DEVELOPMENT AGREEMENT

THIS AGREEMENT, entered into this 23rd day of
October , 1974, between the City of Wheat Ridge,
a Municipal Corporation, hereinafter referred to as City, and
Osmer E. and Dorothy W. Smith, hereinafter referred to as Owners.
WITNESSETH:
WHEREAS, Owners are the titled owners of a tract of land
in the City of Wheat Ridge, County of Jefferson, State of Colorado,
described as follows: 7005 West 32nd Place; and
WHEREAS, the Owners have developed the described land and,
in fact, have applied for a Certificate of Occupancy; and
WHEREAS, the adjacent curb and gutter is incomplete and
will require work and costs to complete; and
WHEREAS, engineering has determined that completion now
is impractical and plans are not adequately complete to enable the
work to proceed; and
WHEREAS, to be consistent with the policy as related to
curb and gutter improvements, this Agreement is hereby determined
as being applicable.
NOW, THEREFORE, BE IT HEREBY AGREED, that
1. Property responsibility for improvement of adjacent
curb and gutter is hereby recognized and affirmed.
2. When neighboring owners install curb and gutter, and
upon the direction of the City, the Owners or their assigns and
successors will adequately provide for the installation of adjacent
curb and gutter.
3. The curb and gutter improvements will be promoted by
the City when it becomes practical to do so.
4. The Owners will, as a condition of receipt of a Cert-
ificate of Occupancy, abide by the applicable conditions of the
Ordinances of the City.
5. The Certificate of Occupancy, applied for, will be
issued if otherwise applicable, upon the execution by the Owners of
this Agreement, and the money now held in escrow by the City ($570.00)
will be returned to Owners forthwith.
6. This Agreement is executed by the Owners pursuant to
the Subdivision Regulations of the City, passed, approved and adopted
February 7, 1972, as amended.
7. The parties hereto agree that this Development Agreement,
by its terms, shall be binding upon the City and the Owners, and upon
the assigns and successors thereof; and shall constitute covenants

running with the described property. This Development Agreement
shall be recorded with the County Clerk and Recorder.
IN WITNESS WHEREOF, the parties have set their hands
and seals on the date first shown.
