This meeting was held in person, in the city council chambers located at 7500 W. 29th
Avenue, Wheat Ridge Colorado 80033.
Chair DiTullio called the Liquor Authority Meeting to order at 9:00 a.m.
Liquor Authority Members present: Rocco Germano, Cynthia Shaw, Jerry DiTullio, Juanita Stites, Morgan Richards (arrived late), Lenny Ortiz,
Absent: Edward Volk, , Michael Betterton Also present: City Clerk, Steve Kirkpatrick; Deputy City Clerk, Robin Eaton; Assistant City Attorney, Joe Rivera; WRPD Detective Charles Hemings; Mestizo Brewing LLC
Members Ryan Piec and Ian Hunt APPROVAL OF MINUTES OF August 26, 2021 Chair DiTullio motioned for a correction of the minutes of August 26, 2021 to include the
motion by Member Richards which was not heard for a lack of a second along with reported future such motions, seconded by Member Germano, motion carried 5-0. With no other changes to the minutes, they will stand as amended.

Chair DiTullio opened the public hearing and introduced Item 1.
Application for a new Brewpub Liquor License – Mestizo Brewing LLC., dba Mestizo
Brew Cantina located at 6800 W. 38th Ave, Wheat Ridge, CO 80033 Staff Report
Deputy City Clerk Eaton reported that the applicants have not yet received their basic
brewers notice from the ATF&E and asked for a continuance of the hearing until October 28. Motion by Member Stites to continue the hearing for Mestizo Brew Cantina to October
28, 2021, seconded by Member Germano, motion carried 5-0

Chair DiTullio introduced Item 2.
Review the La Fonda Findings and Order for Show Cause Hearing for Padilla Juana
Padilla Alejandro Partnership dba La Fonda Mexican Restaurant (Licensee) 5750 W.
38th Avenue, Wheat Ridge, Colorado 80212
Staff Report
Assistant City Attorney Joe Rivera briefly reviewed the process of the 3-step show
cause hearing process and asked if the board were to approve it by the suggested
motion.
There were no questions from the board
Motion by Member Shaw to approve and adopt the Findings and Order on Show Cause
Hearing for Padilla Juana Padilla Alejandro Partnership dba La Fonda Mexican
Restaurant, seconded by Member Ortiz, motion carried 5-0
Item 3
Chair DiTullio introduced Item 3.
Review Draft Resolution for Alcohol Beverage Permitting process
Staff Report
Assistant City Attorney Joe Rivera spoke that while reviewing the information on the
festival resolution, he thinks there are several important questions he feels are left un-
addressed.
He spoke on several items, including:
• New festival permit allows for new floating liquor license to occur in the State.
• Comments from City Manager Mr. Goff.
He asked for guidance on the following questions:
1. Should local Festival permits be limited to persons holding a valid City of Wheat
Ridge liquor license? No
2. Should the number of licensees permitted to participate in/sponsor a Festival be
limited?
3. If so, how?
4. Should the number of Festivals permitted be limited to a number less than nine
(9)?
5. Should Festival sponsors be required to obtain a local permit for each Festival?
6. Which food service requirements apply to the Festival?
7. What is the process to approve a Festival permit?
8. Should the Festival permit require adherence to the City’s special events process
and standards?
Deputy Clerk Eaton interjected that there is some discrepancy whether the city Parks &
Recreation (P&R) rules have jurisdiction when these permits are applied for on private
property areas. Also there have been numerous liquor violation on previous events
approved for by the P&R division" Do they know what liquor laws to follow and enforce?
Discussion and comments from the Board included the following items:
• The Board has made it clear that there is to be a festival permit application that
needs to have board approval.
• Who will come up with the forms to apply for a festival permit.
City Clerk Kirkpatrick pointed out that the term liquor license should not be used, more
that the term festival permit should be utilized as it is not a permanent license to sell
liquor.
Motion by Chair DiTullio that there be a requirement for a festival permit to be issued
from the City of Wheat Ridge, seconded by Member Germano, motion carried 5-0
For the record, Member Richards arrived at 9:29AM
Discussion and comments continued to include:
• Using the P&R special event permit application packet, administered by that
department
• Can P&R rules and regulations be adhered to on private property
• The City Clerk’s office needs to be notified immediately where events with
alcohol are applied for
• Can electronic applications and signatures be available on-line
• Call together a city working group
• Security plan signed off on by WRPD
• Posting and publishing’s for the events be required
• Decide what would be the food requirements for the festival
Motion by Member Germano to send the discussion items to a work committee, created
by the City Clerk to include the Deputy Clerk, to come back with a process for the board
to review and possible revise, seconded by Member Shaw, motion carried 5-0
CITY CLERK’S MATTERS Deputy Clerk relayed that the City has received 4 applications for transfer and new
licenses, one for Denver Pizza just west of King soopers on 38th. Modification in-coming for Audacity Lounge on 38th and High st. CITY ATTORNEY’S MATTERS - none POLICE DEPARTMENT MATTERS - none
