(Grantor) and
Ridge (Grantee).
WHEREAS, Grantor owns the real property located at 3975 Kipling
Street within the City of Wheat Ridge, Colorado, which is legally
described in Exhibit A which is attached hereto and made a part
hereof;
WHEREAS, Grantee is constructing, and will hereafter maintain,
certain drainage improvements upon and within Grantor's property
which improvements are for the benefit of Grantor and all property
owners upon and affected by waters flowing through Lena Gulch;
WHEREAS, it is the intent of Grantee to develop and maintain
open space, recreational and scenic facilities and opportunities
upon and within Grantor's property for the general health, safety
and welfare of Grantor and the other citizens of the City of Wheat
Ridge;
WHEREAS, Grantor's property, or the portions thereof described
in Exhibits Band C attached hereto and made a part hereof, are
necessary for the construction and maintenance by Grantee of said
drainage improvements and said open space facilities;
WHEREAS, Grantor and Grantee have agreed upon the following
terms and conditions for Grantor's conveyance of easements to
Grantee on the property described in Exhibits Band C;
NOW, THEREFORE, the parties above named, for themselves,
their heirs, successors and assigns, do hereby agree as follows:
1. Grantor agrees to convey to Grantee as permanent
easement all of the property contained in the legal description
of Exhibit B without exception.
2. Grantor agrees to convey to Grantee as a temporary
construction easement for six months the property described
above in Exhibit C.

3. Grantee agrees to modify the channel configuration

through Grantor's property ln such a manner as to allow Grantor

continued vehicular access to and egress from those buildings
presently maintained by Grantor on the property described in
Exhibit A.

4. As consideration to Grantor for the grant herein
described, Grantee agrees to pay to Grantor, on the date of
delivery of the easements described in paragraphs 1 and 2 above,
the sum of $729.00.
5. The parties agree to cooperate completely and fully
in the preparation of all closing documents necessary to effect
this transaction.

The subject property is located on the Westerly side
of Kipling street, approximately 762 feet North of West
38th Avenue and carries the mailing address of 3975 Kipling
street, City of Wheat Ridge, Jefferson County, Colorado.
The property is legally described as follows, to wit:
That part of the East one-half of the East one-
half of the Southeast one-quarter of the Southeast
one-quarter, Section 21, Township 3 South, Range 69
West of the 6th P.M., lying North of a line drawn
from a point on the East side of said lands, begin-
ning at a point 762 feet North of the Southeast corner
of said Section and running in a straight line to
a point 600 feet North of the South line of said
Section to a point in the West line of said lands;
EXCEPT the North 138.28 feet thereof; EXCEPT that
portion lying within Kipling Street; together with
the water right consisting of 5 1/5 inch of water,
together with the ditch rights for conveying same
as more particularly set forth in instrument recorded
June 4, 1937, in Book 393, page 1, Jefferson County
Records. Also the water right consisting of three
inches of water together with the ditch right for
conveying same as more particularly set forth
in instrument recorded June 4, 1937 in Book 393
page 2, Jefferson County Records."
