Ll\'1'IONS of the CITY OF [mEAT RIDGE, passed, approved and adopted Feb-
ruary 7, 1972, as amended) entered into this 25th ,day of March
19~, between The City of Wheat Ridge, a Municipal Corpo~ation,
hereinafter referred to as Ci ty, and R. H. Jacobson - a Trustee
h~reinafter referred to as ~dner.

[nTNESSETll :
1. WHEREAS, the ~"ner is the titled Owner of a tract of land in the
City of Wheat Ridge, County of Jefferson, State of COlorado, des-
cr.ibed as f0110'-1s:

East 0 of ~ract 21 Brookside Subdivision,
wheat Ridge, Colorado, together with that
portion of the "Resubdi vision of Tract 20,
Brookside" lying west of Quail Street.
2. WffEREAS, the Owner is developing a tract of land as described
in Paragraph No.1, and in fact is being issued the following
permits to do so: and
3. WHEREAS, Street Improvements
fronting 32nd Avenue & Quail Street said tract of land as descr~bearn
Paragraph No.1 and the neighboring tract of land are incomplete and be.7mv

and completion or non-completion of those improvements as requireo

make no significant change at the present in those streets fronting
that tract of land as described in Paragraph No.1, and the neigh~
boring tract of lands; and
5. WHEREAS, in order to conform to those requirem2nts as ~et out in
SECTION POUR: DESIGN STANDARDS and SECTION FIVE: INPROVEI1ENTS of
the SUBDIVISION REGULATIONS this agreement is hAxeby determined
to be applicable.
lIor", THEREFORE, BE IT HEREBY AGREED, THAT
A. Property responsibility for meeting and conforming to 1:hose J:equirc-
ments as set out in SECTION FOUR: DESIGN STANDhRDS and .sECTION FIVL:
IMPROVEMENTS of the SUBDIVISION REGULATIONS is hereby x-ecognized ~nd

11. The Director of Public florks, upon the advice and consent: of the Mayor,
shall direct the Owne.:: or his assigns and successors to J/ieet those re-
quirements as set out in SECTION FOUR: DESIGN STANDARDS and SECTION FIVE:
IMPROVENENTS of the SUBDIVISION REGULATIONS.
C. In the event an improvement district is created by the city to implement
those requirements as set out in SECTION FOUR: DESIGN STANDARDS, and
SECT.ION FIVE: IMPROVEMENTS of the SUBDIVISION REGULllTIOllS for those
streets or streets fronting that tract of 13no as described in Paragraph
No.1 and the neighboring tract of lands, the Owner or his assigns and
successions will not oppose .its creatioil

D. In the event an improvement district is created by the City to
accomplish the intent of SECTION FOUR: DESIGN STANDARDS and
SECTION FIVE: IMPROVEMENTS of the SUBDIVISION REGULATIONS, the
costs accessable shall be of direct benefit to that property
as described in Paragraph No.1 and shaJ.I not be costs that are
disproportionate ,.,ith costs accessable to other nearby and like
properties.
E. Upon execution of this DEVELOPMENT AGREEMENT by the City and Owners,
the City will waive the guarantees for public improvements as set
out in SECTION THREE: PROCEDURE (Subsection C., Paragraph 5.) of
the SUBDIVISION REGULATIONS
F. This agreement is executed by the Owner pUl'suant to the SUBDIVISION
REGULATIONS of the CITY OF WHEAT RIDGE, passed, approved and adopted
February 7, Z972, as Qmendcd.
G. The Parties hereto agree that this DEVELOPMENT AGREEMENT, by its
terms, shall be binding upon the City and the Owner, and upon the
assigns and successors thereof; and shall constitute covenants
running with the described property.
This DEVELOPMENT AGREEMENT shall be recorded with the County Clerk and
Recorder.
IN WITNESSTH WHEREOF, the parties have set their hands and seals on
the date first shown.
