REQUEST: Rezoning from Commercial-One to Planned Commercial Development, outline plan
approval and final development plan approval with a variance.
WHEREAS, the City of Wheat Ridge Planning Division has submitted a list of factors to be considered
with the above request, and said list of factors is attached hereto and incorporated herein by reference,
and made a part hereof; and
WHEREAS, there was testimony received at a public hearing by the Planning Commission and such
testimony provided additional facts.
NOW, THEREFORE, based upon the facts presented and conclusions reached, the following motions
were made:

It was moved by Commissioner SNOW, seconded by Commissioner THOMPSON, that Case No. WZ-
97-5, a requestfar approval of rezoning from Commercial-One to Planned Commercial Development
and for approval of an outline development plan for property located at 9500 West 49th Avenue be
Denied for the following reasons:
VOTE: YES: 3
NO: 5 (Commissioners RASPLICKA, CERVENY, BRINKMAN, GRIFFITH,
and WILLIAMS.)

It was moved by Commissioner BRINKMAN, seconded by Commissioner CERVENY, that Case No.
WZ-97-5, a request for approval of an outline and final development plan for property located at 9500
West 49th Avenue be Approved for the following reasons:
I A rezoning is required to expand allowed uses as recommended by Staff which would allow a
land use transition.
2. All requirements for a PCD outline development plan have been met.
With the following conditions:
VOTE: YES: 5
NO: 3 (Commissioners SNOW, THOMPSON, and SHOCKLEY.)
It was moved by Commissioner THOMPSON, seconded by Commissioner CERVENY, that Case No.
WZ-97-5, a request for approval of a five foot setback variance for property located at 9500 West 49th
Avenue be Approved for the following reasons:
With the following conditions:
I . Landscaping be installed around the base of the sign.
2. No other freestanding sights be allowed on the property.
