CITY OF WHEAT RIDGE, COLORADO
October 14, 1991
The Liquor Authority Meeting in the matter of the alleged violation on
"Happy Liquors", 4141 Kipling Street, was called to order by the Mayor
at 6:30 p.m. Councilmembers present: Kent Davis, Tony Flasoo, Bill
Shanley, Don Eafanti, Ron Selstad, Phil Edwards, and Elise Brougham.
Larry Merkl arrived at 7:20 p.m. Also present: City Clerk, Wanda Sang;
City Attorney, John Hayes; Chief of Police, Jack Hurst; Police Officer,
Steve Berkowitz.
Alleged violation under Section 12-47-128 (1)(a) of the Colorado Liquor
Regulations.
Binh Thanh Ho, owner of "Happy Liquors" was present and asked by the
City Attorney if he was ready to proceed with this hearing. He replied
yes. Mr. Ho stated that he did not have an attorney. John Hayes
explained that the procedure would be that Officer Berkowitz would give
testimony, then witnesses would be heard, Mr. Ho may ask questions of
any of those people, and he may call witnesses. Mr. Ho accepted this
procedure.
Officer Berkowitz identified the witnesses as Kevin Smith, Julie Cash,
and Gary Guerra.
Officer Berkowitz presented the case as described in the attached police
report.
Kevin Smith, 4963 Franklin Drive, Gary Guerra, 2415 King Street, and
Julie Cash, 6333 Zang Court, were sworn in by the Mayor and answered
Officer Berkowitz, Mr. Ho and City Council members' questions.
Messrs. Thich Minh Chau, Minn Ho, and Binh Thanh Ho, 183 S. Dale Court,
were sworn in by the Mayor and gave their testimony. They were then
questioned by members of City Council.
Motion by Mr. Selstad that the Authority determined that a violation of
Section 12-47-128 (1)(a) did occur, regarding sale to minors. That the
liqour license be revoked for 15 days and suspend 5 of those days and
that this period start from 8:30 a.m, on October 16th and go through
October 26th; seconded by Mr. Eafanti; passsed 7-0, with Mr. Merkl
abstaining bec use he had not been present during the testimony.
