CITY OF WHEAT RIDGE COLORADO
August 24, 1992
The Liquor Authority Meeting in the matter of the show cause hearing for
Valley Liquors was called to order by chairman Winger at 6:30 p.m.
Liquor Authority members present: Vance Edwards, Ron Selstad, Elise
Brougham, Donald Eafanti, Kent Davis, Tony Flasco, Phil Edwards and Bill
Shanley. Also present: City Clerk, Wanda Sang; City Attorney, John
Hayes; City Administrator, Robert Middaugh.
David Digiacomo, 5460 Ward Road, attorney for Valley Liquors, introduced
his clients Thelma and Leroy Cerrone, 4292 Ward Road, who were sworn in
by the chairman.
Mr. Digiacomo stated that his clients admit the violation of selling
malt liquor to a minor.
Mr. Digiacomo explained that fair. Cerrone has held the license for 5
1/2 years and had never had a liquor violation until now. Mrs. Cerrone
is the one who sold the beer to the minor. The Cerrones are extremely
careful about selling to minors, have signs posted all over the place,
and check I.D.'s and do not accept duplicate I.D.'s. They assured the
liquor authority that to the best of their ability it would never happen
again..
Motion by Mr. Davis to retire for a fact finding session; seconded by
Mr. Shanley; carried 8-0.
Motion by Mr. Sel.stad that after fact finding it is the conclusion of
the authority that there has been a violation of C.R.S. 12-47-128, that
we set a 3 day suspension with 1 day to be served and 2 days to be
continued or suspended pending no further violations; those days are to
be a week from today, August 31, September 1 and 2; seconded by Mr.
Davis.
Mr. Digiacomo asked for a fine in lieu of suspension, which in this case
would be the minimum fine of $200.00. Mr. Flasco moved to amend the
motion to accept the fine in lieu of suspension. Mr. Selstad and second
accepted this as a friendly amendment. Motion carried 8-0.
