PERMANENT EASEMENT
KNOW ALL MEN BY THESE PRESENTS, that Marilyn K. Shotwell of
Jefferson County, State of Colorado, hereinafter called the
"grantor" for and in consideration of the sum of Ten and 00/100
Dollars ($10.00) and other valuable consideration to her in hand
paid by the City of Wheat Ridge, hereinafter called "City", do
hereby give and grant to said City PERMANENT RIGHT-OF-WAY AND
EASEMENT on, along, over and across the following described
premises to-wit:

A Permanent Slope Easement on the south 10 feet of a tract
of land described at Reception No. 730550, recorded in the
County of Jefferson on September 2, 1975, excepting the east
65 feet of said tract; said parcel being in the Southwest
quarter of the Northwest quarter of Section 23, Township 3
South, Range 69 West of the 6th P.M.
Also known and numbered as 8241 West 44th Avenue
For the purpose of maintenance of a transition from the existing
sidewalk elevation to existing property elevations.
Subject to the following terms and conditions:
Twenty five feet of the existing railroad fence will be
removed upon execution of this agreement.
And the Grantor hereby covenants with the Grantee that she has
good title to the aforedescribed premises; that she has good and
lawful right to grant this easement.
