COMMISSIONER'S DEED OF WATER STOCK
THIS INDENTURE is made this 27th day of October ,1993,
between the County of Jefferson, State of Colorado, a body
politic and corporate, (the "County"), whose legal address is 100
Jefferson County Parkway, Golden, Colorado 80419, acting by and
through its duly constituted and appointed Commissioner, John P.
Stone, to convey and to execute this deed, and the City of Wheat f .1
Ridge, State of Colorado, a municipal corporation ("Wheat ./d
Ridge"), whose legal address is 7500 West 29th Avenue, Wheat
Ridge, Colorado 80033.
WITNESSETH
WHEREAS, the Board of County Commissioners of the County of
Jefferson, State of Colorado, did at a regular meeting of said
Board held on the 16th day of December, 1991, duly adopt and pass
Resolution No. CC91-831 authorizing the conveyance of certain
real property to Wheat Ridge and did by said Resolution appoint
and constitute the undersigned as Commissioner to convey and
execute a Commissioner's Deed for said real property to Wheat
Ridge for and on behalf of the said County of Jefferson, State of
Colorado, a body politic and corporate, and did further authorize
the undersigned to execute such Commissioner's Deed and to affix
the seal of said County thereto; and
WHEREAS, a Commissioner's Deed conveying said real property
to Wheat Ridge was executed by the undersigned as Commissioner on
January 2, 1992 and recorded in the Office of the Clerk and
Recorder of Jefferson County, Colorado on January 6, 1992 at
Reception No. 92001254; and
WHEREAS, in connection with such conveyance of said real
property to Wheat Ridge, it was the intent of the parties to
convey certain water stock associated with said real property to
Wheat Ridge and the parties desire to convey such water stock
pursuant hereto.
NOW, THEREFORE, FOR AND IN CONSIDERATION of the sum of Ten
Dollars ($lO.OO) and other good and valuable consideration, in
hand paid by Wheat Ridge to the County of Jefferson, State of
Colorado, a body politic and corporate, receipt of which is
hereby confessed and acknowledged, the undersigned, acting as
Commissioner aforesaid, does by these presents remise, release,
sell, convey, and quit claim unto Wheat Ridge, its successors and
assigns for so long as the real property described in the
aforesaid Commissioner's Deed is used exclusively for public open
space, park and recreational purposes and no longer, all the
right, title, interest, claim and demand which said Jefferson
County, State of Colorado, a body politic and corporate, has in
and to the following:
Five (5) shares of the Capital Stock of The
Consolidated Mutual Water Company,
represented by Certificate No. 66746, a copy
of which is attached hereto as Exhibit A and
inc~rporated herein by this reference;
subJect to assessments thereon for the years
1992 and thereafter.

the appurtenances and prlvlleges thereunto belonging or in any
~ay thereunto appertaining, and all the estate, right, title,
lnterest and claim whatsoever of said Jefferson County, State of

the appurtenances and privileges thereunto belonging or in any
way thereunto appertaining, and all the estate, right, title,
interest and claim whatsoever of said Jefferson County, State of
Colorado, either in law or equity, to the only proper use,
benefit and behoof of Wheat Ridge, its successors and assigns;
provided that if Wheat Ridge shall use the real property
described in the aforesaid Commissioner's Deed for any purpose
other than public open space, park and recreational purposes,
said water stock shall revert to the County and this deed shall
be null and void.
