and convey to the City of Wheat Ridge, a Municipal corporation,

A Perpetual Easement upon, over and through the following
described real property situate within the City of Wheat Ridge,
County of Jefferson, State of Colorado, to-wit:
A part of the SE 1/4 of the NW 1/4 of the SW 1/4 of
Section 22, Township 3 South, Range 69 West, of the
6th principal meridian, City of Wheat Ridge, County
of Jefferson, State of Colorado, more particularly
described as follows:
Commencing at the SW corner of the above described
parcel which is the true point of beginning thence
N 89050'30" E and along the South boundary a distance of
50.00 feet; thence N 00014'OO'' Wand parallel to the
East boundary a distance of 90.06 feet; thence
589046'00" W a distance of 50.00 feet; thence SOOo14'OO"
E and along the West property line a distance of 90.00
feet to the point of beginning.
The above described parcel contains 4,501 square feet
(0.103 acres), more or less for road purposes.
Said Easement shall be perpetual in nature and shall be
dedicated to public use for path, roadway, trail and other public
access and travel purposes. The property conveyed hereby shall be
maintained by Grantee.

THIS AGREEMENT TO GRANT CONSTRUCTION EASm-IENT is made this

WHEREAS, Grantor owns the real property located at
4100 - 4154 Kipling Street, within the City of Wheat Ridge, Colorado;
WHEREAS, Grantee is constructing, and will hereafter maintain,
certain drainage improvements upon and within Grantor's property
which improvements are for the benefit of Grantor and all other
property owners upon and affected by waters flowing through Lena
Gulch;
WHEREAS, Grantor's property, or the portion thereof described
in Exhibit A attached hereto and made a part hereof, is necessary
for the construction and maintenance by Grantee of said drainage
improvements;
WHEREAS, Grantor and Gran"tee have agreed upon the following
terms and conditions for Grantor's grant of a cons.truction easement
to Grantee concerning the property described above in Exhibit A;
NOW, THEREFORE, the parties above named, for themselves, their
heirs, successors and assigns, do hereby agree as follows:
1. Grantor agrees to grant to Grantee a construction easement
over and upon the real property described in Exhibit A attached
hereto, on a form prepared by Grantee but acceptable to Grantor.
Said easement shall be for a period of one year and shall entitle
Grantee. its agents, contractors, and assigns to come upon Grantor's
property for the purposes of surveying, preparing, constructing and
maintaining improvements to Lena Gulch.
2. As consideration to Grantor for the grant herein described,
Grantee agrees to pay to Grantor, on the date of delivery of
the easement described in paragraph 3 below, the sum of
$3,065.00.

The parties above names, for themselves, their heirs,
successors and assigns, do hereby agree as follows:
1. Grantor agrees to grant to Grantee a Perpetual Easement
to, over and upon the real property described in Exhibit A
attached hereto and made a part hereof, on a form prepared by
Grantee but acceptable to Grantor.
Said easement shall be
perpetual in nature and shall be dedicated to public use for
path, roadway, trail and other public access and travel purposes.
2. As consideration to Grantor for the grant herein described,
Grantee agrees to pay to Grantor, on the date of delivery of the
easement described in paragraph 3 below, the sum of $540.00
3. Grantor shall deliver to Grantee the easement described
in paragraph 1 above no later than ten (10) days from the date hereof.

described herein, Grantor does hereby grant, bargain, sell, assign and

erty described on Exhibit A, which is attached hereto and expressly
incorporated herein. It lS expressly understood and agreed by and
between the parties, and is expressly made a portion of the grant hereby
conveyed, that the Easement hereby granted is for the purpose of
allowing Grantee to enter upon the property described for the purpose
of gaining access to an area where Grantee will be constructing flood
control improvements which will be of benefit to Grantor and other
citizens of The City of Wheat Ridge, as well as to residents of
surrounding areas.
The Easement granted hereby shall entitle Grantee to enter upon
the described property for the purpose of gaining access to the
construction of such improvements as may be contemplated and required
by Grantee. During the term of this easement, which shall be effective
from October 1, 1980, through and including September 30, 1981, Grantee
agrees that it shall be responsible to repair or compensate Grantor for
any damages caused by Grantee's utilization of this Easement to
Grantor's surrounding property.
