Adjustment, do hereby certify that the following Resolution was
duly adopted in the City of Wheat Ridge, County of Jefferson,
State of Colorado, on the 22nd day of September 1994..

Upon motion by Board Member ABBOTT , seconded by Board Member
HOVLAND ,'the following Resolution was stated.
WHEREAS, the applicant was denied permission by an Administrative
Officer; and
WHEREAS, Board of Adjustment Application, Case No. WA-94-11A
is an appeal to this Board from the decision of an Administrative.
Officer; and
WHEREAS, the property has been posted the required 15 days by law
and there WERE protests registered against it; and
WHEREAS, the relief applied for MAY be granted without detriment
to the public welfare and without substantially impairing the
intent and purpose of-the regulations governing-the City of Wheat
Ridge.
NOW, THEREFORE, BE IT RESOLVED that Board of Adjustment
Application Case No. WA-94-11A, be and hereby is APPROVED.
TYPE OF VARIANCE: A 10' variance to the required 15' sideyard
setback.
PURPOSE: To allow an existing carport to remain. ,
FOR THE FOLLOWING REASONS:
1. Circumstances could be considered unique as the zoning of
this property does not fit with the use of the site nor the
surrounding area. In addition,'the surrounding zoning
classifications allow for side yard setbacks of less than 15
feet. ,
2. The granting of this variance would probably not alter the
essential character of the local neighborhood as the
surrounding zoning allows for side yard setbacks of less
than 15 feet and it seems that the Agricultural-One zoned
properties to the south of the subject site have side yard
setbacks of less than 15 feet.

3. Due to the uniqueness of this request the conditions upon
which this petition for variances are based, would not be
applicable to other property within the same zoning
classification.
4. The purpose of this variance is not based exclusively upon
the desire to make money.
5. The proposed variation will not impair the adequate supply of
light and air to adjacent property or substantially increase
the congestion in the public streets or increase the danger
of fire or endanger the public safety nor will the request
substantially diminish or impair property values within the
neighborhood.
WITH THE FOLLOWING CONDITION:
1. A building permit must be issued and the carport must
meet the building code requirements as of the date of
construction.
VOTE: YES: Abbott, Clark, Hovland and Rossillon
NO: Howard
DISPOSITION: Motion granted by a vote of 4-1.
