KNOW ALL MEN BY THESE PRESENTS, that Leona T. McDaniel 4406 Pierson Street
of Wheat Ridge, Jefferson
County, State of Colorado
hereinafter called the
"grantor", for and in consideration of the sum of ONE DOLLAR ($1.00), and other
valuable consideration to in hand paid by the City of Wheat Ridge, State
of Colorado, hereinafter called the "City" "grantees", receipt of which is hereby
acknowledged, has given and granted and by these presents does hereby give and
grant unto the said grantees, their heirs, successors or assigns a PERPETUAL
EASEMENT on, along, over, under and across the following described premises to-wit:
A part of certain tracts of land situated in the Southeast one-quarter
of the Northwest one-quarter, Section 21, Township 3 South, Range 69
West of which is particularly described as the North four feet of the
tracts of land described as follows:
Beginning at a point 835.92 feet West of the center line of Section 21
on the North line of West 44th Avenue; thence North 200 feet; thence
West 80 feet; thence South 200 feet; thence East 80 feet to the point
of beginning; AND,
Commencing at a point 200 feet West of the Southeast corner of tract
heretofore conveyed by Warranty Deed to Leonard B. Fletcher dated
February 3, 1922 and recorded February 4, 1922 in Jefferson County;
said point being the Southwest corner of said Fletcher tract and on the
North boundary line of West 44th Avenue; thence North along West
boundary line of said Fletcher tract 200 feet; thence West at right
angles 50 feet; thence South at right angles and parallel to said
East 1 ine 200 feet to the North boundary of said yJest 44th Avenue;
thence East to the place of beginning
for the purpose of a storm drainage way for the surface runoff tributary of
said certain tracts from Pierson Street
of which the City will construct, operate and maintain such facilities con-
Sisting of a surface drainage way or a combination surface storm drain and
underground storm sewer.
And the Grantor(s) hereby covenant(s) with the Grantees that it has good title
to the aforedescribed premises; that it has good and lawful right to grant this
easement, that it will warrant and defend the title and quiet possession thereof
against the lawful claims of all person whomsoever.
