DEVELOPMENT COVENANT

THIS DEVELOPMENT COVENANT is entered into this 11th day
of ,Tll1 y , 19 89 ,between the City of Wheat Ridge,
a Municipal Corporation, hereinafter referred to as City,
and Glenn Daughenbaugh , hereinafter referred to
as Owner, and concerns property located at
4300 Kivling Street

WITNESSETH:
WHEREAS, Owner is the titled Owner of a tract of land in the City
of Wheat Ridge, County of Jefferson, State of Colorado, more
fully described in Exhibit A, which is attached hereto and
expressly made a part hereof (which property is hereinafter
referred to as "the Property");
WHEREAS, Owner received approval of rezoning and site plan
approval by the City of Wheat Ridge on February 9. 1987
and such approval was partly conditioned upon platting of an
ingress/egress easement and development of such easement to
facilitate vehicular circulation between properties to the north
and south of such property; and
WHEREAS, a plat and site plan which illustrates the location and
extent of such easement has been recorded with the Jefferson
County Clerk and Recorder under Reception Numbers 87093521 and
87093522 ,and is attached hereto for reference; and
WHEREAS, Owner has been issued a Building Permit for development
of the property and has completed such development to an extent
that all codes and regulations of the City have been met, however
physical connection to properties north and south that will
require removal and reconstruction of concrete curb, and
construction of bridges across OULETTE IRRIGATION DITCH, has not
been accomplished at this time; and
WHEREAS, Owner desires a Certificate of Occupancy for such
property prior to development of such physical connections
described above.
NOW THEREFORE, IT IS HEREBY AGREED THAT:
1. The responsibility for constructing such physical
connections described above and incurring expenses related
thereto, is hereby recognized by Owner.
However, in light of development occurring adjacent to and
north of the property and the benefit which will be received
from these connections, the Owner of 4300 Kipling shall be
responsible only for the western connection across the

ditch. The design of said connection shall be approved by
the Oulette Ditch Company prior to any construction.
2.
The Director of Planning and Development, upon development
of properties to the north and/or south, shall give written
notice directing the owner or his assigns and successors to
meet the requirement to construct such physical connection
as described above.

3. Upon receipt of such notice to furnish or construct the
vehicular access improvement as required by the approved
site plan, Owner hereby agrees to construct and furnish
at Owner's cost, such improvements as are required.
4. Owner agrees to construct, or cause to be constructed, all
such improvements required hereby within THIRTY days of
the receipt of the notice described in the preceding para-
graph. In the event such improvements are not completed
within such time, the City is hereby authorized to enter
upon the Property, either by its employees or through
agents, contractors, or subcontractors, and to complete the
improvements described herein, said completion to be
accomplished at Owner's sole expense. Owner agrees to pay
for all improvements so made within 30 days of the date of
completion, Owner further agreeing that any amount resulting
from his failure to pay for any improvement thus completed
shall constitute a lien upon the property above described in
the actual amount of the improvements completed, less any
payments made by Owner, plus interest on the amount unpaid
at 10 percent per annum from the date of completion, plus
any costs incurred by the City in collecting same, including
court costs and attorney's fees.
5. The parties hereto agree that this DEVELOPMENT COVENANT, by
its terms, shall be binding upon the City and the Owner and
upon the assigns and successors thereof; and shall consti-
tute covenants running with the Property.
6. This DEVELOPMENT COVENANT shall be recorded with the Clerk
and Recorder of Jefferson County, Colorado, and shall
constitute a continuing covenant running with the land,
providing however, that this DEVELOPMENT COVENANT shall be
released by the City upon the completion by the Owner of the
improvements described herein, which release shall be
evidenced by a signed document attested to by the City Clerk
and bearing the City's seal, which document shall likewise
be recorded.
SPECIAL PROVISIONS AND AGREEMENT:
Owner shall be responsible only for improvements related to
the western ditch crossing.

Commencing at the West Quarter Corner of said Section 22; thence
N 89014'16" E a distance of 45.00 feet to the easterly right-of-
way of Kipling Street, also being the TRUE POINT OF BEGINNING;
Thence S 00021'30" E a distance of 58.37 feet to the Southeast
Corner of that tract of land recorded in Book 2120 at Page 266,
County of Jefferson, State of Colorado, said corner also being
the Southwest corner of that tract of land recorded under
Reception No. 86078111, County of Jefferson, State of Colorado;
Thence N 89043'33" E a distance of 301.02 feet;
Thence N 00019'23" W a distance of 138.09 feet;
