The meeting was called to order by Chair BRINKMAN at 7:01 p.m. in the City Council
Chambers of the Municipal Building, 7500 West 29"' Avenue, Wheat Ridge, Colorado,

APPROVAL OF MINUTES — March 20, 2014
It was moved by Commissioner OHM and seconded by Commissioner DORSEY to
approve the minutes of March 20, 2014, as written. Motion carried 5-0 with
Commissioner WEAVER abstaining.

A. Case No. ZOA-14-01: An ordinance amending Chapter 26 concerning the
Subdivision Regulations and making certain related amendments to chapters 2 and 5 in
association herewith.
Ms. Mikulak presented the case. She entered into the record the case file, the draft
ordinance and the digital presentation. She stated the public noticing requirements for the
hearing have been met.
She stated a subdivision does not change the entitlements for a piece of property nor does
it change the permitted uses, but it is an important document as it prepares land for
development. A subdivision creates a record of land establishing property lines and
easements. The city uses subdivisions to promote orderly development, and positive
improvements like shared access and logical lot layouts.
She stated there are three major amendments including classification of subdivisions,
parkland dedication and public improvements. She reviewed each topic.
Commissioner BUCK NAM asked if there was a method for changing/updating the
measurement for the proposed density multipliers, Ms. Mikulak replied it is based on
census data and census data is updated annually. It has been codified that it will be
updated annually.
Commissioner POPP asked about a previous subdivision case and if public improvements
were triggered for that case. Ms. Mikulak stated it is likely a fee in lieu was paid.
A couple other scenarios were discussed as they related to the proposed code amendment.
Ms. Mikulak stated public improvements are not required for small residential or
commercial additions or accessory structures.
Commissioner POPP asked if there is enough money in the budget for sidewalks, etc. to
be installed throughout the city. Ms. Mikulak replied no.
Ms. Mikulak stated public improvement fees for single and two-family homes are
proposed to be more uniform and based on the frontage length but not the location of the
property.
Commissioner DORSEY observed that the city has inconsistent street improvements. He
stated some neighborhoods have culverts and roadside ditches while others have curb and

Commissioner POPP asked if there are standard fees or contractor quotes for public
improvements, Ms. Mikulak stated the city would establish the fee. The impact fee
study outlines the current prevailing costs for material and these costs would be reviewed
and updated annually.
Commissioner OHM inquired about administrative subdivision review. If the criteria are
not met does it move into the minor category. Ms. Mikulak stated if a plan does not meet
all the subdivision requirements it is including either a waiver or variance which will be
reviewed by Planning Commission and City Council.
Chair BRINKMAN asked if there was any notification to the public for the
administrative plat review procedure. Ms. Mikulak replied no. If an administrative
subdivision plat meets the requirements there is no opportunity to deny due to arl
objection from the neighborhood.
Chair BRINKMAN asked for clarification regarding whether or not Planning
Commission is the final authority for deciding upon a minor subdivision. Ms. Mikulak
confirmed they are but stated that any land use decision can be appealed.
Chair BRINKMAN asked why the term waivers was eliminated from section 26-115.
Ms. Mikulak stated that section of code applies only to variances. Planning Commission
hears variances when it is associated with another land use application but typically
variances are reviewed of as a quantitative request. Waivers are described in the
subdivision regulations and are distinct from variances.
Chair BRINKMAN asked how often the cash in lieu fee schedule will be revisited. Ms.
Mikulak stated it is still being worked on. The fee schedule would be adopted by City
Council by Resolution and the review frequency would be addressed in the first
resolution.
Chair BRINKMAN stated she is concerned about the lack of public input since
subdivision regulations prepare land for development. The neighborhood would be
aware that something is happening.
Commissioner BUCKNAM stated he shared Chair BRINKMAN's concern when a large
parcel of land is eligible for subdivision.

Chair BRINKMAN asked if staff reviews a subdivision with consideration of the
applicant's intent for future development. She provided an example. Ms. Mikulak stated
the intent of the application is reviewed. A subdivision may allow future development,
but there are many existing lots that are eligible for new development and there would be
no requirement for notification of a building permit.
It was moved by Commissioner BUCKNAM and seconded by Commissioner
WEAVER to recommend approval of the proposed ordinance amending Chapter 26
of the Wheat Ridge Code of Laws, concerning the subdivision regulations and
making certain related amendments to chapters 2 and 5 in association herewith.
Commissioner WEAVER agreed that there should be public input but if the zoning
allows a certain type of development then subdivision review should not be used to
disincentivize what is otherwise allowed within the zoning code.

Commissioner BUCKNAM stated he agrees with Commissioner WEAVER, If the
zoning in the particular area is cause for concern, then the zoning merits its own
discussion.
Motion carried 6-0.
Chair BRINKMAN closed the public hearing.
OTHER ITEMS
A. Ms. Mikulak stated a case is scheduled for public hearing on April 17. Chair
BRINKMAN stated she will not be able to attend.
It was moved by Commissioner 1 RSEY and seconded by Commissioner
OHM to adjourn the meeting at 7:55 p.m. Motion carried 6-0.
