TOGETHER WITH all and singular the hereditaments and appurtenances thereto
belonging, or in anywise appertaining, and the reversion and reversions, remainder and
remainders, rents, issues and profits hereof, and all the estate, right, title, interest, claim, and
demand whatsoever of Grantor, either in law or equity, of, in and to the above-bargained
premises, with the hereditaments and appurtenances.
TO HAVE AND TO HOLD the said premises above bargained and described with the
appurtenances, unto Grantee, its successors and assigns, for so long as all of the said property
shall remain within the Jefferson County boundaries. is used by a public entity for public open
space, park or recreational purposes, and all Jefferson County residents are charged the same
user fee which the Grantee may from tune to tune impose for the use of the property or any
improvements thereon and no longer, and if at any time any portion of the said property is not
so situated or utilized, then title to all of the said property shall automatically vest in the
County of Jefferson, State of Colorado, a body politic and corporate. Grantor, for itself and
Its successors and assigns, states that at the time of ensealing and delivery of these presents, it
is well seized of the premises above conveyed, has good, sure, perfect, absolute and
indefeasible estate of inheritance, in law, in fee simple, and has good right. full power and
authority to grant. bargain, sell and convey the same in manner and fonn as aforesaid, and that
the same are free and clear from all fanner and other grants, bargains, sales, liens, taxes,
assessments, encumbrances and restrictions of whatever kind or nature soever, except taxes
and assessments for the year 2000 and subsequent years, a lien not yet due and payable, and
except for those additional matters set forth on Exhibit B attached hereto and made a part
hereof;
The grantor shall and will warrant and forever defend the above-bargained premises in
the quiet and peaceable possession of the grantee, hiS heirs and assigns, against all and every
person or persons lawfully claiming the whole or any part thereof. The singular number shall
