CALL THE MEETING TO ORDER: The meeting was called to order by Chair MONTOYA at 7:30 p.m. on October 24,2002 in the city council chambers of the municipal building, 7500 West 29th Avenue, Wheat Ridge, Colorado. 2. ROLL CALL Members Present: Tom Abbott Bob Blair (arrived at 7:55 p.m.) Paul Drda Bill Echelmeyer Paul Hovland Bob Howard Jerry Montoya Members Absent: Kent Young Staff Present: Meredith Reckert, Sr. Planner Mike Pesicka, Planning Tech Ann Lazzeri, Secretary The following is the official set of Board of Adjustment minutes for the Public Hearing of October 24, 2002. A set of these minutes is retained both in the office of the City Clerk and in the Department of Planning and Development of the City of Wheat Ridge. 3. PUBLIC FORUM There was no one signed up to speak. 4. PUBLIC HEARING A. Case No. TUP-02-05: An application filed by Trugreen Landcare for approval of a one-year Temporary Structure Permit to allow an office trailer on property zoned Commercial-Two (C-2) and located at 8935 West 44th Avenue. This case was introduced by Mike Pesicka. He reviewed the staff report, digital presentation and entered all pertinent documents into the record. He advised the Board that all public notice requirements had been met so there was jurisdiction to hear the case. Staff recommended approval of the application for reasons outlined in the staff report. Board Member ECHELMEYER commented that he did not see a public hearing notice sign on the property. Board of Adjustment 10/24/02 Page 1 Jeff Miller Branch Manager, Trugreen Landcare Mr. Miller was sworn in by Chair MONTOYA. He stated his company had need for the trailer to house a temporary office until such time as they can take over the lease for the building which presently houses Pumps, Inc. This should happen within the next two years. In reply to a question from Board Member ECHELMEYER, Mr. Miller stated that he had given direction to an employee to post the public hearing notice sign but had not been on site personally to observe the sign. In reply to a question from Board Member HOWARD, Mr. Miller stated that the trailer has been on the property for 2-3 months. Board Member HOVLAND clarified to the applicant that a TUP can only be issued for one year. Chair MONTOYA asked if there were others who wished to address this matter. There was no response and the public hearing was closed. Because Board Member BLAIR arrived at the meeting after the presentation was made, he agreed to abstain from voting on this matter. There was discussion concerning the posting of the property. Board Member ECHELMEYER stated that he walked around the property and could find no evidence of a sign. Meredith Reckert stated that the posting certificate had not been returned to the city. It was moved by Board Member ECHELMEYER and seconded by Board Member DRDA to continue Case No. TUP-02-05 to the Board meeting of December 4, 2002 because it is impossible to determine if the area has actually been posted for the required fifteen days. The property is required to be posted prior to the December 4th hearing according to the rules and regulations governing the City of Wheat Ridge. The motion passed 6-0 with Board Member BLAIR abstaining and Board Member YOUNG absent. 5. CLOSE THE PUBLIC HEARING Chair MONTOYA declared the public hearing closed. 6. OLD BUSINESS Board Member HOVLAND inquired about the status of Case No. WA-02-09. Mike Pesicka stated the city has given notice to the applicant that they have thirty days to Board of Adjustment 10/24/02 Page 2 remove the deck. 7. NEW BUSINESS Election of Officers - Meredith Reckert reminded members of the Board that elections of officers should take place at the next meeting. Minutes of September 26, 2002 - It was moved by Board Member HOWARD and seconded by Board Member HOVLAND to approve the minutes of September 26, 2002. The motion passed unanimously. 8. ADJOURNMENT It was moved by Board Member HOWARD and seconded by Board Member BLAIR to adjourn the meeting at 8:08 p.m. The motion passed 7-0. ::Lot:.
