HomeMy WebLinkAbout05/26/2005MINUTES FOR LIQUOR AUTHORITY MEETING CITY OF WHEAT RIDGE, COLORADO 7500 West 29th Avenue, Municipal Building May 26, 2005 Liquor Authority Member Kent Davis called the Meeting of May 26, 2005 to order at 9.00 a m Liquor Authority Members present: Frank Sanzalone, Kent Davis, John Miks, Judith DiCroce, and Lloyd Donnelly Brenda Locricchio, Anthony Davia and Robert Alldredge were absent. Also present: Deputy City Clerk, Christa Jones APPROVAL OF MINUTES OF May 12, 2005 Motion by Mr Miks for the approval of the Minutes of May 12, 2005, seconded by Mr Sanzalone, carried 5-0 Item 1. Public Hearing on Application for a new Retail Liquor Store License for West 44th Retail, LLC , d b a. "West 44th Liquors", 6690 West 44th Avenue, Wheat Ridge Item 1 was introduced by Mr Davis Christa Jones presented the staff report. Applicant Haimaniot Embaye was present and stated she had 7 years experience working in a liquor store Also present was James Beimfort, attorney for the applicant. Tina Scott from Oedipus, Inc gave testimony as to the way the neighborhood survey was conducted Speaking in opposition to the granting of a new Retail Liquor Store License were Scott Madsen, 3105 Ingalls Court, current owner of Lakeside Liquors, strongly opposed the license There are 8 retail liquor stores in a 2-mile radius of this location Sts Peter and Paul school is nearby; it might hurt business at Club Corner, directly across the street. He read a letter of opposition from Dorothy Larson, 4090 Pierce Street, who was not able to attend this meeting Mr Beimfort objected to a letter being read from somebody who was not present at the meeting Chair Davis allowed the reading of the letter LIQUOR MINUTES May 26, 2005 Page -2- Elizabeth Samples, barbershop owner, stated that she had signed the survey in favor of the retail liquor store, but wished she had not done that. She had been very busy and preoccupied when she signed and was actually against the license She wants her name off the petition We don't need another liquor store Evelyn Gleason, 4595 Newland Street, believes there are enough liquor stores already in the area. She does not drink, but is not opposed to drinking Lenn Hardy, 4210 Newland Street, is opposed to another liquor store He does not drink alcohol He complained about the traffic caused by Club Corner Molly Zeman, 3535 Urban Ct., does not live in the 1-mile radius area, but her children go to Sts Peter and Paul school She is also a Realtor and questioned what this would do to property values Her husband Matt Zeman wrote a letter in opposition, citing too many stores already She does drink alcohol Attorney Beimfort objected to a witness who did not live in the 1-mile radius Mayna Nguyen, recently purchased Wilmore Liquors at 7700 W 38th Avenue, and is opposed to another Retail Liquor Store coming in Motion by Mr Donnelly to approve the application for a new Retail Liquor Store License for West 44th Retail, LLC , d b a "West 44th Liquors", 6690 West 44th Avenue, Wheat Ridge, Colorado, for the following reasons (1) All applications and fees required by statute have been filed and paid (2) Notice of hearing and posting of the premises have been accomplished according to statutory requirements (3) The applicant is entitled to occupancy of the premises by virtue of a lease, dated February 28, 2005 (4) The applicant has been cleared by the Police Department. (5) The evidence adduced at the Public Hearing on May 26 established that the desires of the residents of the neighborhood under consideration are for granting this license, as evidenced by petitions bearing 109 signatures favoring issuance and 32 signatures opposing issuance, and that issuance of this license is consistent with the needs of the neighborhood under consideration LIQUOR MINUTES May 26, 2005 Page -3- WITH THE FOLLOWING CONDITIONS 1) That the State and City licenses not be handed over to the applicant until the building has been re-inspected and a Certificate of Occupancy has been issued 2) That the applicant attend the Retail Liquor Store class offered by the Police Department. seconded by Mr Sanzalone, carried 3-2 with Mrs DiCroce and Mr Miks voting no Mrs DiCroce feels there are enough liquor stores on 44th Avenue Item 2. Application for Transfer of Ownership for Wheat Ridge Liquors, 5806 W 38th Avenue, Wheat Ridge Item 2 was introduced by Mr Davis Christa Jones presented the staff report. Applicant Mike Gauthier, 7494 Braun Way, Arvada, was present and asked for approval of his application He has worked for his brother's liquor store in Arvada, as well as part time at Wheat RidgeLiquors Motion by Mrs DiCroce to approve the Transfer of Ownership from Karen and Alan, Inc., d b a "Wheat Ridge Liquors", to MPG, Inc, d b a "Wheat Ridge Liquors", 5806 W 38th Ave , Wheat Ridge, for the following reasons 1 All applications and fees required by statute have been filed and paid 2 The applicants will be entitled to occupancy of the premises by virtue of a signed lease dated May 1, 2005 3 The applicants have been cleared by the police department. With the following condition That the applicant attend the Wheat Ridge Police Department liquor class, seconded by Mr Miks, carried 5-0 Item 3. Motion by Mr Miks to accept the Findings for Long Shots Lakeside Liquors Vern's Liquors and authorize the Vice Chair and Deputy City Clerk to sign the findings, seconded by Mr Donnelly; carried 4-0 with Mr Sanzalone abstaining Item 4. Application for Transfer of Ownership for Lakeside Liquors, 5820 W 44th Avenue, Wheat Ridge Item 4 was introduced by Mr Davis Christa Jones presented the staff report. LIQUOR MINUTES May 26, 2005 Page -4- Applicant Roger Loecher, 4599 Carr Street, Wheat Ridge, asked for approval of his application Motion by Mr Miks to approve the Transfer of Ownership from Scott Madsen, d b a "Lakeside Liquors", to Roger/Dodger LLC , d b a "Lakeside Liquors", 5820 W 44th Ave , Wheat Ridge, for the following reasons 4 All applications and fees required by statute have been filed and paid 5 The applicant will be entitled to occupancy of the premises by virtue of a signed lease dated May 5, 2005 6 The applicant has been cleared by the police department.
