Case No. WA-99-26, an application by Robert Graf for an administrative variance of 900 square
feet from the minimum lot size of 9,000 square feet at the property located at 5571 West 27"'
Avenue. Said property is zoned R-3.
Pursuant to Section 26-6 (D)(2)(a) of the Wheat Ridge Code of Laws, the Zoning Administrator
is empowered to decide upon application for a waiver from the minimum lot size requirement
since the following conditions apply:
1. The variance does not exceed ten (10) percent of the minimum or maximum standard.
2. That the Zoning Administrator finds that the "findings of fact," as set forth in subsection
(2)(c), are substantially complied with and support the request.
3. The Zoning Administrator has not received objections to the project after noticing and
posting the site for ten days.
4. No additional dwelling units would result from this approval.
This request for a variance of 900 square feet from the minimum lot size of 9,000 square feet
meets all applicable conditions as required by Section 26(D)(2)(a) of the City of Wheat Ridge
Code of Laws. Staff has not received comments in opposition to this request from the
surrounding neighbors.
Therefore, staff recommends APPROVAL of Case WA-99-26

This is to inform you that Case No. WA-99-26 a request for an administrative variance of 900
square feet from the minimum lot size of 9,000 square feet at the property located at 5571 West
27`r Avenue has been received by the Department of Planning and Development.
The applicant is requesting an administrative variance review which allows no more than a ten
percent (10%) variance to be granted by the Zoning Administrator without need for a public
hearing. Prior to the rendering of a decision, all adjacent property owners are required to be
notified of the request by certified mail.
