor-in-interest to continuously meet the
conditions of the proposed permit. Nextel will provide a statement of ability to continuously
meet the conditions of the proposed permit and will require any permitted successor-in-
interest to meet the same conditions.
9. Other factors relevant to the specific application. Any other factors relevant to this specific
application will be addressed with the Planning Department and will meet the City of Wheat
Ridge code regulations.
10. Nextel will meet or address any conditions of approval requested by City Council after their
review.
Nextel feels their proposal meets the City of Wheat Ridge Zoning Regulations and is requesting
approval of the Special Use Permit Application.
