WHEREAS, AppleloJood Village Shopping Center and the City of Wheat
Ihuge, State of Colorado are desirous of estClblishing a development plan
for the future development of the Center.
"JOW, THEREFORE, IT IS ,\CRl:ED /\S FOLLOWS:
1. Development of the Center shall occur subsLlIltially in 3ccor-
dance "ith the Official Development Plan marked Exhibit "A", attached hereto
anu incorporated herein by reference.
2. LanllsL:l]>cd or greenbelt areas numbered and keyed on the drawing
h;l ve 1)('en comput cd by a reg i s t ered, profess ional archi teet in a breakdown
for e:lch :lrea, which breakuO\m appears in documents marked Exhibit "B" att:lched
hereto :lnd incorporated herein by reference.
3. Size of all areas in the Center pertinent for the Plan are set
forth 1n the st:ltisties summary \\'hich appears on the fxhibit "A".
4. The refen,nce on Exhibit "A" to new bndsc:lping to be installed
concurrcnt l'Ii th new bui Iding Lonstruct ion refers to construction of the bui ld-
lng shOlm on the ur;]\,ing :ldjaLent to greenbelt area 11 and the proposed addition

5. The refcH-nce in the ];1I1dsc:lpe plan to new landscaping to be
defLrrclll'nLonpasses uevelopincnt of grecnbelt areas which cannot at the present
time 1,e Lonverted by the owner to greenbelt due to existing lease requirements
with present tenants of the Center. Applewood Village will install the deferred
:lrcas "t such time :lS current contractual obligations with existing tenants
expire and may be nnegotiated. At that time or prior thereto, if Appleh'ood
Village acquires additional adjacent ground \\'hich it might utilize for green-
belt pllrposes, o;uch ground may be suhstituted in the Plan for the deferred areas
of like sqllClre footage.
6. Tr:lffic areas designated on the Plan as "service drives" and
traffic directions indicated with regard thereto shall be posted with signs
at the o\\ner's expense.
7. Authorized uses l'Iithin the subject property shall be those
currently allowed in a C-l zone district except the existing building In the
northeast corner of the tract shall be limited to uses allowed in the R-C
zone district.

8. All 1ill1(lsc:lping shall contain a comhination of t\\:o or more
of the following: grass, flowers, shrubbery, deciduous :md coniferous trees.
In :lddition, ony combinotion of b;nk, rock or orn:JJnental objects m:lY be used,
but in :lny event of such 3rea of use shall not exceed t\\enty (20) percent of
the tot:ll landscaped area. All natur3l gret:nc>ry shall be maintained in a
living condition :lI1d :lll landsclped :Hea shall be maintained in an orderly
manner.
9. The parking area to building area ratio shall be 3.06 to 1 or
at the developer's option, a minimum requiremt:nt shall be the parking re-
quiremt:nt for the combination of the various uses at the time of new develop-
ment. Any significant change in total parking spaces or circulation within
the p:Hking area shall be reviewed and approved by the Oirector of Community
Oevelopment, or the Planning Cummission and City Council prior to the change.
10. All street improvc'mcnts including curb, gutter and sidewalk
will be in place or an escrow \\li11 be supplied by the developer to accomplish
a]l required improvements subject to the approval of the City's Public Works
[)c>partmt:nt prior to the issuance of building permits within the development.
All streets abutting the property s]13l1 have one,half street paving, curb,
gutter :m,1 sidewcllk the design of \\:hich has to be approved by the City's Public
l\'orks 01 pdrtlllent peior to const euct ion.

tions with existing tenants expires, dnd may be rencgotiated.
12. Upon 3doption of the Plan by the City of 1I'heat Ridge and the
cxecution of this :lgrccJnent, ;ll1d the conditions includcd herein, building permits
",ill be issued by the City upon requcst with regard to the project construction
depicted on the Plan.
