WHEREAS, Grantor owns the real property located at 4100 - 4154 Kipling Street, within the City of Wheat Ridge, Colorado; WHEREAS, Grantee is constructing, and will hereafter maintain, certain drainage improvements upon and within Grantor's property which improvements are for the benefit of Grantor and all other property owners upon and affected by waters flowing through Lena Gulch; WHEREAS, Grantor's property, or the portion thereof described in Exhibit A attached hereto and made a part hereof, is necessary for the construction and maintenance by Grantee of said drainage improvements; WHEREAS, Grantor and Gran"tee have agreed upon the following terms and conditions for Grantor's grant of a cons.truction easement to Grantee concerning the property described above in Exhibit A; NOW, THEREFORE, the parties above named, for themselves, their heirs, successors and assigns, do hereby agree as follows: 1.
