At its meeting of April 2, 2009, Planning Commission APPROVED Case No. MS-09-01, request
for approval of a 2-lot minor subdivision plat for property zoned Agricultural-One and located at
4593 Parfet Street for the following reasons:
1. All development standards of the A-1 zone district have been met.
2. All requirements of the Subdivision Regulations have been met.
3. All required utility easements have been provided.
With the following conditions:
1. The plat shall be signed by the appropriate owners following probate of George Williams'
estate.
2. The plat shall not be recorded until the one-foot strip connecting 46th Avenue to the
property be dedicated to the city for right-of-way.

Mr. Tietz explained that a cross access easement currently extends across lot 2
which would grant public works access to the lot without having access from 46 n.
Commissioner REINHART agreed with staff s conclusions, but expressed
concern that there is no uniform standard to determine which streets require
public improvements. This can give the appearance that standards differ from one
person to another. He suggested that staff develop a standard to determine where
it is appropriate to require public improvements and where it is not.

Commissioner CHILVERS asked if there would be a fence between the
subdivision and the city's property. Mr. Tietz explained that once the subdivision
is complete, the city would purchase lot 2 and a fence would be constructed. The
property would remain vacant until funds are available to expand the public works
facilities. Mr. Paranto showed a copy of the master plan for the facilities to the

I. REQUEST
The applicant is requesting approval of a minor subdivision plat. Two lots will be created as a
result of the subdivision.
The Planning Commission has the ability approve minor subdivisions which involve no
dedications for public streets or other public uses, or which involve no right-of-way vacations.
The decision by Planning Commission is final.
The purpose for the subdivision is for the purchase of Lot 2 by the City of Wheat Ridge in order
to expand the existing Public Works facility for the future consolidation of the Parks and Public
Works Department's administrative facilities and maintenance operations. The original request
was accompanied by a request to rezone Lot 2 from A-1 to PF, Public Facilities. The request for
the rezoning has been withdrawn as the purchase of the property is dependent only on the
subdivision. The request for the rezoning will occur at a later date by the Public Works
Department.
II. EXISTING CONDITIONS
The property on which the action is being requested is located at 4593 Parfet Street and is zoned
Agricultural-One (A-1). The A-1 zone district was established to provide a high quality, safe,
quiet and stable residential estate living environment within a quasi-rural or agricultural setting.
In addition to large lot, single-family residential and agricultural uses and activities;
governmental/public and semi-public buildings and facilities are allowed in this zone district.
The property is a long and narrow lot, approximately is 4.32 acres in size, which has a single
family home on it. There are also several outbuildings and other structures located throughout
the property that support agricultural uses on the lot. (Exhibit 1, Alta Survey)
The lot is relatively flat and has two irrigation ditches that traverse the property. One irrigation
ditch runs along the southern property line while the other cuts across the rear portion of the
property from southwest to northeast before following the northern property line. The area to the
west of this irrigation ditch remains unused. The eastern portion of the property has historically
been used for agricultural purposes. In more recent years it has been used to grow pumpkins.
The surrounding area has a large mix of different zone districts and land uses. The majority of
the area is zoned A-1 with single family homes and agricultural uses on large lots. There is also
a private school located to the south of the eastern portion of the property. There are areas of R-
2 zoning to the west and southeast that contain both single family homes and duplexes. Directly
to the south, on the western portion of the property, there is the Public Works Operations facility,
which is zoned PF. Further to the south there are some commercial uses and zoning on
properties that have frontage along W. 44th Ave.
III. CASE ANALYSIS
Whoever divides, or participates in the division of a lot, tract, or parcel of land into 2 or more
lots must comply with the regulations in the City Code Section 26-401. No final plat of a
subdivision can be approved and accepted by staff, the planning commission or the city council
unless it conforms to the provisions of these regulations. The regulations are regarded as
minimum requirements for the protection of the public health, safety and welfare. The A-1 zone
district development standards were used to examine the conformance of the newly created lots.

Lot 1 (eastern lot)
There is an existing single-family structure with several other accessory buildings located on Lot
1 that will remain. The subdivision plat will create a new rear yard property line on lot 1. As a
result of the subdivision, Lot 1 will be reduced in size to 123,698 square feet or 2.84 acres.
(Exhibit 2, Subdivision Plat) The A-1 zone district allows for 25% maximum building coverage.
With all the existing buildings, the lot coverage is well below the 25% coverage limitation at
2.5%.
The existing structures that are on the lot must meet minimum rear yard setbacks from this new
property line. A main structure in the A-1 zone district must have a minimum rear yard setback
of at least 15 feet while barns, sheds and other accessory structures can maintain a setback of 5
feet. The closest structure to the rear lot line is an existing barn. It is approximately 320 feet
from the newly created rear (western) property line. The home will be approximately 430 from
the rear property line. The front and side yard property lines are not required to be examined
since the improvements on the property are already in place and no new front or side property
lines were established. The side yards are conforming with required side yard setbacks while the
main dwelling structure is only approximately 14.5 feet from the front property line.
The required lot width for a parcel in the A-1 zone district 140 feet and the minimum size is one
acre. Both the lot width and size requirements have been met. The width of Lot 1 will be 254
feet while the size will be 2.84 acres.
Lot 2
The newly created lot is required to meet all development standards of the A-1 zone district. Lot
2 will meet the lot size and width requirements with a width of 254 feet and it being 64,770
square feet or 1.49 Acres.
Building setbacks and lot coverage were not examined as no buildings are proposed for Lot 2 as
a part of this request. When buildings are constructed they will be required to meet all setback
requirements.
Right-of-Way Dedication
When there is a subdivision of land dedication of right-of-way is typically required for
improvements to the street, if the street is not constructed to City standards. The most common
right-of-way dedication requires the dedication for the installation of curb, gutter and sidewalk.
Dedications can also be required in order for the streets to be widened or to be able construct
streets that haven't been built and are necessary to support the proposed subdivision. The Public
Works Department has the discretion to waive the requirements to dedicate right-of-way based
on the surrounding conditions.
The subdivision does have frontage along two public streets, Parfet Street on the east and W. 46th
Avenue on the west. W. 46`h Avenue dead ends into Lot 2 of the subdivision and there is no
curb, gutter or side walk along the Parfet Street, street frontage of Lot 1.
The Public Works Department has determined that no dedication of right-of way will be required
as there is no curb, gutter, or sidewalk on either side of Parfet Street from W. 44th Avenue north
to W. I-70 Frontage Road South and as curb, gutter, and sidewalk will likely never be installed
on this stretch of road. No cul-de-sac bulb is required to be dedicated or constructed at the end
of W. 46th Avenue since access to the Public Works maintenance facility will remain off of W.

45'h Avenue on the west side of the facility. A gate will be installed at the terminus of W. 46th
Avenue which will only be used for emergency access.
Utility Easements
Easements for utilities were established around the perimeter of each lot as required by the Code
of Laws. The easements meet the minimum standards set in the Code which requires 10 foot
easements for all front and rear property lines and 5 foot easements for all side property lines.
IV. AGENCY REFERAL
All affected service and utilities were contacted regarding their ability to serve the property with
respect to this application. The applicant will bear the cost of upgrading any service to the
property. The following comments were received by the affected agencies:
Public Works: Public Works had minor comments pertaining to the form and content of the
subdivision plat. All items have been addressed to the satisfaction of the Public Works
Department.
Xcel Energy: Xcel has no conflict with the subdivision. If the rear portion of Lot 1 of the
subdivision is ever developed, they do advise that there is an 115kV overhead electrical
transmission line that could have implications on the development of that portion of the lot.
Valley Water: Currently Lot 1 is served by a well, but both Lots 1 and 2 do have the ability to
be served by Valley Water, subject to Denver Water operating rules and regulations. When the
properties are developed, each new building will be required to connect to the public system and
have separate water taps. At that time the developer should contact Valley Water to discuss the
water system design needs.
Arvada Fire: When buildings are constructed on the lots, the existing Valley Water District
water line will be required to be extended and looped in order to be able to provide fire
protection to the new buildings. In addition, fire hydrants will have to be installed along the loop
line for protection. The number of hydrants is yet to be determined.
Access lanes will also have to be provided for fire apparatuses, as required by the current edition
of the International Fire Code, in order to occupy any building that is constructed.
Other: All other referral agencies did not to respond to the request for comments which
indicates that they have no comment. Typical utility easements are being established around the
perimeter of each lot and are shown on the subdivision plat.
V. STAFF CONCLUSION & PROPOSED MOTIONS
Because this is a two-lot minor subdivision with no right-of-way dedication required, Planning
Commission is the final decision making authority. Staff has concluded based on the A-1 zone
district development standards, all the requirements for a subdivision in the A-1 zone district
have been met. Because the requirements for a minor subdivision have been met, a
recommendation of APPROVAL is given for Case No. MS-09-01.

Notice is hereby given that a Public Hearing is to be held before the City of Wheat Ridge
PLANNING COMMISSION on April 2, 2009, at 7:00 p.m. in the City Council
Chambers of the Municipal Building at 7500 West 29`h Avenue, Wheat Ridge, Colorado.
All interested citizens are invited to speak at the Public Hearing or submit written
comments. Individuals with disabilities are encouraged to participate in all public

The subdivision plat for the property located at 4593 Parfet Street has been received. After the first
review of the documents, I have the following comments. Please see the attached redline plans for
further details.
1. Zoning, lot numbers, and subdivision names are required to be shown for all lots adjacent to
the subdivision. If the lots have not been platted please label as "Unplatted". Examples are
provided.
2. A section titled "PLAT NOTES" should be added to the plat. Items to be included in the
notes are indicated. The language to be used for the notes will be listed below.
3. Standard utility easements should be shown on the plat. The easements should be 5 feet
wide along the north and south property lines and 10 feet wide along all east and west
property lines. These areas are indicated by the dashed lines. The easements should also be
labeled on the final plat.
4. Standard Easement Language should be added to the "PLAT NOTES" as item 1. The
language should read, "Ten foot (10 ) wide easements are hereby granted on private
property adjacent to all public streets and front and rear property lines of each lot in the
subdivision or platted area. 5 -foot (5 ) wide easements are hereby granted on private
property adjacent to all sided lot lines of each lot in the subdivision or platted area. These
easements are dedicated for the installation, maintenance and replacement of electric, gas,
television cable, drainage and telecommunications facilities. Utilities shall also be
permitted within any access easements and private streets in the subdivision. Permanent
structures and water meters shall not be permitted within said utility easements.
5. A cross access easement will be required between lot 2 of the Pumpkin Patch Subdivision
and the property owned by the City of Wheat Ridge to the south. The area of the cross
access easement is shown by the "dot pattern" on the plat. The easement should also be
labeled on the final plat.
6. Cross Access Easement Language should be added to the "PLAT NOTES" as item 2. The
language should read, "The owner, his successors and assigns grants limited rights and
privileges to access and to free movement through those areas indicated as `cross
access/ingress-egress easements', as illustrated upon this plat. Such grant of easement shall

be limited to the owners, tenants, customers, and guests of the owners, and shall furthermore
grant access to and free movement through said easements to those entering said easements
from similarly recorded easements from adjacent properties and/or from abutting public
streets.
Under the heading "General Notes", item number 11, please correct the sentence to read,
"Subject property is zoned Agricultural-One (A-1). Refer to City of Wheat Ridge Code,
Chapter 26, Section 204 and Section 213 for a list of allowed uses and development
standards.
8. Please insert the word `feet" after the distance 1,327.13 in the legal description.
9. In the owners certification block, please replace "OWNER" and "STATE OF COLORADO"
with the owner's actual name and address. A second signature block should also be
provided for the second owner.
10. Please replace "SIGNATURE" with your name and PLS# in the Surveyors Certification
Block.
11. Please add a "Case History" box with the following case number: MS-09-01
Other items of concern:
City policy requires title insurance for all subdivisions of land. The title commitment shall
be provided with title insurance policy (to the benefit of the City) that is current to 30 days
provided at the time of submittal of the subdivision plat for Mylar recording.
2. Attached are referrals received from other city departments and outside agencies regarding
the plat document.
Please address each of these comments and redline corrections by revising the plat document
accordingly. A public hearing before Planning Commission has been set for April 2, 2009. Upon
the correction of all discrepancies, please submit 18 full-size copies (folded) of revised plat to the
Community Development Department by March 19, 2009. Please note that an electronic copy and
11x17 reduction of the plat is required with the resubmittal.

We have reviewed this request for conformance with the 2003 International Fire Code
and have the following comments.
1. Fire protection is provided to this site by Station 2, 12195 W. 52"d Ave. and Station
1, 7900 W. 57ti' Ave.
2. If buildings are proposed to be constructed at the site, the existing Valley Water
District water line will need to be extended and loop in according to Valley
Water District Standards.
Additional fire hydrants will need to be installed. The number of fire h d°ants . ,ill
be determined by the minimum required fire flow and construction type of the
building.
4. Access lanes for fire apparatus and code requirements for the occupancy to be
constructed will need to be provided as required by the current edition of the
International Fire Code.

In reference to Project #MS-09-0 IAVZ-09-01, 4953 Parfet St., Valley Water District has
reviewed the inquiry and offers the following comments:
1. Valley Water District does not currently provide water service to the property.
Valley Water District can provide water service to the proposed Lot 1 and Lot 2 subject
to Valley Water District rules and regulations.
2. Valley Water District is supplied water through a distributors contract with the
Denver Water Department and must follow Denver Water operating rules and
regulations. The District must also follow all Denver Water mandates with regard to
drought and conservation that may be imposed.
3. Additional looped water main lines, fire hydrants and fire sprinkler lines may be
needed to serve the property that meet Arvada Fire Protection District requirements
which will be at owner's expense.
4. Each separate building structure will require a separate water tap. Please contact
the District regarding domestic water service prior to construction.
5. The owner will be required to provide a recorded plat of the project and necessary
easements to the Valley Water District.
6. The owner of the property will need to contact Valley Water District at 303-424-
9661 prior to development of the project to discuss water system design needs.

SUBJECT: Pumpkin Patch Subdivision and Change in Zone at 4593 Parfet Street
The 2004 Public Works/ Parks Maintenance Master Plan proposed consolidation of the Public
Works and Parks maintenance operations at the existing Public Works Maintenance Facility. The
consultants determined that it would be very difficult and expensive to relocate both operations
to another site. Locating the Police Department evidence custody function at the Public Works
Maintenance Facility was also recommended. The Master Plan concluded that a minimum of
1.05 acres of additional land was needed to accommodate the needs of the consolidated
Maintenance Facility.
The Master Plan concluded that there were numerous advantages to combining the
maintenance operations of the Public Works and Parks Departments and include the
following:
1. Greater efficiency in having the operations at the same location
2. Shared work areas (less duplication for the same types of spaces)
3. Improved work areas
4. Covered storage for equipment
5. Better access to shared equipment
6. Better access to equipment and vehicles by City mechanics
Future relocation of the Parks Administration offices and Operations Shops from the facility
near Anderson Park will allow future redevelopment of that area to be included in the Park
per the recommendations in the Parks and Recreation Master Plan.
Phase 1 of the Master Plan implementation was completed in 2006 with the construction of
the new Police Department evidence building and storage yard. Phase 2 will consist of the
construction of a new administration building, which was originally proposed for
construction in 2008 and 2009, but is now planned for 2012.
In anticipation of funding the administration building in 2009, the City Council authorized
Staff to negotiate the purchase of 1.5 acres of vacant land adjacent and north of the
Maintenance Facility. Staff has negotiated with the property owners, Allen and George
Williams, for the purchase of the rear 255 feet of their lot at 4593 Parfet Street. The amount
to be purchased is larger than recommended in the Master Plan in order to avoid leaving an
unusable remnant north of the recommended area.
On October 27, 2008, City Council approved the purchase of approximately 1.5 acres of property
north of the existing Public Works Maintenance Facility for future consolidation of the
maintenance functions.
The purpose of this plat is to divide the existing lot into two separate parcels to allow the
purchase of western 1.5 acres of the lot. This portion of the lot will also be rezoned to Public
Facilities in anticipation of the expansion of the Maintenance Facility. An easement will be
dedicated for the existing irrigation ditch that crosses the property. Otherwise, no other
dedications or improvements are planned. Eventually, a consolidation plat will be done to
combine this lot with the existing Maintenance Facility lot.

Re: First Review Comments of the Pumpkin Patch Subdivision Final Plat.
Dear Mr. VanRaemdonck,
I have completed the first review of the above referenced Plat for the parcel located at 4593 Parfet Street
received electronically on February 6, 2009, and I have the following comments:
Final Plat:
1. Please show the property owners exactly as shown on the deed for parcel #39-212-00-031. The
two brothers, George Lester Williams and Allen Eugene Williams are the current owners of this
parcel - not the City of Wheat Ridge (and the County will of course reject the plat without the
names exactly matching the deed).
2. Revise the "Power Line Easement" on the graphical portion to read "Electric Lines Transmission
Right-of-Way" to be consistent with the note below the Owner's Certificate.
3. Show the new lot line as "LOT LINE HEREBY CREATED BY THIS PLAT".
4. Two of the property corners need to be tied to the section per the City's Geodetic Surveying Requirements
for Final Plats (please see attached sheets). A section tie diagram (see attached sheet) can to be utilized to
depict the section, but a minimum of two (2) property boundary corners of the site must be tied to any of
the three (3) following control point types within the City of Wheat Ridge network per the Requirements:
a. Section corners.
b. Quarter-section comers.
c. City of Wheat Ridge Permanent High Accuracy Control (PHAC) points.
5. Need to include the following standard documents with the next submittal:
a. A completed copy of the Geodetic Surveying Requirements for Final Plats checklist.
b. A Closure Report, for the boundary and also for each of the lots. The error of closure shall
not exceed 1:50,000 for all linear and angular (bearing) measurements per Section 26-407-
D of the City of Wheat Ridge Municipal Code of Laws.
6. The following statement needs to be included on the plat: "Per Colorado Revised Statutes Sec.
38-51-106 (L), all lineal units depicted on this Land Survey Plat are U .S. Survey Feet. One Meter
equals 39.37 divided by 12 U.S. Survey Feet according to the National Institute of Standards and
Technology".
7. A statement regarding the horizontal coordinate system and vertical datum used must be
included:
The following information must be shown on the Final Plat
a. The Coordinate System is a ground-based modified form of the NAD83192 State Plane
Coordinate System, Colorado Central Zone 0502.
b. Vertical Datum is the North American Vertical Datum of 1988 (NAVD88).
c. Ground to Grid Combined Scale Factor is 0.99974780300, scaled from base point PBAC 1
(Permanent High Accuracy Control Point #1) which has the following coordinate values:

8. Per C.R.S. 38-52-106, the Final Plat shall contain a completed Statement of Accuracy, as
defined by the National Ocean Survey/National Geodetic Survey, used to derive the coordinates
shown on the Final Plat. The form of the Statement of Accuracy shall be:
The geodetic point coordinate data shown herein has been derived from the Colorado
Coordinate System of 1983, Central Zone 0502, and has a horizontal Accuracy
Classification of U.S. Survey Feet at the 95% Confidence level, as defined in
the Geospatial Positioning Accuracy Standards of the Federal Geodetic Control
Subcommittee (FGDC-STD-007.2-1998).
With the next submittal, include the following standard documents from the previously
provided Land Surveying Information Packet:
a. A completed copy of the Geodetic Surveying Requirements for Final Plats checklist (please
see attached).
b. A Closure Report, for the boundary and also for each of the lots. The error of closure shall

Applicant/Owner Preliminary Proposal:
The property on which the action is being requested is currently zoned A-1, Agricultural
One District. The applicant is proposing to subdivide the lot into two smaller lots. One lot
will be 1.5 acres while the remaining parcel will be 2.75 acres. The western lot (1.5 acre
lot) will be purchased by the Public Works Department in order to expand their
Maintenance and Operations Facility.
The western lot will also be rezoned to PF, Public Facilities, to allow the property to be
used for the operations of the Public Works facility.
Will a neighborhood meeting need to be held prior to application submittal?
A neighborhood meeting will not be required for the platting process. One will be required
for a zone change.
Existing Conditions:
The parcel on which the action is being requested is zoned Agricultural One, A-1. This
district was established to provide a high quality, safe, quiet and stable residential estate
living environment within a quasi-rural or agricultural setting.
The property is a long and narrow lot that is approximately is 4.25 acres in size. The lot is
relatively flat but has two irrigation ditches that traverse the property. One irrigation ditch
runs along the southern property line while the other cuts across the rear portion of the
property from southwest to northeast before following the northern property line. The
area to the west of this irrigation ditch remains unused. The front portion of the property
has historically been used for agricultural purposes. More specifically, it has been used
to grow pumpkins for several decades.
The surrounding area has a large mix of different zone districts and land uses. The
majority of the area is zoned A-1 with single family homes and agricultural uses on very
large lots. There are areas of R-2 zoning to the west and southeast that contain both
single family homes and duplexes. Directly to the south of the property is the Public
Works Operations facility, which is zoned PF. Further to the south there is some
commercial zoning on properties that have frontage along W. 44t' Ave.
Planning Comments:
The subdivision of the lot will be required to be platted by a licensed engineer in the State
of Colorado. The plat will describe the new lots in legal terms as well as depict them in
graphical form. Easements will be required to be placed around both irrigation ditches.
These easements will also need to be shown on the plat.
Rezoning the property to PF is a straight rezoning. It does not require an outline
development plan or final development plan to be developed in conjunction with the
rezoning. The uses allowed in the PF zone district are restricted to governmental, quasi-
governmental, and other public facilities including parks and schools. Since the property
will be used for the Public Works Operations facility in the future, the zone change to a PF
zone district will be an appropriate zone district for the future land use.
The Process:
Both the application for the zone change and subdivision may be submitted
simultaneously for review. Incomplete applications will not be accepted or reviewed. All
required documents must be included with the application otherwise the application will
be considered incomplete.
The minor subdivision process does not require a neighborhood meeting. The application
for this process may be submitted at any time. Upon submittal of the subdivision
application and plat, the case manager will review and make comments on the project. .
The project will simultaneously be reviewed by other departments and utility companies
for their comments.
When the review is complete the case manager will inform the applicant of issues that
other departments and outside utility companies need to have addressed or if all
requirements have been met. If all requirements are to the satisfaction of Community

Development Staff the plat must be printed on Mylar paper and signed by the appropriate
parties in order for the plat to be recorded with the Jefferson County Clerk and Recorder.
Once the plat has been recorded, the subdivision will become official.
Before the application for the application for the zone change can be submitted, the
second step required by the Community Development Department will be to conduct a
neighborhood meeting. For this meeting, the applicants must inform all property owners
via mail or hand delivery within a 600 foot radius of the property on which the request is
being applied for of the meeting. The Community Development Department will supply
the applicant with a list of the all property owners within the 600 foot radius. The meeting
will be led by the applicant and should inform those who are in attendance what is being
proposed. After the neighborhood meeting is held, the applicant may submit their
application for the request.
Neighborhood meetings can be held at city hall or any location the applicant desires. All
costs associated with meeting, its location, and mailings will be paid by the applicant.
A sample of the neighborhood meeting letter can be found in the pre-application meeting
packet and can be used as a template. However, changes to the letter should be made
to suit the applicant, including the letterhead. A fee of $100 is required for staff to be
present at this meeting.
After the neighborhood meeting is held, the process will be similar to that listed above
however public hearings before both Planning Commission and City Council will be
required.
After the review of the application and the accompanying documents, if all requirements
are to the satisfaction of Community Development Staff, the applicant will be scheduled
for a public hearing before the Planning Commission with a recommendation of approval,
approval with conditions, or denial. At the hearing, staff will present evidence to support
their recommendation. The public will also be allowed to present evidence or give
testimony in support or in opposition of the project. The Planning Commission will
recommend approval, approval with conditions, or denial of the project based on the
testimonies given by staff, the applicant and the public.
After the Planning Commission hearing, the case will be heard before City Council. City
Council will make the final determination to approve, approve with conditions or deny the
application. The City Council meeting will follow the same format as the Planning
Commission hearing, at which, the City Council will give a final ruling on the case.
