HomeMy WebLinkAbout12/09/1999LIQUOR LICENSING AUTHORITY MINUTES CITY OF WHEAT RIDGE, COLORADO 7500 W. 29th Avenue, Municipal Building December 9. 1999 The Liquor Authority Meeting was called to order by Chairman Wilde at 9.00 am Liquor Authority Members present: Dan Wilde, Harry Williams, Frank Sanzalone, Kent Davis, George Langdon, Rocco Gioso, Judith DiCroce and Laura Leprino Also present: Deputy City Clerk, Christa Jones, City Attorney, Gerald Dahl, Chief of Police, Jack Hurst. APPROVAL OF MINUTES OF November 18, 1999 Motion by Mr Gioso for the approval of the Minutes of November 18, 1999, seconded by Mr Davis, carried 7 in favor with Mr Langdon abstaining Item 1. Transfer of Ownership for Old Prospectors Liquors, 5012 Kipling Street, Wheat Ridge Christa Jones presented the staff report. Applicant Yung Ik Kim was sworn in by the Chair Also present was his attorney, Carl Rehm They answered the Authority's questions and asked for approval of the license They stated that Mr Kim has sold his other liquor store and has no financial interest in it. Motion by Mr Davis to approve the Transfer of Ownership from Old Prospectors Liquor Ltd , dba "Old Prospectors Liquors", 5012 Kipling Street, Wheat Ridge, Colorado, to Yung Ik Kim for the following reasons 1 All applications and fees required by statute have been filed and paid, 2 The applicant will be entitled to occupancy of the premises by virtue of a signed lease assignment dated October 28, 1999, 3 The applicant has been cleared by the Police Department; seconded by Mr Sanzalone, carried 8-0 LIQUOR LICENSING AUTHORITY MINUTES December 9, 1999 Page - 2 - Item 2. Transfer of Ownership for El Mexicano Parilla Bar, 4105 Wadsworth Blvd , Wheat Ridge Christa Jones presented the staff report. Thomas Dunn, attorney for Aurelio Padilla was present. Mr Padilla was sworn in by the Chair Mr Dunn explained that his client has some difficulty with the written English language The forms were filled out by Karen Marquez, who is an accountant. She would read the questions and Mr Padilla would answer His answer regarding liquor violations pertained to selling to minors, visibly intoxicated persons, etc. He forgot about the violation regarding the reporting of change of corporate structure It was only an oversight, there was no intent to mislead or to deceive Mr Dunn pointed out some other discrepancies in the application that were answered in error by the accountant. He also stated that there would be no dancing and no bands, only a juke box. City Attorney Dahl explained that in the event this transfer would not be approved today, the Authority needed to set a hearing date for the formal hearing of transfer of ownership and to post the property and formerly notify the applicant. In the case of an approval, this matter could be concluded today The applicant then answered the Authority's questions Motion by Mrs DiCroce to set a formal hearing for Transfer of ownership for the following reasons false information regarding the liquor license suspension, false information regarding the DUI, incomplete answers on the background information, specifically No 46 and the professional references, no social security number on one form, mistake as to marking one form yes to dancing, another form no to dancing She would be more comfortable to set another hearing when all of these items can be straightened out; seconded by Mr Davis, carried 6-2 with Mr Wilde and Mr Gioso voting no Motion by Mr Davis to set the date for the formal hearing for Thursday, December 23, 1999 at 9 00 a.m , seconded by Mrs Leprino, carried 8-0 Item 3. Transfer of Ownership for La Scala Ristorante, 10151 West 26th Avenue, Wheat Ridge Christa Jones presented the staff report. Margarita, Octavio and Hector Granados were sworn in by the Chair Margarita Granados explained that she is the wife of Octavio and is not on the application for the liquor license, but she filled out the application for her husband LIQUOR LICENSING AUTHORITY MINUTES December 9, 1999 Page -3 - She stated that he had a DUI 13 or 14 years ago, but his license was not suspended When she answered "no" to the violation question she was not trying to hide anything, it was an oversight. Her husband is a person of high moral character; they have 2 liquor licenses in Denver and have never had any problems whatsoever Chief Hurst stated that he believes this was an honest mistake, but he felt obligated to bring the mistake to the attention of the Authority Motion by Mr Davis to approve the Transfer of ownership from BEK, LLC, 10151 West 26th Avenue, Wheat Ridge, Colorado, to H O G G Inc., for the following reasons 1 All applications and fees required by statute have been filed and paid, 2 The applicant will be entitled to occupancy of the premises by virtue of a signed lease assignment dated November 8, 1999, seconded by Mr Gioso, carried 8-0 Item 4. Renewal Hearing for Pink Cadillac Saloon, 12100 West 44th Avenue, Wheat Ridge City Attorney Dahl stated that he and the attorney for Dennis Clifton had worked out a stipulation for conditional renewal of the liquor license which stipulates that the licensee shall negotiate and complete the sale of the licensed premises within 90 days of license renewal If this is not accomplished within 90 days, licensee will surrender the license This is subject to approval by the Liquor Authority Dennis Clifton, 5420 Nolan, Arvada, was sworn in by the Chair He stated he wants to be out of the liquor business, he has had a problem with finding competent employees and doesn't want to spend all of his time in the bar He just needs time to get the business sold He is in full agreement with the stipulation He has three potential buyers at this time Motion by Mr Davis that we accept the stipulation between the City of Wheat Ridge and DBN Inc, 12100 West 44th Avenue, and renew the liquor license on a temporary basis as stipulated, seconded by Mr Wilde, carried 7-1 with Mrs DiCroce voting No She stated that she really has a problem with this because Pink Cadillac has had 4 warning letters within the last year, 1 suspension, numerous other reports from the Police Department.
