This meeting was held virtually with no board members or staff present in person, in the
city council chambers.
Chair Germano called the Liquor Authority Meeting to order at 9:05 a.m.

APPROVAL OF MINUTES OF August 13, 2020 Motion by Member Peterson to approve the minutes of August 13, 2020; seconded by
Member McIntyre; Motion carried 5-1, with Member Nazarenus abstaining.

Hearing for a new Fermented Malt Beverage (Beer) Off-Premises Liquor License – Kum
& Go LC. dba Kum & Go #2310, located at 3432 Clear Creek Drive, Wheat Ridge, CO
80401
Chair Germano opened the public hearing
Deputy City Clerk Eaton gave the initial findings for the staff report and entered Exhibits
1-6 into the record, showing the applicant has fulfilled all of the requirements to hold a fermented malt beverage liquor license. He explained that Kum and Go LC is a nationwide chain of convenience stores that sell Fermented Malt Beverage (FMB) at many Colorado locations and is now desirous to sell beer at their new location in Wheat Ridge. Mr. Mike Fix for the applicants has agreed to the virtual hearing.
He also explained that the applicant had requested concurrent review with the State. Chair Germano swore in the company representative Mike Fix.
Mr. Fix offered testimony as to why this application should be approved, gave detailed
insights to what the company was all about as well as to the new facility itself. He
added that he was available to help answer any questions that the board may have.
Chair Germano asked for discussion on the item.
Questions were asked as to where the facility was actually located and to what types of
facilities the establishment will have onsite.
Motion by Member Peterson to approve the issuance of a new Retail Fermented Malt Beverage License for Kum & Go LC. dba Kum & Go #2310, located at 3432 Clear Creek Drive, Wheat Ridge, CO 80401 on the basis of the following findings:
1. Public Notice of the hearing on the Application was published and posted on the
property as required by Colorado law;
2. The applicant is qualified to obtain a liquor license pursuant to C.R.S. Section 44-3-307;
3. The premises are in a location eligible to conduct the proposed liquor licensed
business pursuant to C.R.S. Section 44-3-313 and the zoning laws of the City;
4. The applicant is entitled to possession of the premises for which the application is made;
5. The neighborhood under consideration is considered to be within a one-half mile circumference around the proposed licensed premises;
6. The inhabitants of the neighborhood desire an additional establishment that
serves liquor;
7. The needs of the neighborhood are not met by the existing outlets.
There was no additional discussion or further questions.
Seconded by Member Ortiz, motion carried 6-0

Attorney Joe Rivera spoke about the still unheard liquor hearing for dba Rambling
Rose. He will try to work with the licensee and report back on findings for a hearing at a later date, possibly to be held on November 12. POLICE DEPARTMENT MATTERS – none
