This letter is in regard to your request for a zoning and structure confirmation for property located at
3219 Benton Street in the City of Wheat Ridge.
The property in question is zoned Residential -One C (R -1Q. The RAC zone district is a single family
zone district with a minimum lot size of 5000 square feet with a minimum lot width of 50'.
The property was subdivided into two parcels pursuant to Case No. MS -13-07 on December 19, 2013.
A condition of approval of the subdivision was that an existing garage on the southern property be
demolished. The garage was taken down and a new garage was built in generally the same location in
2014.
The required rear setback in the R-1 C zone district is 5'. The proposed location of the garage
encroaches into a 10' wide drainage and utility easement that runs along the rear property line. When
a property is subdivided, it is standard that utility easements are located along all four sides of the
property perimeter. However, because this is an infill situation with existing overhead utilities and not
a new neighborhood being built, it is highly unlikely that there are any utilities in the easement and
doubtful that any of the utility companies would require this rear easement to run new utility lines.
Therefore, while there is an encroachment into an easement on the rear, the garage setback is
compliant with zoning and will be considered legally conforming. The garage can remain at its
location in perpetuity until such time that it is voluntarily removed or if more than 50% of the structure
is destroyed.
