HomeMy WebLinkAboutRes WA-02-11 ORIGINAL CERTIFICATE OF RESOLUTION I, Ann Lazzeri, Secretary to the City of Wheat Ridge Board of Adjustment, do hereby certify that the following Resolution was duly adopted in the .City of Wheat Ridge, County of Jefferson, State of Colorado on the 26th day of September. 2002. CASE NO. WA-02-11 APPLICANT'S NAME: Kimary Marchese LOCATION: 10400 West 38th Avenue Upon a motion by Board Member ABBOTT and second by Board Member HOVLAND, the following resolution was stated: WHEREAS, the applicant was denied permission by an administrative officer; and WHEREAS, Board of Adjustment Application Case No. W A-02-11 is an appeal to this Board from the decision of an administrative officer; and WHEREAS, the property has been posted the fifteen days required by law; and in recognition that that there were no protests registered against it; and WHEREAS, the relief applied for MAYbe granted without detriment to the public welfare and without substantially impairing the intent and purpose of the regulations governing the City of Wheat Ridge. NOW, THEREFORE, BE IT RESOLVED that Board of Adjustment Application Case No. W A-02-11 be, and hereby is, APPROVED. TYPE OF VARIANCE: Request for approval of a variance to the fence height standard in a minimum front yard setback for an increase from the four foot maximum height requirement to six feet. FOR THE FOLLOWING REASONS: . I. The six-foot portion of the fence will extend only fifty feet and will be a picket style fence with decorative archways at both ends of the fence. The properties to the west and east are commercial and would not be negatively impacted by this request. 2. Granting the variance would not diminish property values or general appearance and character of the neighborhood. 3. The requested variance may produce a benefit or contribution to the neighborhood and community by enhancing a historic property. 4. The applicant testified that she felt that the fence, as proposed, had received positive feedback from Claudia Worth, President of the Wheat Ridge Historical Society. The fence must be pickets as proposed or otherwise compatible and complimentary in design and color to this particular historic property. 2. The variance shall apply only to the portion of the frontage as illustrated in the application and at no less a setback than applied for. NO: ABBOTT, BLAIR, DRDA, ECHELMEYER, HOVLAND, HOWARD, MONTOYA, YOUNG None VOTE: YES: DISPOSITION: A request for approval of a variance to the fence height standard in a minimum front yard setback for an increase from the four foot maximum height requirement to six feet was APPROVED.
