HomeMy WebLinkAboutResolution 02-2020 V Hearings WHEAT RIDGE LIQUOR LICENSING AUTHORITY CITY OF WHEAT RIDGE, COLORADO RESOLUTION NO. 02-2020 TITLE: A RESOLUTION OF THE WHEAT RIDGE LIQUOR LICENSING AUTHORITY REQUIRING QUASI-JUDICIAL PUBLIC HEARINGS REGARDING ALLEGED VIOLATIONS OF APPLICABLE LIQUOR LAWS TO BE CONDUCTED VIA A REMOTE PARTICIPATION PLATFORM WHEREAS, on March 10, 2020, the Governor of the State of Colorado declared a statewide state of emergency in response to the coronavirus (COVID-19) pandemic; WHEREAS, on March 14, 2020, the President of the United States declared a national emergency in response to the coronavirus (COVID-19) pandemic; WHEREAS, on March 20, 2020, the Wheat Ridge City Council (City Council) declared a local emergency in response to the coronavirus (COVID-19) pandemic; WHEREAS, C.R.S. § 44-3-601, et. seq., conveys to local liquor licensing authorities the power to adjudicate at a public hearing alleged violations of applicable liquor laws and to issue an appropriate sanction where such a violation is found (“Show Cause Hearings”); WHEREAS, Chapter 11 of the Wheat Ridge City Code established the Wheat Ridge Liquor Licensing Authority (City’s Liquor Board) and conveyed to it the authority to adjudicate Show Cause Hearings, suspend or revoke liquor licenses for cause, and promulgate reasonable rules and regulations regarding same, among other responsibilities related to the sale of liquor in the City of Wheat Ridge (City); WHEREAS, due to the length of the coronavirus (COVID-19) pandemic and the duty to promptly hear and adjudicate alleged violations of applicable laws, the City’s Liquor Board finds that it is in the best interests of the City to require Show Cause Hearings to be conducted via a remote participation platform, such as, but not limited to, Zoom, WebEx, or other similar remote meeting technology. NOW, THEREFORE, BE IT RESOLVED by the Wheat Ridge Liquor Licensing Authority, that: Section 1: During declared emergencies, the City’s Liquor Board requires all quasi- judicial public hearings related to any alleged violation of any applicable liquor law to be conducted via a remote participation platform. Section 2: This Resolution shall become effective upon adoption.
