THIS DEVELOPMENT AGREEMENT, as authorized by the SUBDIVISION REGULATIONS of

WHEREAS, the Owner is the titled Owner of a tract of land in the City of
Wheat Ridge, County of Jefferson, State of Colora~o. described as fo~lows
That part of the SW% of the S~~ of the NE% Section 25, Township 3
South, Range 59 West of the 5th P.M., described as follows: Beginning
at a point 40' East and 30' North of the SW corner of the NE% of
said Section 25, said point being on the East right-of-way line of
Wadsworth Boulevard; thence North along said East right-of-way
line of Wadsworth Boulevard a distance of 201.0'; thence East and
at right angles to said East right-of-way line of Wadsworth Boulevard
a distance of 155.0'; thence South and parallel with said right-of-way
line a distance of 201.0'; thence West a distance of 165.0' to the Point

ments and completion or non-completion of those improvellients as required by
SECTION FIVE' IMPROVEMENTS of the SUBDIVISION REGULATIONS will make no
significant change at the present in those streets frontinG that trilct of
land as described in Plragraph No.1, and the neighboring tract.s of land:

DIVISION REGUL'TIONS of the City, this aoreement is hereby determined ta

NOW, THEREFORE, IT IS HEREfY A~P[ED, Th~T
A, The responsibility for meetinq, confonninq to and providinr] those reqllire-
ments as set out in the SUBDIVISION REGULATIONS Of the City is hereby
recognized by Owner,
B, The Director of PubllC Works, upon the advice and consent of the Mayor,
shall direct the Owner or hi~ assigns and successors to meet those require-
ments as set out in the SUBDIVISION REGULATIONS of the City
C, Upon receipt of such notice to furnish or construct the public improvement
as required under the SUBDIVISION REGULATIONS of t.he City, Owner hereby
agrees to construct and furnish at Owner's cost, such improvement.s as are
required by the SUBDIVISION REGULATIONS of the City, and to do so in con-
formance with the design standards of the SUBDIVISION REGULATIONS of the City,
D. In the event an impl'o'jpment district is created by the City to imorove or
provide those reouiren:ents as set out in the SUBDIVISION REGULATIONS for
those streets or streets fronting that t.ract of land as de~cribed in

his assigns and successors agree not to oppose its creation,

accessable aqainst the property as described in Paraaraph No, 1 shall not
be disproportionate wit.h cost~ ~ccessable to other nearby and like properties

F. Upon execution of this DEVELOPMENT AGREEMENT by the lty and Owners, the
City will waive the immediate rjUarantees for public mprovements as set
out in the SUBDIVISION REGUL~TIOHS of the (it),
G. This agreement is executed by the Owner pursuant to the SUBDIVISION REGULA-
TIONS of the CITY OF WHE~T RIDGE.
H. The Parties hereto agree that this DEVELOPMENT AGREEMENT, by its terms,
shall be binding upon the City and the Owner, and upon the assigns and
successors thereof; and shall constitute covenants running with the described
property.
This DEVELOPMENT AGREEMENT shall be recorded with the County Clerk and Recorder.
IN WITNESS WHEREOF, the parties have set their hands and seals on the date first
shown.
