AGREEMENT JirfcRSON COUNTY, COLORADO
THIS AGREEMENT is entered into this 'of ) )it»�Et 1983, between the
City of Wheat Ridge, a Municipal Corporation, hereinafter referred to as City,
and Jefferson B. Armstrong , hereinafter referred to as Owner,
and concerns property located at 10700 W. 49th Place

W I T N E S S E T H
WHEREAS, Owner is the titled Owner of a tract of land in the City of Wheat Ridge,
County of Jefferson, State of Colorado, more fully described in Exhibit A, which
is attached hereto and expressly made a part hereof (which property is hereinafter
referred to as "the Property "); and
WHEREAS, the Owner has submitted an amended Final Industrial Development Plan,
known as L & K Industrial Park - Amendment 3, for administrative approval and
filing; and
WHEREAS, such amended plan does meet the criteria established by the Zoning
Ordinance, Section 21.K, a thru f, for administrative approval by the Director
of Community Development; and
WHEREAS, there are certain site development and street improvement aspects of
the plan which are not clearly defined in the plan, specifically which relate
to a) street related improvements, b) parking requirements, c) landscaping
requirements, and d) access to West 50th Ave.; and
WHEREAS, it is necessary prior to final approval and recording of this amended
plan to specify the terms, conditions, and restrictions under which development
may be permitted in accordance with the approved amended plan;
NOW, THEREFORE, IT IS AGREED THAT:
1. The responsibility for meeting, conforming to and providing those requirements
as set out both in the amended plan and as enumerated below is hereby recognized
by the Owner.
2. The Owner will construct and develop all parking areas and spaces, and will
develop all required landscaping necessary for and related to the two one -story
buildings which are expected to be constructed first, known as Warehouses
(A) and (B), Phase II, Stage I. All parking lot improvements and landscaping
within those areas illustrated in Exhibit B shall be required with building
permits for either such building.
3. The Owner will construct a paved access drive of at least 24 feet in width
and of the same standard as standard parking lot pavement, between the east
edge of parking lot improvements related to Warehouses (A) and (B) and the
curb cut on the south side of West 50th Ave., located approximately 600 feet
west of Miller Street. Said access drive shall serve as temporary access to
West 50th Avenue.
4. The Owner will construct that portion of Oak Street dedicated south of West
50th Ave. to full City standards, including, but not limited to street
pavement, curb, gutter, and sidewalk. Plan and profile of such improvements
shall be submitted with the first building permit requested for either
Warehouse (A) or (B) and construction of same shall be accomplished prior to
request for Certificate of Occupancy for either said Warehouse.
5. Any street construction south of that portion of dedicated Oak Street shall
conform to the City standards for any particular improvements made. (i.e.
street pavement and base shall conform to City standards regarding thickness
and compaction so that any future public street could utilize existing
pavement.) The City will work with the Owner of said parcel to obtain
dedication for a public street.
6. The Owner shall construct the south half of West 50th Avenue,including, but
not limited to street pavement, curb, gutter, and sidewalk, when either of
the following events occur:
A. The owner of property to the north constructs the north half of
West 50th Ave. ; or
B. With construction of any buildings on the Owner's property in excess
of Warehouse (A) or (B).

7. This AGREEMENT is executed by the Owner and shall be binding upon the Owner
and upon the assigns and successors thereof; and shall constitute covenants
running with the Property.
8. This AGREEMENT shall be recorded with the Clerk and Recorder of Jefferson
County, Colorado, and shall constitute a continuing covenant running with
the land; provided, however, that this AGREEMENT shall be released by the
City upon the completion by the Owner of the improvements described herein,
which release shall be evidenced by a signed document, attested to by the
City Clerk and bearing the City's seal, which document shall likewise be
recorded.
